Overstay

I have a friend that has been in the USA since Feb 2002, his I-94 expired on Feb 2003. His actual visa expires in the begining of 2006. I would like to know is there any way for him to be "legal" in the USA without him being worried?

Overstay & Out of Status

Even though your friend’s visa doesn’t expire until 2006, he has been out of status since February 2003. Without knowing the details of his situation, it’s impossible to speculate what his options may be to get back into status, but realistically speaking, his options are probably very limited.

If he hasn’t done so already, he should speak to an immigration attorney for a full assessment of his case. If he’d like to further discuss his case with me, please have him contact my office directly to arrange for a consultation.

One final point... if he now leaves the country, he won’t be able to return for 10 years.
