to consideration by the Legislative Assembly. It is an editor¢s brief statement of the essential features of the
measure as introduced.
Prohibits inbreeding of dogs by breeder. Makes first violation subject to maximum fine of $360.
Makes second or subsequent violation subject to maximum fine of $720.
Requires breeder to keep records showing parentage and grandparentage of dogs and puppies.
Makes violation subject to maximum fine of $720.
1 A BILL FOR AN ACT
2 Relating to the inbreeding of dogs.
3 Be It Enacted by the People of the State of Oregon:
4 SECTION 1. (1) As used in this section:
5 (a) Breeder means:
6 (A) A person registered as a breeder of dogs with a kennel club, breed promotion organ7
ization, breeder referral service or other entity organized for the purpose of providing cre8
dentials, advertising or contact information for breeders of dogs; or
9 (B) A person that has, within 12 months prior to breeding a pair of dogs kept by the
10 person, sold or advertised for sale more than two litters produced by dogs kept by the per11
son.
12 (b) Dog means the species Canis familiaris.
13 (c) Kept means owned, possessed, controlled by or in the charge of.
14 (2) A breeder may not breed a dog with another that shares a common parent or
15 grandparent with the dog.
16 (3) A breeder shall keep a record of all puppies produced by dogs kept by the breeder.
17 The records shall include identifying information for the parents and grandparents of the
18 puppies. This subsection does not require a breeder to maintain a record for stillborn
19 puppies. If the breeder possesses or can obtain information identifying the parents or
20 grandparents of dogs that the breeder uses for breeding, the breeder shall maintain a record
21 identifying the parentage and grandparentage of the dogs used for breeding.
22 (4) A person that breeds a dog in violation of subsection (2) of this section:
23 (a) Commits a Class B violation for a first offense; and
24 (b) Commits a Class A violation for a second or subsequent offense.
25 (5) A person that fails to maintain records as required by subsection (3) of this section
26 commits a Class A violation.
27 SECTION 2. Section 1 of this 2009 Act applies to dogs bred on or after the effective date
28 of this 2009 Act and to puppies born 60 or more days after the effective date of this 2009 Act.

Southwest Oregon Bulldog Club Specialty Pics (Corvallis, OR)

We had a lot of fun this past week at the SWOBC specialties. It was great to meet new people and see dogs from another part of the country. We hope to make it back next year. Congratulations to all the winners!

The second day of the specialty had a 50's theme. We saw some Pink Ladies, rolled up jeans, and the "poodle" skirt was revamped into the bulldog skirt of course!

PCBC Puppy Match------Be there!!!

When the Bulldog Club of AZ use to have a puppy match to start off the specialty weekend, it was such a great event with always over 30 pups entered. I showed my past champ Cool Dude in one of these when he was 12 weeks old and it was his first show ever.
I often remember the fun we all had while watching pups do what they do best, entertain.... Bob Vincent was the judge at this one puppy match and Kim Lindemeon spoofed Bob by entering a very trained Wire Har Fox Terrier that looked as though he was going to lift his leg on the judge as he approached to go over him.. That was some funny stuff. I believe Myrna or somebody else in the club had a Frenchy in there as well. All lots of fun..

We should all strive to make this puppy match at the PCBC shows a come-back event and enter our pups.

Let's show off what we have and at the same time celebrate the winners from the specialty weekend.

Action Alert!! Texas HB 3180 Scheduled for Wednesday Hearing CALL & FAX LETTERS

ACTION ALERT!

HB 3180, the Puppy and Kitten Breeder/Dealer/Pet Sales/Lemon Law Bill, is
scheduled for a hearing at 8:00 AM Wednesday, April 1st in Austin. It will
be held in Room E2.016 in the Capitol Extension (2nd floor,) before the
Licensing and Administrative Procedures Committee.

Detailed maps of the Capitol Layout, all floors, visitors parking,
restrooms, etc are on our website: www.rpoatexasoutreach.org under the
Lobby Day Link.

We must have lots of "warm bodies" to back up our speakers and try to kill
this bill in committee. Martin Kralik and James Dark will be representing
and speaking for Responsible Pet Owners Alliance. You can sign a card in
opposition to this bill and don't have to speak. If you cannot attend this
hearing, please call, fax and email (all three!) to ALL committee members -
until noon Wednesday. Contact info and talking points are listed below.
Email rpoa@texas.net if you can attend.

In fighting bad legislation, it is NOT advisable to "make it palatable" and
harder to defeat. You kill bad bills as written. Please repeat the
following sentence in all correspondence to legislators as Californians did
with AB 1634, which was eventually defeated after 8 revisions. "This bill
is fundamentally flawed and cannot be fixed with amendments!"
Also tell them that HSUS and Texas Humane Legislation Network do NOT
represent you.

* You've been told this is a "Puppy Mill" Bill. That is not true. It is a
pet bill and will affect anyone selling one dog or cat. Under "Retail Sales
of Dogs & Cats" the definition of "dealer" includes a person who is
"required to pay sales tax for the sale of animals," which includes every
sale in Texas. We've been told rescuers are required to collect sales
taxes.

* We've all been told by Texas Humane Legislation Network and HSUS that
this bill doesn't affect "hobby" breeders which is a lie. Yes, it does!
Numbers set on intact female dogs or cats allowed are irrelevant as they'll
be back every session until they legislate pet ownership out of existence.

* If this bill were "necessary to protect public health and safety" as
claimed, it would include all animal shelters and animal control facilities
that sell animals, yet they are exempt! Parvovirus, Distemper, Kennel
Cough, external and internal parasites and other diseases are rampant in
animal shelters and animal control facilities. We know because we take
these animals into our Rescue Program, rehabilitate them and find them new
loving homes. Veterinary bills average $400 to $1,000. How about this bill
addressing that?

* Raids and animal seizures from breeders, rescuers and "hoarders" with
substandard conditions are made on a regular basis in Texas with existing
local and state Animal Cruelty Laws. A new state department with personnel,
office expense, equipment, vehicles and facilities is an unnecessary burden
on taxpayers.

* This is a national "animal rights" legislative agenda to end all dog and
cat breeding. HSUS's stated goal is to get this legislation proposed in 34
states this year. To date they've succeeded in 16 states, including Texas.

* All animal control advisory boards in Texas are "stacked" by these
extremists - just as the Advisory Committee described in HB 3180 will be. A
directory is to be published of all licensed facilities which will lead to
harassment from Animal Rights Extremists.

* John Stossel and his 20/20 TV Program did an expose on the SPCA of Texas
regarding seizures of animals that were not being cruelly treated but were
seized anyway. The 20/20 Program had a veterinarian pose as their cameraman
for the expose.

* Animal seizures are big fundraisers for humane societies who lobbied in
2003 to change state law disallowing animal owners the right to appeal a
hearing when their animals were confiscated. We're attempting to get that
changed this session to allow an appeal with HB 1046 by Mark Homer. Texas
Humane Legislation Network is vigorously opposing Homer's bill.

* Animal Rights Extremists work to get their legislation passed and then
volunteer to enforce it, using it as a "tool" for harassment of animal
owners. Palm Beach County, FL, is providing used uniforms to vigilante
animal rights activists to enforce their spay/neuter ordinance and hobby
breeders permit. It is being considered by Dallas and San Antonio Animal
Control Departments where onerous ordinances passed recently.

* The bill states that the new state department may designate a local
animal control authority or local humane society agent to enter private
property (our homes) for investigations and inspections with no prior
notice. Licensing of breeders and dealers allows access to premises without
a search warrant. This is not acceptable to us.

* If legislators vote "yes" to HB 3180, it will be political suicide in
Texas. Animal Rights Extremists are approximately 1% of the population. At
least 60% of Texas families own pets who have become members of their
family. Coupled with the Mandatory Pet Spay/Neuter Bill filed by Senator
Van de Putte, the extremists' agenda should be fully exposed at this session
of the legislature.

* Brokers and Commercial Breeders that sell to pet shops are already
regulated under USDA regulations. This bill is duplication.

* Retired hobby breeders worked their entire lives to be able to devote
full time to their hobby and participate weekends in AKC and UKC events;
such as Conformation, Agility, Obedience, Rally Obedience, Tracking,
Earthdog, Coonhound, Herding, Lure Coursing, Field and Hunting Trials, and
Junior Showmanship. The Animal Rights Movement wants to end all that.

* This type of legislation is very divisive among animal groups at a time
when we should all be working together for animal welfare. However animal
welfare obviously isn't the real goal of all groups. The extremists' goal
is to end all use, breeding and ownership of animals for any reason,
including pet ownership.

PCBC/ Div III Health Clinic April 18th

A Health Clinic will be held on Saturday, 4/18, at the Specialty, sponsored by PCBC. Dr. Butchko will be in attendance. Cardiac and Knee Patella Screening will be performed. The clinic will be open from 10am to 3pm for a fee of $20/dog. All dogs are welcome, not just ones entered in the show, must be 12 months of age. This will be handled on a first come first serve basis. All dogs screened will receive a "CHIC" certification.

BCCS Specialty 09

The Bulldog Club of Colorado Springs will hold its annual Specialty Show on June 5, 2008. It will be held in conjunction with the Colorado Springs Kennel Club Show on June 6th & 7th. Dr. David Volz of the Animal Clinic of Woodland Park will be offering OFA Cardiac and OFA Patella exams on Friday June 5th. The cost for Both exams is $25.00 and $35.00 for two dogs (same owner). The first thing Gabe had to do was to kiss the student on his cheek. They had a vet table raised WAY up--sitting on top of apple boxes--so it was level with the student's face. I was a bit nervous about him being up on that narrow platform, but was able to stay right close by to watch him MOST of the time. We put chicken baby food on Cameron's cheek to get Gabe to "kiss" him, while he said his lines.

Then...they decided they wanted to just get some close ups of Gabe while everyone stood back...which was fine at first--until he saw an "intruder" stalking around behind a curtain just off stage & went into "WaTcHDaWG" mode! Before I could stop him, he'd leapt off the platform (which was about 5 feet off the ground!) and ran over to check out the "Bad Guy"! YiKeS!!! Fortunately it didn't phase him at all--but it sure made me freak out!



Then, they moved in a couple lower platforms and Gabe had to jump down off the higher one (about 2' off the ground...still somewhat high, but easy for him), then right back up onto the lower platform & join Cameron.

And...waiting for ANoTHeR run through! Gabie was a sport through the whole thing--eager to do it again & again (Mom brought his special Fido Treats along for lots of rewards, so he was more than willing to perform!)

They had a final scene where Gabe had to trot across an 16' platform, then jump off. I left him at one end on a stay, then signalled him to come when they were ready. The camera was on a track (you can see these in the "Waiting in the Wings" photo above) & they panned alongside him as he moved.


After a couple hours of waiting, shooting & waiting, they said the magic words, "It's a wrap!" and Gabie was free to head home!

And, for some OTHER HOT NEWS...Gabe has been offered the LEAD role in a new dog movie that will be filmed this summer up in Canada!!! This is with another dog talent agent who has worked on all of the Air Bud movies, X-Files, Cats & Dogs, and many more...she has been doing it for over 28 years and gets more of the big jobs. They would probably have 3 or 4 dogs to play that lead role--some for the distance work, others for close ups, etc. as there would be a LOT of scenes to film & the bulldog would be the main character.

The only hold back is that I'd very likely have to hand Gabe over to her for about 5 weeks, then for another 3 weeks later on while they shoot. The filming will most likely be in Ontario, Canada & so my Baby Boy would have to be entrusted to this gal. In talking to her at length the other day, I was reassured that she is very familiar with bulldogs and their special needs & she is close by so we could go spend some time with her before I made the decision.

ACTION IS NEEDED NOW- from all California pet lovers.

California is considering yet another mandatory spay and neuter law. SB 250
mandates sterilization of most dogs and cats in California. By creating new
crimes and imposing new duties on local animal control agencies, this bill
would impose a state-mandated local program upon local governments.

CURRENT STATUS: Action is needed IMMEDIATELY. The bill has been introduced
and has been assigned to the California Senate Local Government Committee.
Organizational letters (clubs, rescue, etc) and individual letters to
committee members are needed ASAP.

WHAT THIS LEGISLATION WILL MEAN TO YOU: SB 250 provides that no person may
own, keep, or harbor an unaltered dog except as specified. It would make it
unlawful for any person who owns, keeps, or harbors any unspayed or
unaltered cat 6 months of age or older to allow or permit that cat to remain
outdoors. It would require an owner or "custodian" of an unaltered cat to
have the animal spayed or neutered, or provide a certificate of sterility.
It would allow an unaltered dog license to be denied or revoked for a
variety of reasons.

This bill would require anyone who offers any unaltered dog or cat for sale,
trade, or adoption to meet specified requirements and report the sale within
10 days. It would require, if an unaltered dog or cat is impounded
pursuant to state or local law, the owner or custodian to meet specified
requirements, including paying the costs of impoundment. Requires
sterilization if a pet is impounded for any reason.

Contact information for the California Senate Local Government Committee and
examples of discussion points in opposition follow. Please write or fax
TODAY.

SUGGESTED ARGUMENTS AGAINST THIS LEGISLATION (SB 250):

This is a costly unfunded mandate on local governments. Local
governments already have the authority to adopt ordinances to deal with
irresponsible pet owners. State action on this matter is unnecessary.

Experience has shown that mandatory spay and neuter ordinances are costly
to administer and ineffective. Analysis of a similar measure last year (AB
1634) by the California Department of Finance showed animal control costs
are likely to rise, euthanasia rates increase, and pet licensing drop off.
Money will have to be taken from other vital local services.

Studies show that education has worked and 87% to 95% of owned cats are
now sterilized. Approximately 75% of dogs are sterilized. To further
increase the numbers of owned cats or dogs sterilized it is necessary to
provide low cost or free spay/neuter accessible year round. This bill would
do nothing to solve the real problem.

This bill imposes punishment for impounds of cats or dogs by mandating
sterilization of pets before release. On top of other expense to reclaim
lost pets this will mean more cats will be left in the shelters.

There are many reasons why a cat could be impounded by animal services
such as fire, earthquake or other disasters. Cats can get loose from a
carrier going to the veterinarian, escape from a hotel room or be
inadvertently let outside by a careless cat sitter. A cat could end up in a
shelter without reflecting owner irresponsibility. This provision means
confiscating the reproductive value of a show/breeding cat.

Complaints from disgruntled neighbors, or any person who wants to harass
someone with an intact dog would be encouraged by this bill.

This is a bad bill, quickly pulled together without regard for existing
laws or of the practical consequences. For example, it requires anyone who
sells an intact animal to post the animal's license number. But most local
jurisdictions do not license cats. Most local jurisdictions do not provide
for licensing an animal under the age of four months but most puppies and
kittens are sold before they reach that age.

This legislation will not improve the lives of cats and dogs but will
negatively impact responsible owners and breeders, and by placing additional
burdens on owners of intact animals. This will lead to an increase of
animals in shelters.

Use of the term "custodian" in the bill, rather than being limited to pet
owners, suggests this law would be used to unfairly target feral cat
caretakers and other individuals feeding or caring for free-roaming cats.
It punishes the people trying to help these unfortunate animals. Kindness
becomes a crime.

If a person is caring for a few freeroaming/feral cats and has not been
able to trap some of them for spay/neuter they could be cited and subject to
a civil penalty if over a local limit law, when ownership of these cats is
not clearly defined.

The word "custodian" does not change attitudes of those who don't care
properly for their animals. Inserting this term in laws actually weakens the
accountability of owners for animal abuse. The important factor in reducing
the reproduction of unowned/free-roaming cats is the point when a person
declares "I own this cat" because this leads to their taking responsibility.
The use of inappropriate terms, such as "custodian", dilutes this message
and lowers the status of cats in society since owners have responsibilities;
"custodian" has no meaning.

ACTION TO TAKE:

ORGANIZATIONS (clubs, rescue groups, etc.) send your faxes NOW to be
received by the Committee Consultant, Peter Detwiler to be included in the

CALIFORNIA SB 250 letters need to get in ASAP

Hi, please make certain that you, your organizations (clubs, rescues etc...) and as many "doggie" friends as you can have or will be writing and calling to OPPOSE SB250. www.petpac.org for more info

This IS a mandatory spay/neuter bill. ANY animal control ordinance violation can trigger the MANDATORY surgical sterilization of ALL your dogs or cats and you may be prevented from ever legally owning an intact pet in California again under it's terms.

Bullet points.

SB 250:

is an unfunded state mandate that will HARM the welfare of animals in California and worsen AC costs. The California Department of Finance last year determined that the strikingly similar final form of AB1634 would result in more animals impounded and killed and more cost to the state under the Hayden Act.

It imposes an unfunded state mandate on local governments.

It will discourage many foster homes for dogs, particularly important to breed rescues, and feral cat volunteers who may fear fines

It will discourage the redemption and reclamation of impounded pets whose owners fear fines

It will damage local AC budgets as it discourages people from licensing their pets due to yet more fees and the fear of being "targeted" for citation for trivial complaints because they are listed in the system as an intact animal owner.

Forces major and potentially life threatening surgery upon an animal for citation of many many sorts of potential violations (barking, water dish turned over etc.. late renewal of license.) that have NOTHING to do with an animals reproductive status.

All individuals need to write. All organizations need to write.

A REPRESENTATIVE OF YOUR CLUB, RESCUE OR BUSINESS MUST ALSO SEND IN A LETTER ASKING THAT THE GROUP BE LISTED OFFICIALLY AS OPPOSED. This must be done NOW.

PLEASE NOTE: There is nothing illegal immoral or fattening about a 501c3 charity writing in either opposition or support of legislation.
501c3 charities may not lobby for political gain or contribute financially to a campaign. BUT they absolutely can voice strong opposition to any proposed legislation which may cause harm in their estimation to their cause. ALL MSN type laws enacted anywhere have ultimately proved harmful to animals by the numbers therefore rescues should voice opposition. ALLEY CAT ALLIES, a leading feral cat advocacy group is OPPOSED to SB 250.

OTHER 501cs such as clubs, may not only write they can also donate to lobby against legislation provided that the funds and time donated do not make up the MAJORITY of funding or activities the club engages in.

*** BeHiNd tHe SCeNeS WiTh GaBe!--Commercial Shoot ***

This past week Gabe was called by an animal agent in Seattle (who'd gotten our name through Mel) to do his first commercial shoot. The commercial is for an online high school called Insight Schools, and will be aired on cable TV in WA, OR, ID & possibly CA, as well as on their website & YouTube channel. It was filmed on a green screen so they will be adding various backgrounds for the finished product. It will be a 30 second spot that highlights various careers a high school student is considering...including being a vet happy.gif (so Gabe's appearance will be just for that one portion of the commercial) It'll be a month or so before they have it all put together & then I'll post the info so you can all see it.

Until then, here are some "Behind the Scenes" pix of our day at the shoot...


When we first arrived, Gabie & I hung out in the "Green Room" (not the same as the green screen that the commercial was filmed on, but the room for the actors to hang out in while waiting for their call). Gabe, of course, made himself right at home...

The shoot was done at a large facility called Jonas Jensen Studios in Seattle--about an hour & a half drive from where we live. (We didn't have to be there till 10 am, so at least we didn't have an early day and The Star could sleep in!)


Gabe wasn't thrilled sitting up here--it didn't offer the greatest support--but I had to get his pic with this "offical JJ chair"!

Hi becky, the hbo series "true blood" it's a modern day vampire show. The main charater is ana paquin aka "sookie". She's kind of sweet, sassy, and spunky all at the same time. I think it's neat we came up with the same names. When I first started my first breeding was to jerry. His sire is jj, the same sire to your rosy. I would always go back to look at your rosy over and over again happy.gif. How is she doing? Sorry for the poor grammar and spelling. I'm on a blackberry. Not stupid! Most of the basic computer stuff is just a matter of messing around with the functions and figuring them out. That's how I learned. Just figured I would show you how. That way you can post pics whenever you feel like it. Hundreds of lurkers on the board but only a hand full of people ever say anything. Sometimes the people on the board who need a "Bulldog fix" get a little bored.

You can just email me the pics and I will post them for you or try and figure it out. It just goes pretty much how I showed in the previous post.

Oklahoma HB 1332 Delayed...Now What?

Good Morning All,



Do you feel like things changed overnight? Yes, I do too!



As you already know HB 1332 has been pulled from the appropriations committee agenda. We are concerned about this as the next opportunity for this bill to be heard by the assigned committee is next Weds. which is the day after the HSUS Lobby Day. The HSUS (Human Society of the United States) is the national organization that does not support local shelters, animal care at the local level and is the powerful lobby group with evidenced animal rights ties. I want to be clear that this is not your local shelter organization. HSUS have introduced or backed anti breeding bills in over 20 states this year some restrict breeding to one litter per year. The latest figures from the IRS state they have raised over $125 million with none of it going to the local communities for animal care. If you would like information or question the information in this email let me know. Im happy to get that for you.



On to the subject at hand



We feel that HB 1332 was pulled because it did not have the necessary votes to pass out of committee and would have a better opportunity to garner those votes next week after the lobby day and the normal politicking.



Its very important to continue contacting legislators. Just because you sent a letter or called it does not mean you cant contact them again. This isnt like voting where you only get to do it once. Remember, these folks work for you. They are PUBLIC officials..and you have every right to let your voice be heard 7 days a week and twice on Sunday if necessary.



We realize its difficult to come up with information to make your point on a daily basis. We certainly do not want you to put all the points into one email every day. Were suggesting that we all take one point and write to the members of the committee each day asking that they oppose the bill, picking a different point each day. This way you can get more mileage with your correspondence and use fresh material. You also dont have to just use email. Making a phone call every other day is another way to voice your concern and to let committee members know this topic is not going away.



Well try to help by sending out a daily email that discusses one negative aspect of HB 1332. Well include the full OAIA list of points each time which you can use as well. Also, the NAIA alert at http://capwiz.com/naiatrust/issues/alert/?alertid=12965961&queueid=[capwiz:queue_id] can be used daily and provides a nice way to enter different information each day. Clickclickclick and its done, how easy is that?



The main thing I want to stress is just because they pulled this from the committee agenda doesnt mean were winning here. It means we have to focus and make a huge effort to keep informing committee members that we are not going away. Everyone has to do their part and should be prodding your network to do theirs. Dog Clubs, Associations, individuals, other agriculture partners like the Cattlemans Association, Oklahoma Riflemans Association, pet owners, breeders etc., should be asked to step up to the plate over the next few days. Indirectly this bill will effect others, it opens the door to more legislation that is restrictive, imposes unfunded mandates and does not solve the problems for which it is intended.

Texas Bills and The Committees that they have been assigned to

Attached is a list of the various committees that have been assigned some of the animal related bills, specifically those that may have a significant impact on our dogs, our clubs and ourselves.

Please Crosspost to your club membership and request your members to voice their concerns, opinions, and in the case of HB 1046, their appreciation and support. It doesn't take long to call, fax or write, at least one committee member, even if they don't represent your district...they represent your future rights through their decisions.

Also, mark your calendar for the RPOA Lobby Day, Wednesday, April 8th in Room 210 of the Sam Houston Building, adjacent to the Capitol Building, from 10:00 am to 2:00 pm. Take the opportunity to visit your district Representative and Senator, by calling their offices and making an appointment to explain how their vote might affect you and the welfare of your dogs. They do want to represent the responsible approach, they just sometimes need to have a better understanding. If your time is running short, at least try to bring a sack lunch, so that we can meet at the Sam Houston Building, Room 210, at noon, and discuss the issues and do some brainstorming on how we collectively can create a positive influence in the legislative process.

The HB 4277, concerning sterilization and permit issues, was assigned to the House Committee on State Affairs today, authored by its Vice Chair, Rep. Jose Menendez. The Senate companion bill, SB 1845 was referred to the Senate Committee on State Affairs on March 20th, authored by its member, Sen. Leticia Van de Putte. As written, HB4277 and SB 1845 would have a widespread and negative effect on an extremely large number of dog and cat owners throughout Texas. The deficiency in its language would exclude many of our dog's activities from being exempt from spaying or neutering, despite being purebred. The only specific, designated activity included in the proposed legislation is Section 828.002 (c) (2) the animal is a purebred animal displayed at a competitive exhibition to determine how well it physically conforms to an established breed standard...The other option is to purchase an Intact Animal Permit for $300 (no time specified), which can result in a criminal penalty for failure to do so. It's that type of lack of understanding of our dog activities and the scope of our interests that leave massive deficiencies in our legislator's ability to craft a responsible and reasonable law that we must obey or be subject to criminal enforcement. That is why we must express ourselves, educate our lawmakers and protect our rights, and it only happens every other year, for a few months. Now is the time.

MANDATORY STERILIZATION BILL TO BE NEUTERED, VOTED ON.

THE CAPITAL, TALLAHASSEE, March 23, 2009... A bill to require most pet
owners in Florida to spay and neuter their cats and dogs or face a fine is
expected to pass out of its first House committee Tuesday.

But not until its fixed.

Originally written to require mandatory sterilization of most cats and dogs,
a proposal (HB 451) by Rep. Scott Randolph scheduled for a vote by the House
Agriculture and Natural Resources Committee on Tuesday will be amended to
strike the mandatory provision that has left pet owners and some veterinarians
howling.

Panelists are expected instead to vote on an amended version of HB 451 that
merely gives local officials the option of diverting a $5 surcharge already
being tacked on to animal control citations to help local governments pay to
spay or neuter Rover or Fluffy.

Local governments spend between $50 million and $100 million a year
euthanizing and housing dogs and cats, said Randolph, D-Orlando. Most of the
time, those funds come from public safety budgets. This is a financial bill.

Local animal control agencies are allowed to add a $5 surcharge on animal
violations. Currently, they must use the funds to pay for employee education
programs. The amendment to be offered Tuesday would allow those funds to be
used for sterilization services.

Animal enforcement officials say spending money to sterilize more of the 10
million dogs and cats in Florida is cheaper and easier than punishing owners
who dont neuter their pets.

Enforcement is extremely expensive, said Dr. Sara Pizano, director of
Miami-Dade Animal Services. You would have to spend a whole lot of money. You
have to ask yourself what your goal is. Your goal should be to neuter animals,
not punish people.

Currently, Pizanos department generates about $100,000 from the surcharges
and only 26 employees. She said her department could perform thousands of
procedures with that kind of money.

Randolphs original bill is modeled after a measure approved last year in
Los Angeles, which enacted a proposal that fines pet owners $500 for not
neutering their pets. Breeders or recalcitrant owners can purchase permits to forgo
the procedures.

But there have been complaints about the L.A. law and its been hard to
enforce.

A couple of Florida communities also have measures already on the books.
Palm Beach County charges pet owners a fee if they dont spay or neuter their
pets. Volusia County also requires spaying or neutering, but has exemptions for
breeders and some other pet owners.

House Agriculture Committee Chairwoman Rep. Trudi Williams, R-Fort Myers,
said shes allowing the bill be heard as a favor to Randolph, who has taken
considerable heat for the measure.

With such a tight budget, Williams said she has told members that
non-critical measures will not be considered this term, including a plethora of pet
bills deemed nonessential to the state.

Ive told members that were going to focused on budget-related issues and
thats it, Williams said. I agreed to allow (Randolphs) measure so he
can clear his name from a really bad bill. Wed like a clean slate.

Late Friday, Florida House Bill 451 was added to the House Agriculture and Natural Resources Policy Committees agenda for Tuesday, March 24. The committee will consider the bill at 8:00 AM in Reed Hall, 102 HOB, at the Capitol in Tallahassee. HB 451 would require the mandatory sterilization of every dog and cat over four months of age, unless they meet strict criteria for exemption. In mid-February, several media outlets reported that HB 451 sponsor Representative Scott Randolph stated that he intended to issue a strike all amendment to replace the original bill with new language. However, such language has not yet been provided. Therefore, it is vitally important that all concerned responsible dog breeders and owners in Florida call, fax, or e-mail the members of the House Agriculture and Natural Resources Policy Committee and let them know that you strongly oppose this legislation.



The American Kennel Club opposes the concept of breeding permits, breeding bans, or the mandatory spay/neuter of purebred dogs. Instead, we support reasonable and enforceable laws that protect the welfare and health of purebred dogs and do not restrict the rights of breeders and owners who take their responsibilities seriously. Additionally, we strongly support and actively promote a wide range of programs to educate the public about responsible breeding practices and the responsibilities of dog ownership. AKC believes that any attempt at restricting the rights and liberties of responsible breedersespecially via mandatory spay/neuter lawsmust be defeated.



As introduced, HB 451 would:



Require owners of every dog or cat in Florida to have each animal sterilized within 30 days of the animal reaching four months of age, or within 30 days of the owner receiving the animal.
Provide ambiguous exemptions, including dogs with veterinary certification showing that sterilization would endanger the animals health, until such issues no longer exist; Greyhounds currently used for racing, until retirement; show animals registered with an established breed registration organization to be approved by the Department of Agriculture and Consumer Services; dogs or cats that have earned, or are in the process of earning, a competitive sports title; animals trained, or in training, for use in law enforcement, military, or rescue; and animals for which an owner holds a valid breeding permit issued in accordance with an ordinance of a county or municipality.

Concerned Floridians should contact the members of the House Agriculture and Natural Resources Policy Committee. Respectfully yet strongly let them know that you oppose mandatory spay/neuter laws, just as HB 451 demands.
