Hi,

I am an American citizen, living in Australia. My wife, an Australian citizen, and I married in Hawaii in 2003 while she was on the Visa Waiver system.
We want to move back to the U.S. in June 2008 to help look after my aging parents.
What is the best way to proceed as we may want to take up residence there depending on my parents health situation?
Thanks for you help.

You and your wife have 2 possible options. If you plan to immigrate permanently to the US, as her husband you can naturally sponsor her for a green card based on your marriage. In Australia, that process will probably take at least 3 to 6 months.

Depending on your long-term plans, another, quicker option would be to apply for an E-3 work visa. An E-3 visa requires your wife to have the equivalent of a bachelor’s degree and a qualifying job offer with a US employer.

If you’d like to discuss your case with me, please feel free to contact my office to schedule a telephone consultation.
