My #2 son, Jake, has put together several commercials for the Doritos "Crash the Superbowl" commercial contest. The top prize is $1 Mill, with several $25K prizes.

For one of his entries ThE GaNG got in on the action. Most of the ads feature Jake's locally famous "nerd" character, "Edward Gibbs". News from the State Capitols
Four state legislatures (Massachusetts, Michigan, Ohio, and Pennsylvania), and the District of Columbia are currently in session. Forty-six states have adjourned their regular sessions or are in recess. For the latest information on the over 850 state and federal bills being tracked by the Government Relations Department, visit our 2009 Legislation Tracking page. Here are some of the highlights.


Local Battles
Although most state legislatures have adjourned, many municipalities are still considering ordinances that could affect your rights as dog owners. If you hear of an issue in your town or county, contact us at (919) 816-3720 or doglaw@akc.org. We will be happy to provide you with the resources, tools, and support you need to help fight for responsible dog ownership in your community. Here are some examples of the approximately 100 local issues we are monitoring.

Louisville Court Ruling May Have Broader Implications
On October 2, a United States District Court judge issued his decision in the case of the Louisville Kennel Club, Inc. v. Louisville/Jefferson County Metro Government. A significant victory for the Louisville Kennel Club, the judge's decision features two key rulings that may also prove to be of great importance for dog owners nationwide.

Among many new provisions, the animal control ordinance passed in Louisville required only owners of unaltered dogs to obtain written approval for dog enclosures. The ordinance also required anyone accused of animal cruelty to post bond for the care of their seized animals, or risk forfeiture- even if the owners were later found not guilty.

The judge declared that there is no rational basis for treating owners of unaltered dogs differently than owners of sterilized dogs. As a result, the portion of the law regarding enclosures was ruled to be an unconstitutional violation of equal protection and substantive due process. The bond requirements for animal cruelty accusations were also ruled to be an unconstitutional violation of due process.

"We congratulate the Louisville Kennel Club and their co-plaintiffs on their leadership in opposing the Louisville ordinance," said Dennis Sprung, President and CEO of the American Kennel Club. "We are confident that this decision will encourage communities to consider the interests of responsible dog breeders and owners when making changes to their animal ordinances."



Make Your Contact Count
Many legislatures will reconvene in January, and some are already beginning pre-filing bills for the 2010 sessions. A few states are still in session and considering bills that impact responsible dog owners. Additionally, numerous local municipalities are considering legislation that may affect you as a dog owner or breeder. As you consider contacting your public officials, here are a few simple steps to help ensure your communications are effective.

AKC Presents Community Achievement Awards
Each quarter, the AKC honors up to three AKC-affiliated clubs, federations, or club members for outstanding contributions to canine public education and government relations efforts. The three Community Achievement Award recipients for this quarter exemplify the impact dog fanciers and owners can have on their community and their legislatures. Read more.




This has been a challenging year for dog fanciers and breeders. More than ever before, it seems our rights to own and breed dogs are under attack. Yet in spite of these challenges, we have much to be thankful for, as this year we have also had a significant number of legislative victories.

I encourage you to take a few minutes to review our ever-growing list of legislative successes posted on our web site. On the state and local level, thousands of fanciers and breeders have worked tirelessly to protect our rights with great success. The AKC has worked in collaboration with them to defeat local and state-level mandatory spay/neuter proposals, numerous breed-specific bills, ownership limits, and also to defeat or significantly amend over 90 percent of the "breeder bills" introduced so far this year.

As we pause a moment to count our blessings, it's also important to remember that our work continues. As you will see throughout this issue, numerous states and municipalities still need your help. Whether or not your state or community is currently considering canine legislation, please continue to contact your legislators, invite them to dog shows, and let them know the good works you are doing in your community. All of these are simple ways you can educate public officials about who we are and the work we do on behalf of dogs and their owners. This issue also includes some helpful tips on how to communicate with legislators, so you can be sure you are being an effective advocate.

This edition highlights three examples of how we as dog owners, fanciers, and breeders can make a difference in our community. We thank these three Community Achievement Award recipients, our state federations, clubs, and the thousands of people who have worked so hard this year to protect our rights as dog owners. We also extend a special word of thanks to the legislators and public officials who have voted in favor of protecting responsible dog ownership.

New Orleans Drops Mandatory S/N!!

Late yesterday evening, the mandatory spay/neuter proposal that was to be considered today by the New Orleans City Council was withdrawn by the ordinances sponsor, Councilwoman Cynthia Hedge-Morrell.

The American Kennel Club (AKC) appreciates the Councilwomans and her staffs effort to reach out to responsible dog breeders and owners who voiced strong opposition to the proposal. We also congratulate the dedicated fanciers and enthusiasts who spent countless hours educating the Council and staff about the unreasonableness and unenforceability of mandatory spay/neuter laws.

The AKC continues to urge the City Council to study in-depth any existing animal population and enforcement funding issues that exist in New Orleans, and to work with all interested stakeholder groups in formulating reasonable and enforceable laws that protect public health and safety without harming those breeders and owners who take their responsibilities seriously.

As the calendar gets ready to change to the month of November, it tells us that the 2009 BCA National Show is less than a month away. As of today there are only 26 days until "We're Goin' To Kansas City, Bully City Here We Come!"











Basket Contest,There will be five groups with a prize awarded to the winner of each:

GROUP I - Individual: Representing your home state.

GROUP II - Individual I: A theme of your choice.

GROUP III - Club: Promote your club along with your state.

GROUP IV - Division: A regional basket representing your division.

GROUP V - Peoples Choice: Winner overall from all baskets.

RULES
Entries are to be brought with you to the show. Include a written description of the contents and an
overall value. The baskets will be raffled off and the basket in each category receiving the most tickets
will win that prize. For any additional information contact Eva Dickey.

LIVE WEBCAST:



The 2009 BCA National Show will have live webcast available on a per day or by-the-week rate. There will be two cameras covering two rings with two simultaneous webcasts. You will only be able to view one ring at a time. After you have purchased your day or week option, you will be given a username and password for each day you have purchased. After you have completed your login, you will be given a choice of which ring you would like to view. You will have the ability to change rings at any time during the webcast. The pre-sale cost until November 16th is $25.00 for the 6 day week , $35.00 weekly rate after November 16th, and $10.00 daily rate.

Tuesday November 24th--The first "FOOL'S BALL" will be a party hosted by "The Benevolent Order of the Fool", a group of Bulldoggers that have generously donated money so that this nights festivities can be enjoyed by all. The nights musical entertainment will be Disco Dick and the Mirror Balls, a long time Kansas City favorite. You can find out more about the band at www.discodick.com. The theme for the night will be reliving the 70's Disco era. Everyone is encouraged to dress in their best 70's disco clothes. The sponsors will be providing a limited number of special edition T-shirts, party hats, party favors and refreshments. This will truly be one that will be talked about for years to come and best of all, everything has been donated at no cost to the show or BCA.



Wednesday November 25th --The annual Purina Costume contest with cash prizes and a DJ hosted party afterwords. Look for more information on the website and at the show for specific times.



BULLDOGS ON PARADE CONTEST--We are also sponsoring the FIRST "Bulldogs on Parade Contest". What a great way to win some extra spending money for your week in Kansas City . You can find details for both of these contests on the website at www.2009bcanationalshow.com.


PLEASE NOTE: On Friday November 27, 2009 we will be having a health clinic/checks for Patellar Luxarion and Congential Cardiac. Forms must be filled out ahead of time and $20.00 payment for each procedure will be taken at the health clinic.

HANDLING SEMINAR---Doris Boyd will host a handling seminar on Monday morning before sweeps. The seminar will be in the ballroom with both verbal and hands-on instruction. Our Instructor Doris Boyd, is renown for her ability to help both beginners and the experienced handler in reaching higher levels of proficiency. We are very lucky that she has agreed to come to Kansas City and give of her time to us.



The closing date for entries for the show is NOVEMBER 4, 2009



We also would like to remind everyone bringing dogs to the show that the following rules will be strictly enforced. There are to be no more than FOUR DOGS PER ROOM. There are to be NO DOGS UNDER SIX MONTHS OF AGE AT THE WESTIN HOTEL.

Purina Dog Food - Deadline date change

At this years Nationals Purina is offering 6lb bags of food for the exhibitors showing dogs. We have put a limit on the food; TWO (2) bags per adult dog. This food is FREE. Please Read More Reasons You Do Not Want Mand. S/N Ordinances in Your Community

Bad news from Houston below!
RPOA vehemently opposes this new trend in Texas to force veterinarians to become pet police. Ask your vet if your records are confidential! Dallas and San Antonio city officials have been pursuing this avenue also.
With "animal rights" legislation being passed every day regarding pet limits, intact animal permits and breed specific legislation, pet owners are very concerned, worried and paranoid for good reason. It is mindboggling to see this approach with animals being relinquished to shelters in droves due to the economy and loss of jobs. Houston vote is today.

City Of Houston: Wasting more of your money on programs that will NOT lower the kill rate The following item is on City Council's Agenda for Wed 10/21/09:

"ORDINANCE amending Ordinance No. 2004-0808 to INCREASE the maximum contract amount; approving and authorizing second amendment to contract between the City of Houston and PETDATA, INC for Animal Licensing Services for Houston Department of Health & Human Services - $380,000.00 - General Fund"

I'm sure that this is a followup to the letter that Houston veterinarians have recently received informing them that the city is going to "deputize" them to enforce pet licensing laws. (See our website to read the letter) However, enforcement of pet licensing laws has proven to be a waste of money in other cities and can cause kill rates to rise. The reason is that responsible people are going to be responsible WITHOUT laws. Irresponsible people will remain irresponsible and still will not license their pets no matter how many laws are passed. And when irresponsible people are faced with fines for not having licenses or being over the pet limit,they will DUMP the pet.

This particular law will also drive the very people that BARC & COH needs most, i.e. foster parents and adopters, "underground" because of Houston's pet limit laws. People who are over the pet limit will be forced to avoid vet care, including spay/neuter, for fear of being found out that they are over the limit. This will just add to pet population problem.

Concerned pet owners are already talking about using vets outside of the city limits and even moving outside the city limits for fear of being found out. So instead of encouraging more people to adopt pets so Houston can stop killing 80,000 pets every year, BARC/COH are instead antagonizing and punishing the very people they need most.... people who adopt animals and adopt more than one.

Also, our vet bills are going to go up because vets will, most likely,be forced to hire additional staff to process the extra paperwork they are now required to handle. This again punishes the very people that BARC needs most..... people who adopt and care for animals.

The $380,000 that they plan to spend on licensing would spay/neuter 7,600 female cats and 9,500 male cats at SNAP! Just think of how far this money would go towards lowering the kill rate in Houston! Just think of how much money this would save the city in the long run when those 9,500 cats aren't breeding and BARC isn't forced to deal with the offspring in a few months. This is more WASTEFUL spending by our city leaders on programs that will NOT lower the kill rate.

The city has an almost 200 page assessment report in their hands, prepared by no kill expert, Nathan Winograd that tells them EXACTLY how to stop the killing. Pet licensing is not mentioned once in this report. The city needs to follow Nathan Winograd's recommendations. This is the ONLY way that Houston will stop the killing.

The ordinance approving the spending of $380,000 more tax dollars will most likely be voted on Wednesday (10/21/09) . Please use this opportunity to contact the Mayor, City Council, Elena Marks and Alfred Moran and let them know how you feel about this wasteful spending that will cause more animals to die in Houston. There are better methods available that will save lives and make money for BARC/COH.

Nearly a quarter century ago Houston City Council passed an ordinance requiring veterinarians in the city to provide names and addresses of pet owners whose animals receive rabies vaccinations.

The data was intended to be the backbone of a city licensing system for area pets.

Partially because a majority of vets have refused to cooperate, the city licensing effort has been ineffective. Less than 4 percent of the estimated one million dogs and cats in the city have been registered for the inexpensive tags. As a result, incentives in the license pricing system to encourage neutering of pets have also failed to achieve the goal of reducing the number of unwanted animals on the streets. A license for a neutered dog or cat is an initial $10 fee, plus $2 annually. A license for a fertile animal is $50 a year.

Responsible pet ownership has never been one of Houston's bragging points.
As a result, the Bureau of Animal Regulation and Care has been overwhelmed by the number of abandoned and abused pets, with its primary business being the gassing of thousands of animals a year. Lack of a dedicated funding source has contributed to substandard and inhumane holding facilities.

Now a real reform effort is underway, headed by consultant Gerry Fusco, to put the "care" back into BARC. But it will require support from the pet-loving populace and the medical professionals who serve them.

The city plans to turn up the heat on vets who continue to flout the reporting requirements. Regulators have sent letters to the pet docs warning them that failure to comply with the ordinance can result in $500-a-day fines.

Some vets claim that the law violates confidentiality between a DVM and the pet owner/patient. That ignores the fact that MDs are required to furnish data on child vaccinations to the state, and the Texas attorney general has already ruled that municipal ordinances supersede vets' patient confidentiality.

Just as mechanics are empowered by the state to inspect vehicles and collect fees, so area vets should combine the process of vaccinations with collecting license fees at the same time. That's how the City of El Paso has handled pet licensing since the '60s, with the vets receiving 10 percent of the revenue collected. Neither vets nor pet owners have complained.

You'd think dedicated veterinarians would be the first to call for and contribute to an effective licensing system for pets. Not only would it provide valuable data on the extent of animal vaccinations, but it would also yield added revenue to improve animal control and care.

In order to alleviate suspicions that the money wouldn't go for that purpose, city officials could create a dedicated fund so that license revenues could only be used for BARC.

Now that the city is finally taking steps to create an animal-caring agency rather than a killing machine, vets and pet owners need to do their part to neuter, vaccinate and license as many animals here as possible. Until all parties work as a team, this community will never be able to achieve the no-kill status that should be the goal of our animal control efforts.

The 2009 BCA National Show will have live webcast available on a per day or by-the-week rate. There will
be two cameras covering two rings with two simultaneous webcasts. You will only be able to view one ring
at a time. After you have purchased your day or week option, you will be given a username and password for
each day you have purchased. After you have completed your login, you will be given a choice of which ring
you would like to view. You will have the ability to change rings at any time during the webcast. The pre-sale

cost until November 16th is $25.00 for the 6 day week , $35.00 weekly rate after November 16th, and $10.00 daily rate.







ENTERTAINMENT--We have some great entertainment planned for the week. All of the weeks entertainment will be in the Westport Room situated on the Lobby level of the hotel.





Monday November 23rd--Connie and the Choirboys will kick off the weeks entertainment. This local group plays a mix of both Blues and Classic rock.





Tuesday November 24th--The first "FOOL'S BALL" will be a party hosted by "The Benevolent Order of the Fool", a group of Bulldoggers that have generously donated money so that this nights festivities can be enjoyed by all. The nights musical entertainment will be Disco Dick and the Mirror Balls, a long time Kansas City favorite. You can find out more about the band at www.discodick.com. The theme for the night will be reliving the 70's Disco era. Everyone is encouraged to dress in their best 70's disco clothes. The sponsors will be providing a limited number of special edition T-shirts, party hats, party favors and refreshments. This will truly be one that will be talked about for years to come and best of all, everything has been donated at no cost to the show or BCA.





Wednesday November 25th --The annual Purina Costume contest with cash prizes and a DJ hosted party afterwords. Look for more information on the website and at the show for specific times.




BASKET CONTEST--Don't forget to bring your baskets for the basket contest. There are many classes that can be entered and won!

We are very lucky that she has agreed to come to Kansas City and give of her time to us.
