as an legal aide representative, may i comment on the question as to what laws the governor of NIP sir j chan has broken when he (allegedly) terminated the lease agreement between malagan lodge hotel and madang resorts hotel ltd.in the absence of actual documents before me, i will comment generally on the letters of law.

1. sir J (& indeed his son byron chan)as MPS are subject to the leadership code administered by the Ombudsman commission of PNG.
2. sections 20 of the code, explicitly state that a leader holding public office must ensure that his decisions and actions do not question the integrity of his office (since this public office is owned by the people of new ireland).
3. the code is strict insofar that it categorically stipulates that a leader must never place him or fer in a position of conflict of interest or even, be seen to be in a conflict of interest.
4. shud a leader place himself in such a position and it can be proven in a court of law by the O.C. then that leader is deemed to have breached the leadership code and will automatically be dismissed from public office.

NOW IT MUST BE PROVEN THAT SIR J WAS A PARTY TO THE DECISION TO TERMINATE SIR PETER BARTERS CO OR AT LEAST, KNOWINGLY ALLOWED SUCH A DECISION TO BE MADE BUT DID NOTHING TO STOP IT.IF IT CAN BE PROVEN, THEN SIR J DYING DAYS WILL COME TO AN END.

i would suggest that the appropriate authorities in kavieng collate the facts (and not get emotional) and have them deposited with the investigation branch of the Ombudsman commission of PNG to determine whether corrupt practices are continuing under the regime of sir julius chan, and if so, dismiss him immediately from public office.

Everyone should know that once you use evidence at a leadership tribunal, you cannot use that evidence again for criminal prosecution. In legal terms, this is called double jeopardy and it is constitutionally not allowed in nearly all democracies.

Which means that the worst punishment a leadership tribunal can deliver is a slap on the wrist penalty regarding seeking office again. Most politicians hope for leadership tribunals because the worst penalties allow them to take a rest and then enter the political arena again and start stealing again. They are smiling all the while because they also know that the evidence now is tied up and will never be used in a criminal court.

Even if there was a criminal court case, we should all look at the fine example of Jimmy Maladina who has managed to keep court cases dragging on endlessly. Pretty soon most Papua New Guineans will be too young to even know who Jimmy Maladina is, much less what he did to swindle the people.

i visit kavieng town on a periodic basis travelling in along the boluminski highway.i notice kavieng township is dirty with very little infrastructure that would provide a platform for development.its roads are disgusting with little to nil kerb and guttering.water pressure at hotels and guests houses are poor.sewage is pityful.town planning completely non existent.business is bad getting worse.

Hi, guys. You know, if you have questions all you need to do is ask. Some of you seem like pretty sharp people. So are you interested in actual information, or are you just happy dealing with rumours and lies and stories by people who dont even have the courage to sign their name? Surely some of you are interested in having a real conversation.

But a few of you dont even bother. And it is just a few you have just scared the people who really want to talk reasonably off the site. You just come online and get really offensive. So big deal. Who cares? I mean, it is only yourself that you are fooling. But that, I think, is not the real problem. Being offensive is one thing it is a kind of childish, infantile thing, but so what. If it makes you feel like a big man to use ugly language and to spread evil rumours about people, so be it. But that is not your greatest failing. What is even worse is that you are supposedly smart people. Most of you are in school in Australia or New Zealand or even the States. And you are the future of this country and this province. So why dont you start practicing basic things like doing research to find out if you have your facts straight. If you dont start using your heads instead of your emotions you are never going to do this place any good.

But since you ask Ill give you a few facts. They call me the million kina man. That would be nice. More like the 0.4 million kina man. I am taking home about 450,000 kina per year. Yeah, that is a lot. But think about this. I took a cut in pay to come to New Ireland from the World Bank. I was doing fine. Working as a consultant for the World Bank, making between 800 and 1,000 US per day, big house in Virginia, nice neighbourhood, a job that took me all around the world to work in different countries. Hell, I was taking eight or nine trips a year to places like Thailand, China, Fiji, Samoa, Laos, Vietnam. It was nice. And it paid a lot more than I am getting now.

That is the way it is. If anyone had bothered to ask me I would have given you a straight answer right away. And you know, if you are in school and if you work hard at schooling and do good work you can be in the same place one day. If you are good at what you do I may even be able to help you out. The World Bank needs good people from the Pacific, and I have already helped several Papua New Guineans to get started as consultants for the Bank. But that is because they worked hard and did good work. Wanking doesnt make it. Being able to talk like a bully and swear doesnt do much for your CV. So the choice is yours.

And everyone says well, why the hell do we need some white American to come to New Ireland when we have perfectly good planners who can do the same work and for a lot less. Well, maybe. But here is another fact. When I got to New Ireland I started doing some research in to the Lihir Gold Mine and I found that the province had not been paid what it was due from the national government for the profits from the mine. So I started digging and doing some more research. The province was supposed to be paid 1% of the annual f.o.b. revenues from sales in what is called the Special Support Grant. That was supposed to be paid every year by National Government. But it had not been paid. And no one knew how much should have been paid.

So I contacted Lihir Gold, Limited, and asked them to provide me with the amount of gold they had sold every month from the start of production in June of 1997 until the end of 2008. And I asked them to provide me with the price of gold for every month since June of 1997, because that would tell me the total amount of income they received. And I asked them to provide me with the exchange rate between the kina and the US dollar for every month, since the gold was sold in US dollars, but the SSG is figured on the basis of the kina value. Then I took all those figures and put them in an Excel spreadsheet and calculated exactly what the national government should have paid us from 1997 to 2008. Then I researched and found out what the national government actually paid us. The difference was about K40 million.

We also calculated that the government owed over K15 million in Infrastructure Development Grants. They owed us nearly K350 million in major infrastructure projects. And they owed us K25 million from the New Ireland Trust Fund that was set up in 1996 and into which money has been paid every year, supposedly for New Ireland, but in fact we had not got any of it.

I did all the calculations and then I advised the Governor to invoke Clause 42 of the Lihir Memorandum of Agreement between the national government and the province, which is the dispute resolution agreement. This forced government to sit down with us and try to resolve the dispute. When we sat down we found out that National Government was completely unprepared. They had no idea either what they should have paid or what they actually did pay us. We were so much better prepared than they were that it was embarrassing. They were so used to going to a province and just being the big men and running over everyone that they were completely surprised when we had the facts and the figures and the information. And that was for one reason only several months of hard work to get the facts and make sure we had the information we needed.

We had four negotiating sessions with the government, and finally got them to admit that they owed us the money for SSG, IDG, infrastructure projects and the New Ireland Trust Fund. So when the Prime Minister came to New Ireland in February he gave a speech to the Provincial Assembly and admitted that they owed us at least K90.2 million for 2009 alone. And that they would have to pay more in the future.

This is a long process, and it is not easy. The Prime Minister gave us K19.9 million while he was here in February. We are now working on getting K35.2 million more, and I think we will get at least a part of it this year. I have just concluded discussions with MRDC to finally get the New Ireland Trust Fund money K 25 million released for use in the province. We will be able to start using that this year.

Question 1: If I am so useless and all those other planners are so superior to me why did none of them even know what government owed us for the past thirteen years? And if they knew, why did they get nothing let me repeat that nothing out of government for the past thirteen years?

Question 2: How is your maths? If you hire a man for K450,000 per year and in the first year he manages to get K19.9 million from the Prime Minister and K25 million from the New Ireland Trust Fund, and very possibly another K15m to K35 m from SSG and IDG, is that a waste of money? Shoot, a lot of people work for a percentage of what they are able to recover. At 10% finders fee I would have made around 5 million kina this year alone maybe a lot more.

And what are we doing with that money? Well, for the last fifteen years no one in New Ireland has bothered to do things like basic maintenance of infrastructure. That is why the aidposts are falling apart, the schools are run down, the roads have all gone bush. In the 2009 budget we have over five times as much money devoted to repairing aidposts and schools and roads than was in any budget for the past ten years. And we are doing it through commuity based contractin we are employing peole from the villages wherever we can so they get the salaries and income. Some things you need outside contractors for, like the Bulominski Highway (which is even now, today, being repaired hey, the stretch from Dalom to Karu is now completely repaired, and we are working on the Namatanai Palabong and Namantanai Kokola sections, which will be done this year), but a lot of the local roads can be done by local villagers, and they get the money instead of outsiders. And we are also repairing all aidposts over the next three years, all elementary and primary schools and a lot of other things. That is what the oney should be used for, not giving aways pots and pans and primus stoves..

You know, I came here because I like PNG. All this talk about outsiders coming in is just a bit tiresome. We were here for over ten years in the eighties and nineties. Both of our boys were born in Moresby General PNG em i as ples blo pikinini blo mi - and both of them love the country and do nothing but tell all their American friends how great this place is. And they tell their friends that this is a place where it doesnt matter what you look like, all that matters is what is in your heart. And for a long time America was not like that. America was inferior to PNG. But now, finally, in America we are getting better. The election of Obama was the best thing that ever happened to us, and we are becoming a bit more like PNG a place where what you look like does not matter; all that matters is who you are and whether you are honest and hard working.

We came back here because we give a damn about this place. Em tasol. We did not have to come back here, we took a pay cut to come here for Gods sake, we had to pack up our entire lives and leave our friends, but I really wanted to try to make a difference and I thought this was a good chance to try to put into action some of the ideas I developed over the years working in and for PNG.

So lighten up a bit. We are just beginning to work in New Ireland. I mean, all this really negative and foul talk is not good for anyone. It is a waste of your time, and it is just not nice. I know Sir Julius is a politician, and I do not trust any politician. But he is actually better than most. Look at the evidence. He has given free and subsidized education to the province. This is the only province in the entire country where that is being done. Think about it. That is revolutionary. And think about what it means to the people, the hardworking grassroots people in the province. If a family has two or three children going to school then they are saving a thousand or two thousand kina per year. Come on! That is huge. People who are lucky to earn three or four thousand kina a year are literally getting a bonus of a thousand or two per year. Andif you guys are going to school outside of New Ireland then you get a subsidy of K1,200 per year. That means your parents save K1,200 per year. I didnt see the last government do that. I dont see any other government in PNG doing that.

And the Old Age and Disabled. It may be a liklik toea, but, hey, if you are old and poor and you get K360 per year, that can make a difference. And, again, is any other province doing that? And how about high schools. Sir Julius promised new High Schools and Konematilik is up and running, ground has been broken for a high school in the west, at Tanga and others are on the way.

You have to ask yourself why social and economic conditions in New Ireland have not got better for the last fifteen years. You know that is the truth. Life is not better for the people of the province. That is just the truth. And when I got here you know what I found? There were no files in the Planning Division. No files. Oh, there were filing cabinets, but the papers in them were just stacked up, not even filed, and they were infested with white ants. We didnt know how many aidposts in the province were working, we did not know how many aidposts had medicines, how many had a health worker actually there, we didnt know how many kilometres of road we had, what the condition of the roads was, we didnt know how many schools were actually operating. So how can you plan without information?

The first thing I did was to hire a database specialist. And now, less than a year later, we have a full database. We know all the information about all the facilities and infrastructure and now we can plan, now we can put the money where it should go. And we are talking to people, too. Before I came there had not been agricultural extension patrols for over five years. This year we have already had two and will have two more to all parts of the province. The same with health patrols and education patrols. And I have traveled to every subdistrict in the province and just sat down and talked to people so we can get an idea of what their priorities are and those priorities are the basis of planning, not the priorities of civil servants in Kavieng or Waigani.

You know, I am in the office at seven every morning and usually dont leave until seven at night. And I am in on weekends too. The reason is because I like what I am doing and I think New Ireland has a chance to show the rest of the country what a province can do if people work hard and are serious about making things better. This is a great opportunity for me, but it is also the most challenging thing I have ever done. So I have to work hard. But all it really takes is work, and there are people here who are willing to do the work. People like Dennis Gati.

All this talk about Dennis being the mole who is going to bring down the Chan Government is just stupid. Dennis is one of the hardest working people I have met in New Ireland. He is excellent value. He is also my best friend in New Ireland. Dennis worked hard under Ling Stuckey and he is working hard under Chan. Because Dennis is not working for Ling Stuckey or for Chan or for any little group that just wants to make other people fail Dennis is working for New Ireland. And so am I. And so is Monica. And it is a pleasure to work with someone like Dennis. And if you want to get a real opinion about me or Monica, just ask Dennis. When I am not around. I like working with people who like to work, and Dennis is such a person And there are a lot of others. A lot of people who are trying very hard to turn things around, to do things that will finally make a difference to the grassroots people of New Ireland. But there are also some people who dont like that. Some people who feel threatened by people trying to do the right thing, because they have been doing the wrong thing and getting away with it for so long That is why the people of New Ireland have suffered, because selfish, lazy people have been taking advantage of them. And if you become a part of that group, then you are doing the same thing and shame on you Come on - you have a choice. You can either be a part of the solution or a part of the problem. You have to make the choice.

And one more thing. Have some decency. Lighten up a little bit about my wife. I mean, come on. I love her and we have been married for almost twenty-five years. She is a good lady and she works hard as well. And she doesnt sleep around. I dont care what anyone in the engine room says. We have two great kids and we are very happy together. I dont know or care what politicians do with their private lives. But I know what we do, and we are in love and have always been in love. She is the best thing that ever happened to me, and I think she thinks that I am not too bad, either. Hey, believe it or dont. But think about it there are no piccies because there is nothing to take piccies of. So if you want to continue to talk that trash, then go for it. But if you do, then dont fool yourself. You are the sick one, and that is fine because we can avoid you just by not reading your trash, but you actually have to live inside your head, and my brother that is a head that is truly sick and I would hate to be there. Your punishment is having to live with yourself.

I went on the web and traced the links and found that the company that provides the server for PNGScape is called Tucows, Ltd., and is based in Toronto, Canada. The President and CEO is a man named Elliot Noss, and I went on their web and they have a disclaimer that says that if profanity or slander or illegal transfer of information occurs on any of the sites that operate through their server they will shut that site down. And several people told me I should write to him and let him know what has been going on at PNGScape, and they will just shut it down.
But I said, no I think PNGScape is too good resource to waster. I would prefer to try to change PNGScape so it is really a useful site, a site where people really talk, with real words instead of all the nonstop profanity and small brained talk. And that is what I am doing.

There must be a lot of people out there who use PNGScape but who have just got real tired of all the really offensive macho crap that appears there. There must be people who want to take PNGScape back, who want to use it to actually here is a radical idea exchange INFORMATION. There must be people who want to share ideas, talk about world events, discuss how we can change things in PNG, or just share their ideas about the last book they read. It would be real nice to have a site like that. But to do so, first we have to kind of clean out the system, flush the sewerage down the pipes.

I think that everyone who really wants to have a discussion should just come online and say what they want to say. But say who you are. Be honest, and lets have an honest discussion. And there will always be the short-brained idiots who come on and talk trash and swear and belittle people. But there is a simple solution. Let them do it. Because they are all actually the same person, havent you noticed? Yeah there is only one really stupid, ignorant person on the PNGScape site his name is Anonymous. (or sometimes From the Inside or Kavieng Civil Servant or).

So my suggestion is that we start to have a real conversation. But we only pay attention to people who are willing to say who they are. Very simple. The postings by all the others all the Anonymouses is just noise, like static, and we ignore it because it gets in the way of having a real conversation. Let those five or six people sit around in a circle and play with each other, who cares? We can talk about things that are interesting and that let us learn from each other.

Hey, I know things are not working right. But, damn, it takes a while to get these things sorted out it has been fifteen years of no progress, and I think we can change that. But we need to work at it. And I know I will make mistakes hell, I worked for the World Bank for twelve years and I did not agree with a lot of things that they did, but I tried to do the best I could to straighten things out. Whether you believe it or not, I really do give a damn about New Ireland and I really do believe we have a chance to do some good things. And I do not care about politics. The past is the past. Lets work on the future.
