A judge has declared a mistrial in the decade-old case of slain funk musician Louis McCall.

Superior Court Judge Gregory Adams stopped the trial of Marques Clair on Wednesday, "based on an omission" in information, said Jada Hudspeth, a spokeswoman for the district attorney's office.

Attorneys in the case were not immediately available Thursday to discuss the judge's decision. Hudspeth said District Attorney Gwen Keyes Fleming and her staff will evaluate the evidence in the case before deciding whether to retry Clair.

Clair, now 29, was arrested as a suspect in McCall's slaying in 1999, but prosecutors dropped the charge. He was finally indicted last year.

McCall was shot to death at the Village Square Apartments near Stone Mountain on June 25, 1997. He was the co-founder and drummer for Con Funk Shun, which recorded hits including "Ffun, Ffun, Ffun" and "Shake and Dance With Me" in the 1970s and 1980s
