I-864 QUESTION

Hello,
I am filing for a k-1 visa, I live in France and I will be marrying a US citizen.
I duly received package number one from the US Embassy requesting a I-864.
My fiancee did not file any Federal tax returns for 2006, 2005 and 2004 because his income is below poverty level.
How do we explain that in our I-864 form and will we be in trouble?
We have a co-sponsor (my fiance's brother) who filed for Federal tax returns for the last 3 years and whose income is well above poverty levels.
Do you think we have a chance to have our visa granted?

As long as you have a qualified joint sponsor, there should be no problem.
