dear sir,

I want to ask something about religious visa. is there any chance for me to get a relief in my situation coz i've been overstaying my status for 2 yrs after i get my extension here in NY i left the organization and find a job. I consulted a noted immigration lawyer in california he said he can able to apply me to the dept of labor so they can process me thru Perm if there is an employer who make an advertisement in the newspaper for the said job and then they can process me to get labor certification. what do u think of this situtation.

If you are currently out of status, you’ll need to be eligible to apply for permanent residency under Section 245(i) if you want to apply for a green card based on a job offer.

dear sir,

thanx for the reply. I heard this so called section 245(i) is a kind of relief given on year 2000 for those people who enter legally but overstayed it. i dont know if im qualified for it coz i get my visa in year 2000 and i come to united state in january 2000. by the way what is the specialty for R-1 visa? i've been in the religious vocation for the last 18 yrs to be exactly.I want to know if there's any difficulty getting the permanent resi-
dence ? and also can u tell how much can i able to pay for the lawyer for this. many thanx to you sir.

Section 245(i) & Green Card Application

In order to take advantage of Section 245(i), you must:

1) be the beneficiary of a labor certification or other petition for permanent residency (i.e., a green card) filed on or before April 30, 2001 – qualifying petitions include I-140, I-130, I-360, and I-526 petitions, and
2) have been physically present in the US on December 21, 2000
