It doesn't matter whether something is written using Flash, javaScript, or C++ -- it's up to the author to decide whether the files can be freely distributed.
Flash is NOT the end-result -- it's what you use to create something. I used it to create the Sonic Memo controls the same way a C# programmer would use Visual Studio to create a program.
By saying there's nothing illegal about distributing Flash controls you're implying there's nothing illegal about distributing EXE files, or PDF files. And unless those are yours to distribute, there is something wrong wth that.
I gave step-by-step instructions on Michael Green's forum to show that the files in question are byte-for-byte identical. Not just close, but identical. That does NOT happen by accident.
I also asked Flash programmers in the Macromedia forums to take a look at them and they said the same thing. (Head over to the Flash forums and read aout it if you like.)
You can deny it if you choose, but there's no debate -- the controls should not have been distributed with the ebook and I already thanked Satya for removing them.
