Hi,

I'm a french citizen, actually in the US under the waiver program and i'm getting married soon with an american resident.
I won't probably be able to marry her before my 90 days on the american soil will expire, so there come my questions:

1- Can i apply for any status so i am legally able to get a job since im married to an american resident (not citizen yet)?

2- Will i be on the deportation procedure if i stay here to get married after the 90 days expire?

3- Do i have to go back to my country to "re-charge" the waiver program's 90 days or can i simply move to canada/mexico or bahamas/dominican republic for a few days or weeks to re enter the american territory with another 90 days?

4- Will i be eligible for the green card or residence or citizenship when my spouse will get her american citizenship in a few mouths?

I know its a few questions but i tried to be as clear as i can, i thank you a lot for help in advance.

Greg.

Options after marrying a permanent resident

Your marrying a permanent resident won’t allow you to stay in the US, extend your status, or apply for a work permit. It actually could make it more difficult for you to spend time in the US.

Although after your marriage your wife can begin the process to sponsor you for a green card, it will take many, many years for you to actually get a green card. Once she becomes a US citizen, however, the process will be much quicker.

In the interim, you’ll have to find another way to remain legally in the US. Travelling back and forth across the border isn’t a long-term solution.

If you would like to fully discuss your options with me, please contact my office to arrange for a consultation (either in person or by telephone).
