Queen of Peace fighting state ban
Thursday, January 24, 2008
BY MATTHEW FUTTERMAN
Star-Ledger Staff
Lawyers for Queen of Peace High and the New Jersey State High School Athletic Association squared off in state court in Bergen County yesterday over whether the wrestling team will be able to compete in the state team tournament next month.
The NJSIAA ruled last month that Queen of Peace, located in North Arlington, had violated state rules against recruiting after the school hired wrestling coach Scott Weaver away from nearby rival St. Mary's to start a wrestling program.
During the summer 10 wrestlers, six from St. Mary's, decided to transfer to Queen of Peace. Two other wrestlers from Nutley and two from Bergen Catholic also decided to transfer to wrestle with Weaver and assistant coach Damion Logan, a popular coach at a Paramus wrestling center.
Michael Herbert, a lawyer for the NJSIAA, said the transfers were "unprecedented" and clear evidence that recruiting had occurred.
"If we allow kids to make wholesale transfers for any kind of athletic advantage we might as well throw out any notion of fair competition," Herbert said.
But Patrick Jennings, a lawyer for Queen of Peace, said the NJSIAA overstepped its authority when it tossed Queen of Peace from the state team competition without any direct evidence of recruiting.
"There is no proof here," Jennings said.
State Chancery Court Judge Robert P. Contillo questioned both attorneys during the two hour and fifteen minute hearing. He appeared skeptical of the NJSIAA's decision to assume recruitment just because the wrestlers had decided to follow the coach, and he was critical of Queen of Peace for denying that the students had sought an athletic advantage.
"It's a difficult, complicated case," said Contillo, who promised to issue a ruling by Monday.

I know Coach Weaver and have been to Coach Logan's training facility many time. They are both excellent coaches, and I can not blame any HS student for wanting to be apart of the new program that they started this year at Queen of Peace.
The unfortunate events that have followed their hirings and the migration of talent to that school are understandable.
Queen of Peace built a training facility for the team, hired 2 of the best coaches in North Jersey, and now are facing a law suit over the fact that students want to wrestle there.
