They're a way to interact with surfers. They're certainly not "spam" by even the loosest definition of that word.
I use every sales tool at my disposal, including popups. Additionally, I won't let surfers onto my sites who use ad-munchers or content-suckers. If a surfer wants to visit my site they're going to play by my rules, just as if I ever open a store in the real world customers are going to behave decently if they want to look at my wares: "no shirt, no shoes, no service"--and no shoplifting. If they don't like my rules, they're free to go elsewhere.
My site costs are insanely high if you include my time; I have to make minding my bottom line one of my higest priorities.
