To compete in 2008 Mclaren had to submit there 2008 car to the FIA for inspection; however, that meeting was cancled due to Mclaren's own internal investigation findings: Their new car is an a lot like a Ferrari, and is said to may have been inspired by the confidential information gathered by McLaren. Several key changes were made to the 2008 Mclaren that seem to have been taken from Ferrari: to include but not limited to a change in wheel base, Quick Shift, Quick fill, braking system(s), tire pressure gas, and other possible Ferrari developed systems and stratigies.
At this point McLaren doesn't have a car to submit to the FIA for inspection to be allowed to compete in the 2008 season.
In additon, Ferrari is seeking criminal and civil charges against McLaren... since they publicly announced their new car is much like a Ferrari they probably don't have much chance at those cases either.
McLaren are re-engineering the car inline with the WMSC findings. Fia and WMSC have closed their files on the matter and to quote Max M "drawn a line under the matter'.
Ferrari's legal processes are against Stepney himself and Coughlan. AFAIK and checking the web heavily not against McLaren.
McLaren will be on the grid and in the constructors championship on current information.

last night and watched the DVDs of the 75 through 77 seasons. I really miss the real characters in the sport. I grew up watching Hunt, Andretti, Regazzoni, Lauda and Watson. Just not the same sport any more. When the 1.5 litre Turbos went finally and Giles died I'm afraid the heart went out of the sport. The death of Senna was the final death nell for true F1, what we get now is just a travesty of the 'real' sport.

...a tremendous opportunity to see Michael Schumacher and Ayrton Senna duke it out through the mid 90's with Senna's death. I believe that the rivalry between the two (Schumacher and Senna) would have topped anything in the modern era of F1. Senna was always the "younger" upstart, it would have been great to see him as the established champion against a new "younger" upstart in Schumacher.
The family of Ayrton Senna and the entire F1 world lost something special on 1-May-94 at the Tamburello curve...
