H1-B and 240 day rule

Hi,

I'm on a H1-B visa for company A due to expire very shortly and company A has just gone out of business. I found another job which started on a part-time basis with company B. Company B filed I-129 and received a receipt notice dated 27th October 2003.

The I-129 for company B is still pending. Does the 240 day rule apply to this case? Can I legally stay in the US beyond the date on my I-94 card whilst waiting for a decision on the I-129?

Under the H-1B portability provisions, you can work for company B while awaiting adjudication of your new I-129.
