Federal Lawmakers Introduce Bill to Crack Down on Abusive Puppy Mills

Legislation Seeks to Close Loophole in Animal Welfare Act that Allows Internet Breeders to Sell Puppies without any Federal Oversight

WASHINGTON (Sept. 19, 2008) The Humane Society of the United States and Humane Society Legislative Fund commend federal lawmakers for introducing bills that will crack down on abusive puppy mills in the United States where breeding dogs are often stacked in wire cages for years to produce litter after litter. The legislation will close a loophole in the Animal Welfare Act that currently allows large, commercial breeders who sell puppies online and directly to the public to escape licensing and regulation.

The legislation known as the Puppy Uniform Protection Statute (PUPS), or Babys Bill in honor of rescued puppy mill survivor Baby who is the subject of Jana Kohls new book A Rare Breed of Love was introduced in the House of Representatives yesterday as H.R. 6949 by Reps. Sam Farr (D-Calif.), Jim Gerlach (R-Pa.), Lois Capps=2
0(D-Calif.) and Terry Everett (R-Ala.). A companion bill was also introduced in the Senate by Sen. Richard Durbin (D-Ill.).

The bills also require that dogs used for breeding be removed from their cages for exercise every day. Female breeding dogs in puppy mills are typically forced to live their entire lives in small cages with no opportunity for exercise, no socialization, and little human interaction.

Dogs are not livestock, and they shouldnt be treated like a cash crop, said Michael Markarian, executive vice president of The Humane Society of the United States and president of the Humane Society Legislative Fund. We are grateful to federal lawmakers for introducing this legislation to curb the worst abuses in the puppy mill industry. Its a much-needed upgrade to our nations laws that protect mans best friend from cruelty and harm.

Facilities that breed dogs for commercial resale through pet stores are required to be licensed and inspected under the federal Animal Welfare Act. But thanks to a gaping exception in the law, puppy mills that sell directly to the public are exempt from any federal oversight whatsoever. Unregulated Internet sellers and other direct sales facilities sell thousands of puppies a year to unsuspecting consumers. Due to improper care, their puppies are often sick, leaving outraged consumers with frail, sometimes dying puppies and high vet bills. Meanwhile, the breeding dogs at these facilities often spend their entire lives in constant confin
ement and deprivation.

Sadly, finding your puppy online may well increase the chance that youll be buying from a puppy mill, said Sen. Durbin. Our bill simply requires that breeders obtain a license from the USDA if they raise more than 50 dogs in a 12-month period and sell directly to the public and sets forth reasonable standards of care for commercial breeders. Responsible dog breeders are not the target of this legislation, but hopefully it will put the puppy mills out of business.

My work supporting puppy mill regulation goes back to my time in the California Assembly where I championed California's puppy mill law, Rep. Farr said. I think its very important that Congress take the time to address issues like animal welfare. These are the kinds of issues that really demonstrate who we are as a society.

Im proud to join with Congressman Farr and representatives of The Humane Society of the United States today as we continue our efforts to ensure that commercial dog breeders are appropriately regulated, added Rep. Gerlach. Our bill, the PUPS Act, will close a loophole in current law that allows large breeding operations avoid any and all oversight. I am confident that this bill will not hinder the operation of reputable and responsible breeders. Instead, it is aimed at protecting dogs and making individuals who are motivated by profit over the fair and humane treatment of dogs accountable for their actions.

The legislation will close the loophole in the AWA that allows thousands of commercial breeders to go unregulated. It will require the following changes to the AWA:

All dog breeders who sell more than 50 puppies per year directly to the public will be federally licensed and inspected; and

Dogs at commercial breeding facilities must be given the opportunity to exercise for 60 minutes a day.

The bill will not affect small breeders and hobby breeders who sell fewer than 50 dogs per year directly to the public, but is crafted to cover only the largest commercial breeding facilities.

Public concern about the inhumane conditions typical in puppy mills is at an all-time high, due to coverage on national television and several large-scale cruelty investigations and rescues from puppy mills this summer that The HSUS and local shelters spearheaded. Earlier this year, the Farm Bill passed by Congress included a new provision to ban the importation of puppies under six months old from puppy mills in China, Russia, Mexico and other foreign countries.

Chicago Anti-Cruelty Society on Record Against Chicago Mandatory S/N Ordinance

Steve Dale delivered when he promised us important news on Sunday on
his Pet Central show!

This is the BIG News! Chicago Anti-Cruelty Society is now on record as being officially opposed to the proposed Chicago Mandatory Spay/Neuter Ordinance. This was announced on the Steve Dale Pet Central radio show Sunday evening Sept 21 2008 by Chicago Anti-Cruelty Society President, Dr. Robyn Barbiers DVM. Dr. Barbiers stated the Anti-Cruelty position on the proposed Mandatory Spay/Neuter ordinance: They support spay/neuter. They do Not support the proposed ordinance, due to its "unintended consequences", and for various others reasons as well.

Chicago Anti-Cruelty is the oldest (founded 1899) and largest of Chicago's private animal shelters.

Dr. Barbiers had a distinguished career at the Chicago Lincoln Park Zoo before assuming her Chicago Anti-Cruelty Society duties in August of this year. You can read more about her here:

Additionally, Steve interviewed the President of the Chicago Animal Shelter Alliance (CASA), Jim Borgelt, who stated his own personal opposition to Chicago Mandatory Spay/Neuter and the reasons for his opinion. (He was not speaking for CASA in this at this time.) Mr. Borgelt stated that he was actually in favor of the ordinance around the time it was introduced (back in May), but now that he's researched the failure of Mandatory Spay/Neuter in other cities, together with its lack of enforceability, and others issues, he is now against it. Mr. Borgelt is also on the Board of Directors at Lake Shore Animal Shelter, Chicago. He stated that their Board is still not in absolute agreement on the issue of Mandatory Spay/Neuter, although he is personally is against the proposed ordinance.

Finally, to start the program, Steve interviewed veterinary behaviorist Dr. JohnCiribassi, past President of American Veterinary Society of Animal Behavior. Dr. Ciribassi was asked about mandatory spay/neuter. (Mandatory Spay/Neuter proponents suggest that neutered dogs are nearly guaranteed not be dangerous, and therefore neutering all male dogs would make our city safer. ) Dr. Ciribassi, an expert on companion animal behavior, says most cases he sees in his referral practice (in dogs) are for aggression. And the vast majority those dogs ARE neutered, or spayed. So, if spay/neuter worked without doing anything more to curb aggression, Dr. Ciribassi would be out of business. He continued that while neutering does matter, particularly in dog on dog aggression, neutering alone will not prevent aggression or ¡¥fix' an aggressive dog. Dr. Ciribassi says he's for spay/neuter, in concept and also glad that Illinois shelters spay/neuter (by law) with each adoption. But he is not for the mandatory spay/neuter - and based on the science of what behaviorists know to be true about hormones, the impression being forwarded by proponents simply is not correct.

Federal Breeder Bills

There are two federal bills to regulate breeders that have recently(last two business days) been introduced in congress. One in the house(HR 6949) and one in the senate (S 3519) The text of these two have not been posted from the Government PrintingOffice (GPO) yet. This is normal, it takes a day or so to get thingsprinted etc. Many times they will introduce legislation from the house and from thesenate. This give the opportunity for one to get through the process.In the end they usually will merge the bills. Senator Durbin (D) from Illinois introduced the senate bill. He is also the assistant senate majority leader.

Finding a breeder (pulled from an all Bull forum..Pit, Bulldog etc)

When you talk to people about their puppies, there are a few warning signs that you may be dealing with a disreputable, unethical, or irresponsible breeder:
The "breeder" lacks knowledge about the breed
The "breeder" shows ignorance or denial of genetic defects in the breed
The "breeder" has no involvement in dog sports
The "breeder" doesn't let you observe the puppies or adults, or let you see the kennels
The "breeder" has no documentation and cannot provide a pedigree
The puppies are not socialized
How to read those ads!
Here are a few more things that you ought to look out for.
"Champion lines" -- look instead for Champion sired or Champion parents. All Champion Lines means is that there is a dog somewhere in your puppy's family that was a champion - it says nothing about the quality of the parents at all. Anyone can buy a puppy from a champion, but it does not mean that they have any other interest in the breed but to bank on the name and make money. The puppy may have been sold as a pet (since it had some problems that prevented it from being shown) and an unethical person did not have the dog desexed and is still breeding puppies.

"AKC Registration" or "AKC Papers" -- So what? AKC registration does not guarantee quality. AKC papers are much like the title of a car - papers are issued on the junked chevy on blocks in your yard just as easily as they are on a brand new, shiny Jaguar. AKC does not control breeding, approve litters, or guarantee soundness. Unfortunately, in the hands of some unethical breeders, it doesn't even guarantee that the dog is purebred.

AKC Registration is automatic if you buy from a reputable breeder - they will provide all necessary paperwork when you buy a puppy. It is not a selling point, and shouldn't be treated as one.

Be wary of other "registrations", as well. There are several groups that are registering dogs, occasionally even mixed breeds, for a fee. This registration means nothing, and is of no value to you. Not that AKC papers really mean much, either.

"extra-big", "extra-small" -- breeders trying for extremes are rarely raising healthy dogs, and any ad that has to stress the size and weight of the dog to sell the puppies is suspect, in my opinion. Usually, these dogs are outside of the breed standard and are subject to their own medical problems due to excessive size or lack of it.

"rare" -- Why? Is the dog showable? Are there too many defects for the animal to be bred? What kind of problems does this "rare" color or size or pattern entail? There are many people buying "rare" white Boxers and Shepherds, not realizing that they are not show-prospects, and that they are buying a dog with medical problems from lack of pigmentation, and possible behavioral problems as well.

There are even some people selling unusual cross breeds as "rare" dogs, and people buy them thinking they are getting some unique treasure. I don't want to be too harsh about this, though -- every breed we se today is the result of some specialized and "rare" breeding to create a certain look or behavior. Shepherds herd, retrievers retrieve...because we have selectively bred them to do so. A breeder who is trying to 'recreate' a lost breed may fall on either side of the ethical divide. Shop with care.

"see both parents" As noted in questions to ask a breeder , this is not usually a good thing. Rarely will a good breeder have the luck to own both dogs for the perfect litter. If you can see both parents, it often means that the person had two dogs in the back yard and didn't supervise them carefully enough, resulting in puppies.

I probably get more mail on this one statement than anything else -- people who legitimately have both parents are incensed that I would suggest that they are unethical and bad breeders. That is not what I am suggesting -- there are some good and very reasonable reasons to have both parents on site. However, you need to ask the right questions and understand why this is true. If the breeder doesn't have an answer, or the answer is something like "well, they were just such cute dogs..." or "we bought another dog so we could have puppies" you need to evaluate whether this breeder is doing the right thing. They might be, they might not. It's up to you to ask.

"Must go now!" Why? Are they too big to be cute anymore? Need more money? Is there a problem? Be very wary of this one.


There really is no secret to buying a good purebred dog. It all depends on the knowledge of the buyer and the willingness of the buyer to utilize that knowledge when confronted with a bunch of cute fuzzy balls of fur. An informed buyer is less likely to be taken in. If only there was a Consumer Reports on dog breeders.




The first step in the process is deciding which breed is right for the family.

The Internet offers several venues for testing your personality and matching it with certain breeds. A family with small children? Perhaps a smaller breed would be a better choice with an emphasis on temperament? An active lifestyle? Maybe one of the sporting breeds would be best. Large and giant breeds (over 60 pounds) are nice but remember they cost more to feed and should the dog get sick, require more medicine because of their size. Reading all you can about breeds of purebred dogs and familiarizing yourself with traits and characteristics is a must.

Once a breed has been chosen, the search for a breeder is next on the list.

Pet shops are certainly an easy way to buy puppies but these puppies are more likely to have been mass produced and little attention has been paid to health. Also, these puppies are sold with hefty price tags. Guarantees are sketchy at best and a return policy is usually for thirty days. After that, you are on your own.

The next option is the backyard breeder. These people have two dogs, one of either sex and decide that Rover should have some fun with Roverette. After all, the children need to see the miracle of birth and Roverette has to have a litter before she is spayed. Surely a litter of puppies is money in the bank. This sounds like a good idea to the breeder but to the buyer, it may be a disaster waiting to happen. These are the puppies where no health testing or pedigree research has been done on the parents. They might be registered and this fact is supposed to be a selling point.

Next is the sophisticated backyard breeder. He may dabble in showing in conformation and/or obedience but maybe has not accomplished much. He may have some knowledge but more than likely, hasn�t had enough experience or contact with people in the breed to be of any real help. His main selling point may be that there are X number of champions in the pedigree and these puppies may be show quality. That seems to be the catchall phrase and meant to impress the buyer. In fact, many things are done to impress a buyer and marketing is important. Again health testing is probably not done on the parents of the litter. If there is any health testing, it is minimal.


The last breeder is the serious breeder.

These are people who are truly interested in their breed. They are involved in showing, have champions and have years of experience under their belts. Their reputation depends on the puppies they sell so they are very careful about the pedigrees of their litters and the health testing done on the sire and dam. They have a lot of money invested in their breeding stock and take care of it. The best companions for a family come from show stock. Yes, the best pets come from show stock. Not only do the dogs look good but temperament is more likely to be even. The serious breeders are dedicated to the welfare of their chosen breed. They rarely advertise because their dogs sell themselves. The waiting lists for their puppies are long.

After researching the breed and finding breeders, the buyer needs to start the interviewing process.

By no means should this be done via email. The buyer either should make contact by phone or in person. This is a two way street. The buyer can see and/or hear what the breeder is like and the buyer is showing the breeder how dedicated he is in his search for the right puppy. The relationship between buyer and breeder is very important. Who else will help the buyer at 3 a.m. in the morning with a puppy question? A good breeder will be available to answer all questions, day and night, on weekends and yes, even on Christmas.

Be sure to familiarize yourself with the terminology.

Know what a pedigree is, know what AKC stands for and know what OFA is. Ask questions if you don�t understand something. If the breeder claims to show, ask to see pictures and be leery of a bunch of blue, red, yellow or white ribbons. In essence, this means nothing in the quest for a championship.

The buyer should ask the breeder questions and if the breeder doesn�t have the answers, the choice of that particular breeder should be reevaluated. Some of these questions should include:



1. How many years have you been involved with this breed? (Preferably over fifteen.)

2. Why did you decide this was the breed for you?

3. Do you show your dogs? How often do you attend dog shows? How long have you been showing your dogs?

4. Do you have both parents on the premises? (This is a trick question. If the sire of the litter is there and is not a champion, this was probably a convenient breeding and no research has been done on pedigrees. Run.)

5. What health tests have been done on the parents of the litter? A visit to the veterinarian last week doesn�t count when it comes to health testing. (At the very minimum, OFA hips, CERF, and thyroid testing should be done. Do not accept the statement that the parents are very healthy and don�t need to be tested. The breeder should be able to back up a claim of testing with certificates. Actually take the time to look at the health papers and study them.)

6. Are the sire and dam registered? (A word here about registration. American Kennel Club or AKC registration is preferred. There are other registries out there but they are less stringent about their registration procedures. Don�t be taken in by the answer of �yes�. Ask to see the registration papers.)

7. Is there a pedigree for the puppies that I can look at? (A good breeder will have one of these available.)

8. Are the dogs conformation champions, obedience title holders or do they have CGC (Canine Good Citizen) certificates? Are these certificates available for viewing? And if so, do the names on the certificates match the names on the registration papers? (All these things are ultimately temperament tests and very important things to consider for the future member of your family. If the breeder boasts about certain accomplishments, don�t take his word for it. Have him prove it)

9. Why did you breed this litter? (If the answer to this is anything but �I want to keep a puppy�, run as fast as you can. Litters of puppies are hard work and expensive to produce. Serious breeders don�t breed just to have puppies. They want to continue their lines and of course want to keep a puppy to show, etc.)

10. Do you have a sales contract? Ask to see a sample. (Companion dogs should be sold on limited registration. If there is nothing in the contract about spaying and neutering, ask yourself if this is a person you want to deal with.)

11. What health warranties do you have? What is the health history of the sire and dam of the litter? What did the ancestors of the puppies die of and how long did they live? (A minimum of three years for a warranty is fair for genetic defects such as hip dysplasia and progressive retinal atrophy or PRA. Know beforehand what diseases afflict your chosen breed. Every breed has something.)

12. What happens if I can�t keep this dog? (A good breeder will take the dog back at any time, no questions asked and find another home for it. The dog is the breeder�s responsibility for the dog�s entire life. This is called a right of first refusal clause.)

13. Do you have references? Ask for names.

14. When you see the puppies, are they clean, friendly and well fed? Runny eyes or puppies that hide in the corner are indications of problems down the road such as an illness or a fear biter. Ask to see the whole litter. Don�t accept the excuse that the rest of the puppies are sold and you don�t really need to see them. It is very important that you do see them. Maybe there are problems with the other puppies that the breeder is trying to hide.

15. What are the temperaments of the parents like?

16. Are the puppies raised in the home? Socialization is important for a well-adjusted puppy. If the puppies are kept in a shed out in the backyard or a kennel run, thank the people for their time and drive away.

17. Is the breeder a member of the parent club for his breed or an affiliate club? These clubs have their own screening processes for membership. If the breeder claims to hold membership, ask for the name of the president of the club and check this out.

18. How does this person interact with the dogs? Kindly? Harshly? How do the dogs interact with him? Friendly? Fearful? Dogs have a sixth sense about people and observing a dog�s behavior serves as an important barometer.

19. Ask other people in the breed about this person. What is the reputation of the breeder? Beware of long silences or responses like, �I can�t recommend them�. If you are going to deal with this breeder, he should have a sterling reputation in the breed.

20. Lastly, what is your gut feeling about this person? Trust your instincts and people skills. Be wary of the fast talker, the one who boasts extensively. If they can�t provide proof to any claims, then they aren�t the breeder for you. You should feel comfortable with dealing with this person because you will have a long term working relationship with him.


Now it�s the breeder�s turn. The questions you are asked may be rather pointed and personal but don�t take offense. A good breeder wants to make sure you can supply a stable environment for the puppy. Breeders are sometimes leery of unmarried couples and people who rent their homes. Problems can crop up with these situations and more than likely the dog will end up going back to the breeder. Also, the breeder will ask you for references. Be wary if these things don�t happen.

The least favorite thing a breeder wants to hear is that you �just� want a pet. This implies that you are willing to sacrifice quality for a lower price. This will jeopardize your chances of buying a puppy from a good breeder. You need to dedicate yourself to finding the right puppy for you regardless of the price. Certainly a budget can be made and things have to be taken into account like feeding and vet expenses but think very carefully about what you really want. A healthy puppy that looks like the breed it is supposed to be will cost money. However, in the long run, it will also be a money saver. Vet expenses will be kept to a minimum over time. This dog will be a member of your family for years to come.

As with anything,

buying a purebred puppy is a buyer beware market.

Do your homework, take your time and be careful.





There are a few things that are great about this post and a few that are truly alarming...namely bashing the AKC but then advising to ask the breeder if they show...questioning breeding to a non champion dog or bitch a breeder owns, labeling it as only a "breeding of convenience" or that if a dog/bitch is not a champion or a pup is sold intact to "grow out" it's basically a scam...thoughts??

Well, the KING 5 news crew just left my house after a good hour of filming me & The Gang. He should have some fun footage and he told me as he was leaving that it would be on TONiGHT at 5:00!!! That's FAST! Anyway, for anyone who may be able to tune in, just wanted to let you know

I had gotten an email a couple weeks ago that a friend of ours had passed on one of Gabe's Daily Reminders to KING, KOMO, KCTS & KIRO News, telling them what a great "Human/Animal" interest story this would make. Came home the other day (the same day Gabe's story was published in our local newspaper) to find SEVEN messages on my phone...the first from KING News, and another from one of our most popular radio stations. I was interviewed live on radio this morning & then had the KING 5 news crew to entertain this afternoon (he said it sure beat doing some of the other news he'd had to cover today!)

Ha! Ha!...I bet not many people can say they've had a newspaper photographer & a TV news cameraman standing in their bathtub filming this week! My bathroom's gonna be FAMOUS!!! Tee Hee! (Hmmm...maybe I can sell tickets

Here's your dwarf. I remember you asking about dwarfism a while back. I don't know the science behind it and I'm not sure if this is hereditary dwarfism or congenital but he's 10 months and 22 lbs (half the size of his siblings). He looked pretty normal up until 2 weeks where he just wasn't growing. Had Dr Butchko check him out at the time and everything checked out normal. Sent me home with some Stat and Panakare Plus to crush in his food when weaning started.

I talked to two other breeders who had dwarfs and the descriptions seem to be very similar in that they all had large heads and were unproportionate to varying degrees. Anyhow, if Forrest was a dwarf he wouldn't know it. He doesn't let that hold him back. We wanted to wait to make sure he was OK before placing him. We're currently in the process of finding Forrest a loving pet home. My friend was supposed to send me pictures of her dwarf so if I ever get them I'll post them as well.

He's cute!!

I've seen a few dwarf's over the years and their temperaments have always been stable and very self assured. Remember the weight division was removed in the 70's..(right?)so I feel it's something that has always been a part of this breed. The dwarf gene is a known, proven fact in our breed. The ones I have seen were from breeders known at the National's winners level so it would seem nobody is immune...you just never know what is hiding
Good luck in finding him a home...I'll let you know if I hear of anything promising At 22 pounds we'd likely just keep him...he'd just get lost in the mix lol

They have to be self assured because they're always picked on. His litter mates really enjoyed tormenting him. I think through that they develop a high degree of tolerance and self assurance as well having to fend off bigger siblings.

I've seen both miniatures and dwarfs. Miniatures being well proportioned just smaller versions of the regular size. Yeah, I do believe the dwarf gene is something that exists in the breed. Aren't French Bulldogs a dwarf breed bred down from the original Bulldog? Pug blood might have been introduced at one time right? Believe me I would love to keep him. He's such a cool dog and a heck of a lot smarter and obedient than my other puppies! I just think he deserves to be in a one or only dog pet home. We are not the Brady Bunch and Noah's Arc all combined into one like you guys are . I think you just might be Super Woman to manage what you manage.

I have someone coming down this weekend to see him so we'll see how it goes. Thanks!

Ahhh, a cutie

He will make someone a fantastic pet. He looks like he is full of personality.

I had a small one in my last litter, but it was opposite from how yours developed. He was small at birth, 7 oz, still weighed 7 oz at a week of age, then started gaining. But he was always much smaller than the others. He is over a year old now, and weighs about 40 lbs. But he is a smart little boy, the owner has taken him thru several obedience classes, and he is always the "star".

some breeds are known to produce dwarfism, I know pointers are one of them because I spent allot of time researching them at one time.
This is not an uncommon thing in bulldogs, it's not common, but certaibly not unhesrd of. The features you see in this pup are pretty typical, the large head, the eyes that bulge out and sometimes look "east west" and the poor feet seem to be recurring issues (among others).
The kind of dwarfism that creates the extremes in conformation for some breeds (bassets, dachshunds, etc) is different.

National health clinics

We will be having a CHIC DNA collection as well as microchipping, Patella and Cardiac during National week.
Time, date and location TBA..

I need a rough head count by November 1. Walk ins will be allowed, but it will be helpful if we get a rough head count ahead of time.

The DNA collection is free, this is a great chance to help our Breed!! Please participate, no excuses, it takes 2 minutes and there are no fee's! Print the paperwork out now and fill it out so it's done. For those out West, don't forget the LVBC Health Clnic

Friday, October 10th, at the hotel, we will also have the CHIC DNA collections, and the cardiac and patella testing. Same discounts as what was said for the Nationals.

In addition, for those wishing to do the OFA x-rays for spine, trachea, hips and elbows, at Desert Inn Animal Hospital (Dr. Dennis Arn, our show vet), from noon till 5 pm, you can have the x-rays done at an unbeatable price.

Please, remember, it is for the Best Interest of our Bulldogs. And, with all the dog related legislation going on, we need to show that as concerned and reputable breeders, we stand out from pet shops, BYB and the interent.
