Each state has different laws so if you tell me which state you are in the answer may or may not be different...
However, the first school district was following the law, the second is not. Not having the evaluations completed is NOT a reason to not provide services when he already has a DX. The law provides they will consider information from other sources. So they should be providing services now based on his DX.
Have you tried contacting an attorney? Unfortunatly I feel you may be destined to have problems with this school district doing what is appropriate, their dragging their feet might be an omen of things to come, sad to say. I hope not.
