I think he should be able to get schnockered and wobble if he wants to. If he is standing and not driving...why the hell not. We have an agency here in Texas that really pisses me off (offends) called the TACB or something loke that...the agency that control liquer licenses, and the like. Last year they pulled some shit that raised a huge ruckus. They send officers into taverns on Friday nights and arrested people they thought were getting drunk. They arrested them just as soon as they stepped out of the pubs, or asked them to step out of the pubs. These people hadn't gotten into a car. They hadn't even gotten as far as calling a taxi. I believe their constitutional rights were violated big time. They hadn't made scenes or anything, but were judged by these agents without even so much as a field sobriety test, or probable cause for a test. I don't know whatever became of the case either, as I haven't heard anymore about it, and I haven't researched it because I just now remembered it with your wobble story.
