when to get married

Hello Mr Weiner, first of all thank you so much for providing a forum like this!

I am German and am here in the US on a Visa-Waiver living with my boyfriend who is a US Citizen. I got here two months ago and we thought that we should get married just before the 90 days are over but now we were told that it makes more sense to get married straight after overstaying the Visa-Waiver because of the possible fraud. Would you agree? Is there any danger there at all?
Is that also the quickest way to get me a work permit?
Is it true that I will not be able to leave the country until all the paperwork is through (like nine months or so?)?
It all seemed very odd to me since so many people seem to get married while on their visa-waiver. But I guess you never hear afterwards if they got in trouble.

Getting married after entering the US on the Visa Waiver Program (VWP) is not necessarily always as easy as it looks. The USCIS could determine that you entered the country fraudulently (i.e., that you traveled as a visitor when you in fact intended to marry and remain in the US).

Before submitting any application, I would strongly advise you to speak to an attorney who can examine the particulars of your case to determine the best route to follow and if any danger lies ahead.
