Ok I am with you on this for everyone else who does not understand. At the beginning of the movie if you read the newspaper clippings, Malcolms mother had abandoned him at a motel, this is why, (in his head) all the personalities are at a motel. NONE of the 10 people are real, and no, they are not people that he killed to go to jail, they are all personalities in his head. Yes he was a killer but again read the newspaper clippings at the beginning of the movie it tells you that he killed those people in the apartment complex and that is why he is in jail.
