Your take on guarantees, 90 days better than 30 days and a Lifetime Guarantee better than a 90 day guarantee is a predominantly agreed upon stance by most experienced marketers. Even the not-so-new marketers are familiar with it.

But I fail to see how YOUR POLICY would supercede a policy which has been set by ClickBank. ClickBank is providing the third-party merchant processing for a set fee plus a percentage of the overall sale. In order to utilize the services of ClickBank, one also needs to pay a set up fee.

With the ClickBank TOS (Terms Of Service) Agreement notwithstanding.... Your approach is an arrogant approach Marcia. As well as a violation of the TOS Agreement the "Seller" has agreed upon, and willingly entered into, in order to utilize the ClickBank service.

Whether or not you give rainchecks, or what your track record over the last ten years regarding refunds may be, or your policy as it relates to sickness on a one-to-one basis, or even what may or may not be "explicity spelled out on the registration form" you use, has nothing to do with the Agreement one enters into in conducting business with ClickBank.

Your statements of:

"If ClickBank can't issue refunds beyond six months, you can still do it yourself... by sending an old-fashioned check to the person. So whatever policy ClickBank wants to adopt really should have nothing to do with your guarantee policy."

I find this to be an entirely INAPPROPRIATE statement Marcia. Even more so being made by someone with your reputation of integrity and ethics.

I would think you of all people would never advocate bypassing a Terms Of Service Agreement in any way, shape or form.

If ClickBank were to "investigate" a violation of their policy by one of their users, and found it to be true, they could very well terminate the service for intentionally violating the TOS! Is this an acceptable form of behavior Marcia? To disregard TOS and policies set forth by a provider you have chosen to utilize? Certainly you were posting without thinking before you hit the 'Reply' button, weren't you?

What if someone were to purchase one of YOUR products or services then blatantly disregard any copyright notices, agreements, etc. you expressed. Then did whatever they wanted to do in violation of your expressed limitations. I'm certain, from reading your previous posts, you would not take it very kindly and would exert whatever actions you could to either bring them back into compliance. Or possibly take legal actions towards them.

I would advise all who read the above post to disregard taking "Policy" into your own hands unless you are the owner of the company in question.

This forum, and myself personally, do not advocate violating
Terms Of Service Agreements as Marcia stated.


They (TOS) are there for a reason and if you cannot live with them, you need to seek other options. With your "stringent refund policy" Marcia, I am astounded you would disperse this type of advice(?). To do an end run around ClickBank's policies?

I believe you are still using DigiBuy, a quality company, and have decided to NOT use ClickBank. Even after we spoke on the telephone. That is your choice. But please do not advocate violating TOS Agreements to the readers of this forum. Would you intentionally disregard and violate the TOS you agreed to with DigiBuy??? I would hope not. So why advocate it here and against ClickBank?

I'm certain your intentions were not as you stated in your post and you are more than welcome to come back and retract them. If not, please refrain from dispersing unethical advice at my forum.

ClickBank may or may not take an aggressive stance on their new guarantee policies. But I would highly recommend to all reading this thread, and using ClickBank's services, to adhere to the TOS you have agreed upon.
