PIP rejection assist offered "palliative not curative"

Hi All,

Dr. Settlement, auto insurance claims expert here to offer some free ammo to fight back versus termination of benefits.

First party insurance adjusters are more frequently terminating benefits under Personal Injury Protection (PIP) or MedPay coverage. They will use any number of alleged justifications. One of the popular excuses is that the treatments are not "reasonable and necessary" because they do not "cure" the underlying problem.

I have some information that could help those who have experienced a challenge to the payment of expenses for chiropractic or other care on the basis that the treatments are "merely palliative, not curative".

The first response is that these are terms and conditions they are trying to add to the insurance policy. The second response to this is that payments DO come for pain relieving drugs, even though they are palliative, not curative. Hence, they cannot allow one and not the other.

This is the place that helped me so much through my problems after the MVA. They were great to me and helped me settle my claim for myself. If anyone needs help they are just the greatest.

Thank you Doctor Settlement, THANK YOU! Just this past month my own insurance company stopped paying my chiropractic billings. They said that the treatments were not curing me. So your post WAS very timely and your auto insurance letter will be helpful.

I looked at your super helpful auto insurance accident site www.SettlementCentral.Com and free legal information on insurance claims is there. I did send you a message today asking for that letter you mentioned.

You know I'd never endorse anyone unless I'd used them myself. With SettlementCentral and the help of my friends here I managed to make it thru this horrible ordeal. They gave me all the information and help to settle my claim for the full amount. If you study and really get into the information they give you then you know what you need to do. I appreciate all they did for me and although it does cost some money in a time where we have so little it's well worth it. I talked to an attorney and he emailed me and even called to talk to me about my case. They gave me all I needed.

I do support them in every way. I had mentioned them so many times before and now I'm glad they came to the form to offer some help.

Sorry I haven't written anyone for so long. Right now I'm suffering with a broken toe (my dog did it) and it's just one more painful thing to deal with.

I know everyone is having a really hard time now with the way money is. It was bad for me but it's gotten so much worse for those of you who are suffering from a MVA.

There were times I wanted to give up with the pain I was going thru and the money I didn't have. It did all work out so hang in there and do the best you can.

I miss talking to you all. Red ....your the best.

Bad Apples Ruin It

Here's the thing about insurance companies - I'm a PIP/Medpay adjuster - it's the bad apples that ruin it for people who have legitimate injuries.

There are people who claim injuries just to get free chiropractic care - there's no possible way that you can be 100% healthy pre-accident, then get in a collision with only cosmetic damage, and end up with injuries that are so severe you need chiropractic care for 12 weeks. But people pull this crap with insurance companies every single day, because they want free care. There are also the attorneys who will refer their clients to chiropractors or clinics that prescribe MRIs for every person, even if it's not clinically necessary. Same thing for EMGs, repeat X-rays (have them review the ones from your ER visit if you have some), etc. A simple whiplash injury shouldn't require an MRI within the first 6 weeks after the accident.

You also have to be smart about the care that you choose. Many many chiropractors give care that is passive and doesn't help strengthen the injured muscles. Any chiropractic plan of care should include stretching, strengthening, and exercises to retrain your muscles. Neuromuscular re-education, posture training, a home exercise program - these are all plans of care that will help you heal faster.

So if you're in a car accident, try this - seek out a treatment provider that gives you a definite plan of care and a goal of getting you better - the chiropractors that preach "wellness" or "maintenance" or preach on and on about subluxations - they will ask you to treat passively and for a long period of time, when you can easily heal faster from a typical whiplash injury within 4-12 weeks.

For more severe injuries, such as fractures, dislocations, etc - go see an orthopedist and a physical therapist.

Dog Breaks Owner's Toe

LOL, I can see the headlines on the front page of your local newspaper. How you doin? So good to hear from you. We all wish you the best of luck on your broken toe-I can only imagine what the dog did to break it.

Times are hard on everyone, I think. The economy is so bad. And, I don't see it getting better any time soon. In these times, all we can do is try and help one another get through it.

Keep dropping by once in awhile. We miss you.
