Has its merits ... but why the struggle with the perceived "fall out" from the Can Spam Act of 2003?

You write:

"From what I understand, filters are 'tuned up' so high that they are even blocking mail that doesn't come from the same domain as the return address."

It is my understanding content filters are blocking emails with links containing domains which don't match the from email address in the header or 'display line,' although I stand to be corrected on this point.

Why? Network administrators are dealing with a literal tsunami of spam and wanting to cope.

Is this spam tidal wave the result of the passage of an opt-out regime in the United States?

Or is it more a reflection of the nature of email, as spammers can simply increase volume levels, flooding network servers in an effort to get through gateway filters?

Since spammers try and hide their identity, while refusing to comply with the Act, can we understand why network administrators are taking steps to filter messages which bear similarities to the typical spam message?

The question is how do we as email marketers cope, survive and flourish in this environment?

Do we continue to beat our head against a brick wall, complaining about being penalized, or do we change tactics, while opening new channels of communication?

What tactics? Sender authentication. Working with accreditation services. What channels? Learning to use blogs to build a community and adding an RSS feed to allow for wider distribution of our message.
