2 girls and 1 boy, full brother/sisters to Ch. Brookhollow Benchmark and the little girl I have been showing who got both of her majors before 11 months old.

What's wrong with the "new" AB1634? Why should you care?

Because, first and foremost, it establishes Mandatory Spay Neuter as an acceptable punishment for AC infractions. It makes MSN an acceptable, state-sanctioned response to late being late in LICENSING.

I would again zero in on Democratic Senators. We just need six. If you can use a letterhead of a regional or statewide or national club do it. You might type in a letter head and start off; "As a member of the---------------------Club, I am writing you to opposed AB 1634 as yet again, amended.

Some suggested writing points:

We remain opposed to AB 1634 as yet again amended. AB 1634 as amended not only imposes mandatory spay and neuter of intact dogs and cats, it now imposes mandatory micro-chipping of intact dogs and cats. Mr. Levine has amended AB 1634 at least 11 times. With each amendment AB 1634 gets more and more convoluted, more confusing and more penalizing.

There are in excess of 100,000 intact dogs in California, the vast majority owned by conscientious owners, exhibitors and trainers. It is overly harsh to penalize these law abiding, tax paying citizens only because they own an intact dog. There are very specific and important reasons these dogs are left intact. Most dog breeding programs go back 20 or 30 years. California dog breeders in fact, breed the best animals in the world. AB 1634 makes law breakers out of thousands of your constituents for no logical reason. Mandatory spay and neuter has been proven to not work.

AB 1634 punishes the elderly and poor living on fixed incomes. Many elderly cannot afford exorbitant spay and neuter surgery, nor can they now afford micro-chipping procedures. The new 14 day time limit for MSN is absolutely outrageous. There are no low cost spay and neuter clinics that can meet those deadlines.

Under MSN, more dogs and cats are surrendered to shelters to be killed. The California Department of Finance's own report agreed with this assessment. Under the newly amended AB 1634, adding mandatory micro chipping will exacerbate and hugely increase the costs to the state for Hayden Act animal shelter reimbursements.

Over the past thirty years, animal shelter populations of dogs has gone down over 75%. Animal shelter populations for cats has diminished 90%. This has been done through improved shelter management, adoptions, low cost spay and neuter and education. Unfortunately, a small radical element of AB 1634 supporters are not content with this success. They are pushing this penalizing agenda to eliminate dogs and cats from our society.

Mr. Levine's licensing fee reduction for MSN and Mandatory Micro-chipping is a sham. It doesn't set a ceiling. It allows local government to yet again raise licensing fees that would cover any bogus reduction.

It is a shame that during this difficult budget year, Mr. Lloyd Levine continues to embarrass this legislative body with legislation that will only end up punishing thousands of law abiding taxpayers of California.

if you truly want to save animals in our shelters senator, please vote No on AB 1634.

This has been the craziest couple of days. Aly is sleeping off the pain meds. I was reminded again that her younger brother (he is 6) really does love her and has compassion for others, and I can actually make it through an emergency without crying (I did once they wheeled her off to surgery).

Thanks for your well wishes. As for the anniversary... it can wait. I think the most important thing there is that we are still married (and if I were married to me, I am not so sure that would be true LOL).

AB1634 may be a completely new bill again by tomorrow....

I think it is safe to say that the legislatures have heard the outcry over AB1634 and Loyd Levine is backing off the whole AR wet-dream "complaint" issue.

But if the new amendments are true, and I'll post it once it is official, it is still a suck piece of legislation.

But let me stress again, if the changes are true, it is because YOU, the dog fancy along with thousands of hunters, S&R folks. ranchers, etc... have acted, THANK YOU.

We are not done however. AB1634 in it's new incarnation would be very bad for pets in California, it will drive up impounds and euthanasias and that is both inhumane and bad for all responsible pet owners/breeders as WE will get the blame NOT the dumbass law, so be ready to holler some more!

Here’s previous information. If you’re a California resident and haven’t called or faxed your state Senator, please take the time to do so now.

Contrary to the claims of its sponsors (and counter-intuitive to many), forced-spay neuter laws increase shelter populations and shelter killing, as people give up their pets rather than pay fines, and then get another pet, but not from the shelters that they now see as “the bad guy” after animal control took their pet.

Instead of pushing a policy that doesn’t work, community-based no-kill solutions bring pet-lovers together to put and keep pets in homes, and to help bring spay-neuter and other services where people need them, at a price they can afford. This is the direction we need to take to bringing shelter populations down, not sound-bite, sound-good legislation with disastrous unintended consequences for people and pets

Levine is hoping to invalidate YOUR letters by adding stupid ****. USE BILL"S ADDENDUM TO YOUR LETTER. It's at the end of his comments

I suggest you hammer on the point that ANY increased scheme of fines and penalties is going to backfire into more pets hitting the shelters.

More impoundments mean more money the state will be charged via the Hayden act

That you cannot amend this bill to negate that issue

That it is a VIGILANTE bill. It invites neighbors to fabricate excuses to turn each other in if there is strife between them. Or disgruntled co-workers, or disgruntled lovers, the list goes on

If mandatory microchipping comes into play, you cannot prevent owners of chipped dogs from surrendering them if faced with MSN. Thousands of impounded pets are tracked back to an owner each year who promptly tells the shelter to keep the dog

that the bill will never be able to affect positively the issue of unowned feral cats. the bulk of cats in shelters. On the other hand it will make it more likely that people will opt out of doing pro bono work with ferals for fear of reprisal.

That it jeopardizes all police, drug sniffing, search and rescue, assistance dog breeding programs in the state

It jeopardizes thousands of financially important canine events in the state

It jeopardizes the multi-billion dollar Ca. Cattle and sheep industries

PetPAC just learned Mr. Lloyd Levine, you remember him, don't you? Well, Mr Levine has decided to amend AB 1634 yet again. Whats this, the eleventh? I've lost count.

While we don't know what exactly the amendments will say, we do know he is desperately trying to answer the Dept. of Finance opposition. So, look for this:

The first complaint will be $100. The second will be mandatory microchipping (surprise!)
The third, well no secret there, its MSN!!
The third may or will require an animal services officer to substantiate the complaint.

However, we're not sure what else he may have up his sleeve. We also don't know when the amendments go in. I would bet on an Alice in Wonderland rabbit event; "I'm late, I'm late for a very important date!".

On the bright side, Floor Analysis agrees the amendments open the way for more letters.
So, I would heartily suggest any of you who want to be counted. to get in your cards and letters ASAP this weekend. You might insert this in your letters: "We ask that our opposition not be withdrawn except by written request:." Thank you American Belgian Tervuren Club."

Every democrat that can, will leave California and get to Denver. No business will be conducted on the Senate or Assembly floor.

This means, AB 1634 has to be passed out of the Senate by the week of 18th - 22nd, so it can go to the Assembly, then to the Gov.
Aug. 31, 2008 Last day for any bill to be passed (Art. IV, Sec. 10(c)), (J.R. 61(b)(17)). Final Recess begins upon adjournment (J.R.51(b)(3)).

Ok, The Dems return for session on the 29th Friday??They can call sessions for Sat the 30th too. But things end at 1201 am on the 31st.
The Republican National Convention starts Sept 1st - 4th, and they will be itching to get out by the 30th, so that could throw a monkey wrench into the last day of session.

Now then, with no budget???? the Gov promises to not sign any bills.
Sep. 30, 2008 Last day for Governor to sign or veto bills passed by the Legislature before Sept. 1 and in the Governor's possession on or after Sept. 1 (Art. IV, Sec. 10(b)(2)).

Just had to share a "Progress Report" & brag for those of you who've been rooting for The Gabester in the Worldwide Fido contest.
If you do a search for the contest on Google, this is what comes up at the top of the page...

Currently Gabe has almost 49,000 views & his next nearest competitor has just over 21,000. (Of course these don't all count as votes...
but the fact that they have Gabe listed as the special highlight on their "Top Dogs" page speaks for itself!
Keep up the grrreat work, GabesteRooters!!!

Voting continues through the end of this month--THEN--the voting for the Semi-Finalists will go through September
(our most crucial time to be voting--this determines not only which dog in each category gets the trip to Hollywood,
but also contributes 40% of their score towards the Ultimate Winner!) The live awards TV show will be the first week in October.

Remember: One-A-Day gets GABE to LA!!!...and be sure to PASS iT oN to your friends, co-workers, etc.
