I, Jonathan Jay Baure hereby make a statement in response to the article on page 5 of the National Newspaper (PNG) dated 10th March 2011 entitled PNG Flotilla heading for Australia.

Australia realizing that myself and my Papuan members are quite serious and determined to cross the Torres Straits to mainland Australia to bring the plight of the Papuan people born before PNGs Independence 16th September 1975 as Australian citizens by birth have now resorted to intimidation, threats, slurry and mis-information to discredit me, the Papuan people and the Papuan issue.

On Wednesday 9th March 2011, Philla Davidson of the Australian High Commission in Port Moresby and her contingent of 15 other officials from the Australian Federal Police, PNG Immigration, PNG Police and Corp Security personals in six vehicles converged on Jack Pidik Park uninvited to address my group. Though I was never informed or given advance notice, I show courtesy and invited Philla Davidson to speak to my group. She spoke to them, telling me that I was wrong and mis-leading them and not to go on this second flotilla. Whilst she was speaking, my group listened attentively without disturbing. After her speech, she asked my group if the was anybody had any questions or comments and handed hundreds of pamphlets to the group. The pamphlet is in English and Motu. There are many errors in the Motu translation of that pamphlet as it was printed in haste to be presented to us.

Few of the members stood up and basically commented, firstly thanking her for coming and speaking to us but we know the truth about our Papuan history, the law and our rights so Australia cannot intimidate and deter us. And a few stood up and told Philla that they were going on the second flotilla and if she wants she can arrest them, she can arrest them now. She declined! She was also asked why are Afghanistans, Pakistanis, Africans, Indonesians, Chinese who dont have any legal right and our history are accommodated at detention centre and their claims possessed and allowed to live in Australia and we Papuans who fought and defended Australia and are Australian citizens were never given the courtesy to the same treatment when our team was on Horn Island in the Torres Straits. She never answered that question. Then I asked my members, if you believe what Philla and the official Australian stance on the issue then you are free to leave. Nobody move! I invited my members to clap and shook hands of all the visitors and they left. Many of our members felt intimidated, angry, frustrated and disappointed with Australias actions and are now more determined to cross. Our group also agreed that the next time Philla and her official come uninvited to our meetings; we will all walk away and not entertain her and her officials.

On the National newspaper report on page 5 of the National Newspaper (PNG) dated 10th March 2011 entitled PNG Flotilla heading for Australia Ian Kemish, the Australian High Commissioner stated that I am duping people and gaining financial from this issue. Firstly the PNG Police confiscate my wallet and my bank accounts when I was arrested. They can check if I have any money. I dont have any savings, any investments, any car or a house so how am I benefitting from this issue. All money donate, given or paid into the issue is used for the issue. Nor myself or any of the leaders benefit. We all work voluntary.

Secondly, it was stated that our case was lost in the High Court of Australia. The first case is Susan Walsh. Susan Walsh went to court in Australia on the ground that she had Australian citizen by descent because her father was a white Australian. She lost the first case but then was given the citizen by descent on the second case. This judgement is in err because even though her father is an white Australian, she was born a Australian citizen by virtue of her birth in the Australian Territory of Papua. Descent is only applicable if you are born outside Australia and you cannot claim descent when you were birth citizen. The case was never lost

The second case Amos Bode Ame, is a case I know personally as I am the person who gave Amos Bode Ame, the Papua Act, the Australian Citizenship Act and the Migration Act back in the year 2004. Amos used these laws to go to court in Sydney. The High Court agreed that Papuans were born Australian citizens but basically made the judgement that there was not enough evidence to justify Amos claim to continuous Australian citizenship and upheld the Australian Government claim that we have no claims to continuous Australian citizenship. The case was not lost. We now have evidence that we have claims to our continuous Australian citizenship and that why we wanted the Australian authorities to arrest, detain and take to court the team that went to Cape York. I challenge Australia to charge me and take me to the court and let me have my day in court.

Australia is frightened of us exposing the racial discriminatory WHITE AUSTRALIA POLICY. Current the policy states Even though you were born in Papua before Independence and attained Australian Citizenship by Birth; if a person had two grandparents born in Papua or New Guinea or adjacent area (Torres Straits, West Papua and Solomon Islands) then you dont have a Right of Permanent Resident in mainland Australia therefore you are no longer an Australian citizen. Firstly; everybody knows that only persons who had two grandparents born in Papua or New Guinea is Black Melanesian person. Everybody also knows that a White person born in Papua before Independence would not have two grandparents born in Papua or New Guinea or adjacent area.

Prior to the Two Grandparents policy, Australia had another policy which states; Persons born in Papua of non-indigenous descent had automatic Right of Residence in mainland Australia. Those of indigenous descent had to apply to be granted Right of permanent residence in mainland Australia. The Minister had the discretion to grant Right of permanent resident to such persons if they (1) were brought up in a European manner (2) had English as their principal language; and (3) were European in outlook. Down right Racist.

Right of Permanent residence is an automatic component of a citizenship right. There cannot be a citizenship without Right of Residence. White PNG citizens and Black PNG have equal Right of permanent residence anywhere in PNG. It is the White Australia Policy that forces PNG citizens to wait weeks to months for visa approval and have to provide medical report, police report, bank statements, etc. It is the White Australia Policy that Australia continues to deny us our right to our birth citizenship. It is the White Australia policy that continues Fuzzy Wuzzy Angels and Colonial soldiers right to pension according white war veterans.

Shame on Australia and history will judge you for denying us our citizenship right.

Please Papuans pass this statement onto our other Papuans.

Dear Mr. Baure,

You may have every right to express your views in the site. Your actions and your views are yours alone.

However, PNGSCAPE will NOT be held responsible or support you in any way in your endevour to pursue Australian Citizen Ship.

The Australian Government through the Department of Immigration and Citizenship has issued an important notice that it does NOT recognise nor support your claims to be an Australian Citizen.

The Australian Govement Response to your claim is as follows:

1. You and your group/followers are not recognised Australian Citizen.

2. Documents issued by any of the advocay groups as proof are of Australian Citizen have no legal standing.

3. The matter was settled for good in 2005 by the Australian High Court.

From the PNGSCAPE management, PNGSCAPE will NOT be held responsible for any actions taken by the authorities seem fit to address the matter.

I sympathise with Jonathan and I also appreciate your response.

Good response because if the discussions continue it becomes trial by media and that may not be appropriate for PNGScape with the racial slur that goes with it, which is quiet understandable.

This is a tough topic to manage but it has found its place here and this may not be the right place. But PNGScape already entertains a West Papua Board, so what?.

So why dont the moderators open a Board for Jonathan with an appropriate name but have it managed as normally by your current rules.

PNG Australia Relations will always be tested day and night, whether PNGScape likes it or not, but to say that PNGScape will become a bad guy out of it is totally amiss.

I understand your comments but I do not agree with it entirely.

Personally I was educated in Australia and have an Ozzie influence in my life but I am neither racist, neither pro Jonathan, I just want to hear from the marginalised people and Jonathan thinks he is marginalised...let us talk and hear and exchange views but also respect people like Jonathan who think they are marginalised. If you choose to lock Jonathan out, that is in your courts as you plus the team of PNGScape moderators have the exclusive right to filter the exchange and do that is acceptable. Your rules and how you play it out wins...and not Jonathan and what He wants.

There are Border crossers and immigrants that Australia has had enough about, but this one needs to be handled as well with care.

I believe in freedom of expression and views. But PNGSCAPE will continue to exercise it discretion to protect the site and the people who manage the site where it sees fit to EDIT or DELETE the thread should on any circumstance as mention arises.

PNGScape is a community Forum website,therefore it is open to all PNGeans with their issues for discussion. I will consult with the webmaster on this topic.
I do not personally see JB as a terrorist in his struggle, and he has the right to persure his beliefs as the right to Australian Citizenship.

Please, moderators, do not delete any messages without me seeing them.

In fact, suppressing Jonathan is little different than the PNG government's suppression of the Free Papua movement, even when people wanted to speak out in POM in favour of Papuan freedom.

Let people speak their views. Free speech was never designed to protect the popular viewpoint, but instead, the unpopular ones.

We already have a country peaceful and fair, why do you wanna go to Australia and be treated like uncivilised people only there to milk their social services. Mirgant Australian have made what Australia is now, they have shown us the rope, lets make our own country for ourselves and our children and their children. Forget about it Jonathan, be sensible and let all those hard working Motuans enjoy the peaceful country that we have.

Advice for you Jonathan, THINK NOT WHAT THE COUNTRY CAN DO FOR YOU BUT WHAT YOU CAN DO FOR YOUR BEAUTIFUL COUNTRY PNG FOR YOUR CHILDREN AND THEIR CHILDRENS CHILDREN.

He is thinking. He thinks that he can not do what he wants, nor can his children or his grand children or his grand childrens children. With maybe 15million people by them they will have no space to do what they want. Thus they have no contribution to make. Let them go and float on a boat to Aust, 1 more time, then the next and then the time after that and so forth. His contribution to PNG, publicity.

my personal opinion is that this papua movement is a waste of time!!!
why??

because first, Mr Jonathan Baure, you are curently using a community site which belongs to the people of papua new guinea!! not an australian website such as seven networks etc...

-you are using PNG KINA to sustain ur living, Not Dollar
- Your Kids attend PNG schools, not australian schools
- u are living in PNG, not australia
- even though PNG may not be a perfect country, it has provided for you and all the papuans who rally behind you...
-for 30 years, PNG has laboured for you all the papuans and looked after them..
- has australia spent a cent on yous??

This papuan movement is like a child crying to go back to its mother when the mother has clearly dumped her in the sewers!! Papuans, PNG is your mother now!! just like a mother who loves her kids, PNG still cares and provides for everyone even if the blessings are small...

all of us grew out of papua new guinea and are who we are now!! Why cry to join australia?? Nogud yupla end up olsem ol aboriginals na kamap kagoboy blo australians?? You are in PNG and you have the muscle to talk and act big because we are part of you..yumi wanpla lain tasol but i guarantee you, if yu are in australia, your issue will never see the dayligt in the media!!

And mind you, as a law student, i know that there are many discrimination laws still in place in Australia and how are you, Mr Baure, going to ensure the equal rights and fair treatment of the people you lead to be australians?? you might gain acceptance but the rights issue will be another battle but by that time you will be part of AUS and they will crush yous like they did to the Abo's.

How do you think the many other people of PNG will feel when they hear papuans wanna seperate from PNG? their contrbutions to the economy of PNG was used to fund developments in papua. How do you think, the buka (panguna), enga (porgera), Lihir, misima and all the other provinces that contributed to your so called papuans feel?? How are you mr Baure going to answer them??
will you tell australia to pay those people and the state of PNG for the 36 long years it has looked after yous??

ACCEPT THE REALITY THAT YOU ARE PART OF PNG!! This is the little section of the world that god has blessed you with...

A shamefull story

Firstly, I am an Australian and, as a child, I grew up in PNG in the late 60s and early 70s.

I remember those times very well and with great fondness for the peoples of PNG and its incredible land.

On that basis I feel humiliated by what is said about the events surrounding the debate about Australias alleged failure to recognize the status of some PNG citizens to citizenship under Australias own Law.

I do not say the Courts of Australia are necessarily wrong in Law, I do not know.

But I can say that it is very misleading and wrong to say that Australians embrace a White Australia Policy, indeed the truth is very far from any such assertion.

Australia is a true melting pot of all Nations and anyone who walks the streets here would realize this immediately.

It is also true that PNG was never ready for independence as a Nation.

It would have been far better if the peoples of PNG had remained citizens of Australia.

What was gained in independence was a flag and a National Anthem and little more.

And you cant eat a flag.

But its too late now to go back to the way things were under Australian governance.

PNG struggles to develop governance systems and its National government fails to provide for the essential needs of its divers peoples.

The situation is indeed truly heartbreaking, especially for people like me who have always seen the peoples of PNG and Australia as one socio-economic pacific block.

And now, Australians have, after two more generations, nearly forgotten the remarkable and close ties the peoples of PNG had with those across the Torres Straights.

The cry for recognition of status as Australians needs to be carefully looked at as a matter of fairness and policy.

But herein lays the terrible consequence for the peoples of PNG.

If the High Court did rule that the peoples of PNG born before 1975 enjoyed the birthright of Australian citizenship the flood-gates would open and just about every citizen of PNG would, directly or indirectly, be entitled to Australian citizenship.

I too would like the right to be a citizen of PNG but I am denied this by my Australian citizenship by birth.

The corollary of the argument is that all Australians should also be entitled to PNG citizenship.

I doubt if the peoples of PNG would agree with this proposition.

How could this ever work for the Independent State of PNG?

How could this ever be administered by the Government of Australia?

Hindsight is often a painful burden.

However, the decision to sever PNG as a Nation was made by the peoples of PNG back in the 70s and whilst the consequence could never be fair for all of its citizens it is the reality of what must now be faced by those whose aspirations and hopes have been disenfranchised by the event of Nationhood and independance.

Get an education. Get a work visa and move your family there legally. That is the only solution I see. Unless you want to continue spending money on a lost cause. Sorry.
