Hate to burst your bubble but for assault (even misdemeanor charge) to be charged there must be documented physical evidence of bodily harm. That wasn't there when Potato went to the cops initially so criminal charge is out. He could try to press civil suit if he has a friend or family that's a lawyer, but no real lawyer is going to take that case because without any damage there is no reward.
