I am a Colombian Citizen who has been working in the USA on a J1 visa for almost 3 years. My girl friend lives in the USA and we would like to marry. Is it possible for me to marry and stay in the USA and apply for residency?
I do not know if a Colombian citizen can be exempted from the two year home residency. If so, does it mean I can remain in the USA after my 3 years and will the fact that I have married a US citizen while on a J1 visa change my status?

Many thanks for your advice
Julius

If you are subject to the 2-year home residency requirement and marry a US citizen, you must first obtain a waiver (i.e., an exemption) before being able to apply for permanent residency. If your waiver application is approved, you of course will be able to remain in the US.
