J-1 Visa and 2-year Foreign Residency Requirement

To determine if you will be subject to the 2-year foreign residency requirement, first check with your sponsoring organization (i.e, the organization that issues your DS-2019).

Three categories of J-1 visas generally are subject to the home residency requirement:

(1) if your J-1 program is financed in whole or in part by the US government or your own government;
(2) if the purpose of your training in the US is to acquire skills and knowledge that appear on the US Department of State's "skills list" (i.e., skills that are needed in your home country);
(3) if you are coming to the US to pursue graduate medical education.

If your situation is still unclear after consulting with your sponsoring organization, be sure to speak to an immigration attorney to more fully assess your case.
