She cannot sue you for what occured. When you sign on to work in special education, a certain amount of risk like this is part of the package. The school has insurance to cover this.

What you need to do immediately is convene an IEP meeting. Get the teachers involved (and aid), the principal, the sped director, whomever operates as a behavioral specialist, and the psyche to attend. I would also very, very strongly suggest that you also bring a seasoned advocate, and if you cannot find one, at least bring your most level-headed friend.

You must respectfully demand that the school perform a full FBA to determine what it is that is triggering these biting episodes, and what can be done to prevent them from happening. The school needs to have an intervention plan put into place, not only to protect the staff working with him, but also to protect your child. (It is most common for injuries to the child to occur during the heat of the moment when ill-trained staff are trying to deal with an outburst).

You must also file a blanket notice of intent to tape all meetings. I will go into detail about this later today.

Do not worry, you cannot be sued. The aid in question is popping off at the mouth cause she is upset she got hurt. If she doesn't realize that part of the job in working with autistic children is the risk of being kicked, bit, hit, pinched, peed on, etc. then she needs to get retrained. When dealing with non-verbal children, sometimes the only way they have to communicate their frustration is meltdown behaviors.

I will not tell you to pull your child to homeschool or not. That is a decision you must make based upon your circumstances. We are homeschooling my boy, not because he might hurt someone else, but because my school district did not feel the inclination to provide him with a proper program, and we are making very good progress without their help thank you very much (assholes). But it is an incredible amount of work, and not everyone has the time or stamina to do so.
