Response to Simple Minds

For a start what makes a "FACT"? Is it that it is by it's very nature undisputable or that conclusive evidence can be required? No, apparently all that is needed for something to become a "FACT" is for it to be typed at the end of a statement!!!

Let's deal with these one at a time:

"It is obvious that the former business failed. FACT"

The Company was placed into receivership. This was not done by the creditors, as is often the case, but by the owner. Yes that is correct, the owner. An owner can cease to trade and liquidate the company at any time. Does this show that Bob lost any money? No. Does it show he invested money? No.

Oh, and the main advantage of the Company putting itself into Liquidation: they get to choose the Liquidator - they get to choose who will investigate the affairs of the company and investigate the transactions made by the Company. (Fact - I have conclusive practitioner texts and case law to back it up!).

"An individual cannot do that in a limited company, it is a FACT that the company failed owned by several parties and shareholders yet certain group’s keep harping on against one individual. FACT"

A company can be owned by different shareholders but still remain at the exclusive disposal of one person. Who was the Chairman/ Managing Director/ solitary director during the period immediately prior to the Company being placed into liquidation? There was one person making the decisions - Mr. Bob Phillips. The shareholders, if not Directors do not have a voice in the day-t-day running of the Company.

"It is obvious that the former business failed because of its financial support in funding Super League ice hockey and the enormous hockey debts amassing some £2.5 million before BP’s takeover. FACT"

There are a number of reasons mooted for why the business failed. Because you believe in your opinion does not make it a "FACT". Are you saying that an astute business man such as Bob Phillips purchased the Company from Celtic Leisure without investigating the Balance Sheet of the Company??? Incidentally, how much money did Reds (Property) Limited make during this same period? One way to organise your finances is to have 2 companies - one which incurs liabilities and one which receives money. The one with liabilities can then be liquidated. How do we know that that is not what has happened?

"You can blame individuals for the failing of the Devils but the business had failed well before BP’s takeover as I have contacted the receiver and know the history. FACT"

So you have contacted the receiver appointed by Bob Phillips? Are you a creditor? Are you a legal representative of any of the parties involved? Are you Bob? There is no way in hell a receiver would hand out private information on a company to a member of the general public who phones up and asks.

"Naturally those who spouted that they would come forward in the summer with bags of funding, where are they – not available. FACT"

So you are suggesting that the investors who contacted the ISL representative Ian Taylor should now reveal themselves to fund the club, despite the fact that it is still owned by Bob Phillips and Brian Candy? Why should they invest whilst they are still running the show?

"I wish with the offer on the table by BC and who knows BP – why you cannot get your act together and save ice hockey in Wales, something you are all intent on destroying. FACT"

Again, not quite sure why that question is a "FACT" but let's give it some consideration. If you see my posting futher down, you will see the scepticism that I have for this offer. There are a number of ways this might be exploited to the detriment of the Cardiff fans and club. This is an offer made very late in the day so that Brian and Bob can blame the fans for the failure of their farce. If they were serious about their proposal why was more time not given?

"It has been stated on this forum that the fans were given the option of BNL at the very last meeting held and you all stated “you only wanted ISL and would not support BNL hockey because the standard was to poor”. FACT – or have you all forgot?"

Has that been stated on this forum? Where? By whom? I think I must have missed it. Wasn't that after the ISL had thrown HIM out??

"I have been told that even the main sponsor of last year stood up in the last meeting in front of the fans and stated he would not support BNL hockey under any circumstances because of the poor quality. FACT"

The way I heard it was that BT decided not to renew their sponsorship of the Cardiff Devils (they had reached the end of the previous agreement, in part because of the involvement with Bob Phillips and in part because the coverage given to the BNL was not as great as with ISL and so they did not consider that it would be a wise investment.

"So it is a fact that a certain group did not want to support ISL, then you wanted to own the ice rink, then you wanted BP to leave, now you want Brian Candy to leave and low and behold you are all spouting that you will all now support the BNL. I really hope someone posts the number times you lot have moved the goalposts and the conditions of returning to the rink. FACT"

The goalposts have not changed, at least not from us. We were initially told that the club would be out into the BNL if we did not raise £250,000 in a short space of time. 3 days later we had to raise £400,000. The council were to blame because they had not done X, Y and Z. then we listened to what we were being told, the changing figures, the talk of Nantgarw, the nasty council, the season tickets in the new arena, etc and gradually realised that it did not all add up. Bob used one of his former Employees to make application to the BNL after he had failed with two other applications, and told everyone that he was no longer involved. Funnily enough nobody believed him. That's why we want Candy removed as well - no shifting of the goalposts there. You can change your name, and I still won't like you!

"I know for one that business fails and that’s hard for everyone but I also understand what the additional benefits received by the players were throughout their contract add up too, they were not that hard up and that's probably why they did not wish to leave. FACT"

What 'additional benefits'? Housing, transport, etc? That happens with every team. If it was just money keeping them around, why have they signed 1 year deals elsewhere. Mo, for example, is getting older - typically longer deals are financially better for veterans.

"Bob Phillips lost more than anyone in his support to hockey, but twisted stories and postings have portrayed him as the villain. Maybe he is maybe he is not, one thing for sure, divided hockey will fail and the real loss will be to the juniors and us the fans. FACT "

Has he really? He had lost £300,000, then £500,000 and now £1 million. Has he ever had anything to back that up??

"Sort it out or give up hockey – there is a choice."

We'll sort it out, and that means Bob giving up hockey. It's for the best of the club.
