Sir Moi guilty

A LEADERSHIP Tribunal yesterday found suspended Petroleum and Energy Minister and Kairuku Hiri MP Sir Moi Avei guilty of five of nine allegations of misconduct in office.
And the former deputy Prime Minister’s fate will be decided on April 24, when submissions will be made on the appropriate penalty to be imposed on him.
In a unanimous decision read out by the tribunal chairman, Justice Timothy Hinchliffe, Sir Moi was found guilty of five allegations, while clearing him of the other four due to lack of evidence.
Sir Moi was suspended from duties last Oct 10 upon presentation of the nine allegations to the tribunal panel by the Public Prosecutor.
The Ombudsman Commission referred the leader to the Public Prosecutor on March 6, last year. The allegations relate to:
1. Misapplication of his electorate’s 2002 District Support Grants between January and October 2002,
2. Failure to properly acquit the application of 2002 District Support Grants;
3. Failure to pay rent to National Housing Corporation (NHC) for a house he continued to occupy despite the fact that he was receiving housing allowances paid to him through his salary every fortnight by the National Parliament; and,
4. Failure to disclose to the Ombudsman Commission the outstanding rentals owing to NHC as liabilities as per Section 4 of the Organic Law on the Duties and Responsibilities of Leadership, which requires persons subject to the Leadership Code to disclose their liabilities such as loans or outstanding bills.
The tribunal conducted a hearing last year and early this year and Justice Hinchliffe said the leader was found guilty of allegations one, three, four, six and seven.
“In relation to allegation one, we find Sir Moi guilty in that, having been allocated K250,000 from the National Government in the form of three cheques being public money allocated for the development of the Kairuku-Hiri Open electorate in respect of year 2002, he failed to ensure that public money was properly applied to the rural infrastructure projects for which it had been allocated,” he said.
The panel said that allegations three and four which the tribunal also found the leader guilty of misconduct in office related to Sir Moi’s failure to properly acquit that public money as per the requirements of the Public Finances Management Act.
Justice Hinchliffe said: “In relation to allegation six, Sir Moi having entered into a tenancy agreement with the National Housing Corporation in 1995 over a rental property located at Section 51, Allotment 128, Konedobu, failed to pay the rentals as and when they fell due. “Therefore, we find the leader guilty of misconduct in office.”
For allegation seven Sir Moi was found guilty of knowingly, recklessly or negligently omitting to disclose to the Ombudsman Commission substantial information in relation to his rental liabilities in his annual statements for six consecutive reporting periods being for 1995 to 2001.
After the tribunal’s decision was handed down, Sir Moi’s lawyers said they would call three witnesses on mitigation prior to making submission on penalty.

How on earth can a candidate contest again if he has already being found guilty...
