"Looking for a helping hand..."

I have applied for and recieved notice of reciept of immigrant petion for relative fiance or orphan aka I-130. I am over 21 married and a Canadian citizen being sponsered by my father a Unioted States citizen. However it should be stated that I can not apply for a son/daughter of United states citizen born abroad as he was only recently inducted as an American citizen. My questions are: Having grown up largely in the United States of America including graduating high school, holding a valid drivers license, a bank account, etc. and possessing a SSN, Is this whole process neccesary? Can I simply move? How can I get a visa for my wife who is not as of yet canadian (israel citzen/ Canadian permanent residence) providing I can simply go out there. If not, Is there any way to speed up the I - 130 application process? Providing that neither of the options above are feasible, What forms would I fill out to request a work permit and does my wife have to be a candian citizen to apply for a work permit?

Any response is greatly appreciated.

PS. Can a canadian resident (not yet citizen) apply for any of the above?

Mr. C.

In order to live and work in the US you need to have work authorization, either a temporary work visa (such as a TN visa, an H-1B visa, etc.) or a green card. The fact that you grew up in the US does not allow you to simply return.

As the married spouse of a US citizen, you are in the 3rd Preference Category for family-based green card applications, and you should expect to wait around 7 to 8 years from time the I-130 petition was filed before receiving your green card.

For more background information, be sure to visit the Visa Information Page of our website at http://www.immigration-aux-usa.com/visas_US.html. There you’ll find information both about the different types of temporary work visas as well as an explanation of the timeframe for getting a green card.

If you’d like to then discuss your case with me to personally explore all of your options, please contact my office to arrange for a telephone consultation.
