H1-B Stamping

Hello,

First of all, thanks a lot M. Weiner for this amazing forum.

I'm french and living in US, I was under a J-1 and now my status is H1B1 (i got the I-797).

My case is that i will have my interview at the American Consular in Paris in December to get my passport stamp. I found some informations about the required documentation (Form I-797- Ds 156....) but nothing is clear. Can you list exactly what we need and specially what they called "other documentation to show proof of binding ties to my country")

My second question is: is it the same as the J-1, if the interview is going well i will receive my visa within 2 to 3 days.

Applying for an H-1B Visa at the Embassy

Thanks for your message – I’m glad that you find the forum helpful.

If an attorney submitted the H-1B petition, he/she should be prepared to help you now with your visa application at the embassy. In fact, even if you prepare the application yourself, you should have the attorney review it to make sure that it is complete and accurate (in order to avoid any delays at the interview).

As described on the embassy Internet site, there are a couple of different forms to complete and you should also provide an updated job letter showing that you still have a valid job offer. As an H-1B visa is a dual intent visa (meaning, unlike most other temporary visas, you DON’T have to have an intent to return to France at the end of it), you don’t have to show proof of ties with France.

As for visa issuance, you should get it shortly after the interview.
