Dear Mr Weiner

Can you help me out? This is the point. I'm on a tourist visa. I'm here for six months. I'll be returning in October. My fiancee is a resident. she filed for naturalization and this should be done before the end of the year. Is it true that I can marry as a tourist after 90 days in the USA? If I marry after six months just before leaving, is it a visa fraud? Will my fiancee face any problem with the USCIS on the day of her her interview?

Thank you so much.

Gaetan

As you probably know, marrying your fiancée while she still only has her green card will not give you any immigration status and in fact could make it much more difficult for you to travel to the US for extended periods. You may actually want to wait until she becomes a US citizen before marrying.

If you’d like to further discuss your case with me, please contact my office directly to arrange for a consultation.
