But other examples come to mind. For instance, a shop owner (non Indian) purchases authenic goods and then puts them up for sale. I am thinking of a "tile" I purchased in a chain cafe/gas station, this tile came with a copy of the artist's blue card, all nicely put in a gift type box. At this rate, the blue card could even belong to someone else!

At some point, common sense has to kick in. Powwow venders often buy/trade goods with other vendors for resell or special orders.

The powwow I am involved in does require Indian authenication of each vendor, right on the application information. We do not require food vendors to be Indian only, only the artist/shop vendors.

The law might say something other than I think, but it seems the proof should rest with the artist, cause who can track the craft after it's sold?
