H1B Renewal Process

Hi,

I am holding H1B Visa and will be expiring on sep 2008. This is my first renewal. My father is coming on GreenCard in feb 2008.

Now, my questions.

1. Should I File for GreenCard or go for renewal of my H1B.

2. On what basis i should put GreenCard filled on my fathers basis or on my employer basis... which way is faster and reliable?

3. How much cost i need to bare for H1B renewal and Greencard Processing.

4. How much time require for H1B renewal and How much time require for converting from H1B to GreenCard status.

5. I am planning to go india for marriage in Nov 2008, so do i go for marriage before Greencard process or renewal. And how early my wife can be here on H4 visa after marriage.

6. If i want work permit for my wife wht should I do?

Good Morning,

I am H1B Visa holder and my H1B getting expires on Sep 2008, I have landed in USA on Sep 2007. This is my first renewal.

My father will be coming on GreenCard on Feb 2008, so i would like to know whether i should go for renewal of my H1B, or should start process for GC with my employer or on my fathers base and how whichever requires less time.

Also I am planning to go for marriage in nov 2008, so how what should i do in this situation.

If you were not a derivative beneficiary on the I-130 / I-140 petition that forms the basis of your father’s Immigrant Visa, you now have no option but to renew your H-1B status. If you apply for a green card through your employer, unless you qualify for EB-1 classification, there’s no way that you’ll receive green card status before September.
