Transferring H1-B

Hello,

I have a H1-B visa but I am considering changing job. Is it
a problem to tranfer H1-B with the new legislation? I read
on your web site that H1-B cap will not apply in my case
but is there any delay to expect?
Another question is the following; can I travel freely or do
I need to get a new stamp on my passport (going back to
the US embassy in Paris that delivered my H1-B). My
stamp has a reference to my current employer.

Thank you in advance.

You’re correct – you’re not subject to the H-1B cap and can indeed change employers (referred to as “portability”) without having to wait until October 1. If you meet the portability requirements, while the new petition is pending you can travel with your old visa and form I-797A receipt notice for the new petition.

If you’d like to further discuss your case or would like me to prepare your new H-1B petition, please contact my office.
