If someone were married, and got a divorce, but the divorce doesn't go through for a year, and I want that person to come to the U.S. for a year while waiting for the divorce, what is the best way to do this? I'm an American citizen wanting this person to come to the U.S. After that year we could get the fiance visa couldn't we? Thanks for any help you can give me in this really odd situation...

Apply for a Work Visa

There is no particular visa for the situation that you’ve described, so the person needs to fit into one of the pre-existing visa categories. The best option generally would be to apply for a work visa, depending, of course, on the person’s background and qualifications.

If you’d like to further discuss your case with me, please contact my office directly to arrange for a consultation.
