NYC lunacy...minor update

i just clipped this from the APG ezine newsletter...

MORE NYC "IMITATION GUN" FALLOUT. Staten Island Paintball Center was
cited earlier this month for selling an "imitation firearm," which
was a paintball marker that happened to be black. "Legal" colors of
paintball markers are red, yellow, and purple. Also cited in this
recent wave of idiocity: The Sports Authority for selling a black
Spyder TL Plus and Tippmann markers. The Department of Consumer
Affairs has subpoenaed numerous companies for lists of stores in the
area that may sell paintball markers. These companies include: Kingman
International, Tippmann Pneumatics, and National Paintball Supply.
Fines are being used to enforce the city policy against the sale of
"imitation" firearms, and more stores are expected to be bullied by
the DCA in weeks to come.<end>

i hate think what else they think of as "toys".....ugh,,,
btw..apparently its perfectly okay to buy a purple paintball gun in NYC..so lets see, the black ones are horrible , dangerous intimidating, and violent..but a purple one is just ducky, and the DCA (dept of consumer affairs) says "colors" are okay.. paintball is just a new source of income for them, but the scarry part is apparently they have to power to define. or redefine the law (or think they do anyhow) , as ref by the "toy " thing..maybe ill decide my car is a "toy" and therefore i dont need insurance or a lisence to drive it...but oh, i need a NYC appointment to a dept of whatever first...then i can do what i want...
okay, rant over..what do you all think?

Hey Mav,

This is lunacy. For once I actually think the politicians are being more childish than the children.

Don't try to do that "toy" thing with your car if it is black! I heard NYC will allow you to declare your car a "toy", but not if it is black!

these people are really . there is a federal law protecting paintball guns because it is considered a firearm there is more info at pbreview.com i think that is were i first heard it

the way i understand it,that law exempts paintball guns from being considered "imitation" firearms, as well as exempts them from being toys. however, its just a base line for states to follow. so in reality, a specific state can draft their laws to be stricter, but not more relaxed (ie-a state cant classify a paintball gun as being a lethal firearm, but they can classify it as being "dangerous." so this is where it gets fuzzy. the federal classification is probably unenforceable, its not like a marshal is going to swoop down and slap the mayor of NYC in the back of the head anbd say "you cant do that!!" everything rests on the courts interpretation of the federal standards/laws. its sort of like window tint, the gov. says its okay to have 18% tint ( i think) yet many states allow much darker , and some dont allow it all making even cars just rolling out of the dealership technically illegal.
So the question now is, how much of a defence will sports auth and others be willing to put up , will they band together and provide mutual defence, or will they just settle to save a few bucks and pay the fines ??
this is why we as paintballers need to let our manufactures know , that in thias case, we support them fully and are willing to go to bat for them...because next week itll be the purple guns, and after that anything that works off compressed gas, ect...and other municpalities will soon follow (if NYC is making money off this, why cant we??)
