I was wondering what would have to happen if you are an F-1 student and want to marry an american? Would you have to re-apply for a visa or if you just did it would it be fraud?

Generally, simply marrying a US citizen will not result in the BCIS (Bureau of Citizenship and Immigration Services – the new name of the INS) finding that you committed visa fraud unless, for example, you entered the US with an F-1 visa intending to marry.

If, on the other hand, you entered as a student and later married, there should not be a fraud problem. Once married, presuming you have proof of your legal entry, you would then be eligible to apply for adjustment of status through your local BCIS office.

For an individualized assessment of your case, please feel free to contact my office to arrange for a consultation.
