I'm F1 now but after a year of study, I didn't make good in grades. So I am no longer accepted in my program. I lost my teaching assistantship. Next fall I can't be in school. I can't go home either because I am broke. An american friend of mine says he is willing to hire me on H2B. Is that move possible? As of now, I am applying for teaching job in high school/college. I have ssn and drivers license. do you think it would help me find a temporary job? My visa ends on 2009. I am in bad shape now because of the credit card to clear. However, if I can work for a year things will be Ok and I can hire you to help me out it my status. What advise can you give?

Because you’re no longer in school, you cannot change your status in the US. Although your friend can indeed submit an H-2B application on your behalf, if it’s approved, you’d then have to return to your home country to get a visa, and it’s at that stage that things could become complicated. Because the H-2B visa requires you to show your intent to return home at the end of your visa, the fact that you’ve fallen out of F-1 status could result in the embassy rejecting your visa.

If you’d like to further discuss your case with me, please contact my office directly to arrange for a consultation.
