tomos targa trans sluggish

I have a 2000 tomos targa with a35 engine and 2500 miles showing. The transmission does not shift well. I only recently bought this and don't know that much about it. I checked the fluid and it looks overfilled,. It comes out the hole in the side when i go to check it and looks crappy. The bike really lags in first gear and I have to let off to shift to second. I hope changing the fluid will help out. What type should i use. Does anyone have any helpful tips????How long do these tomos transmissions last???
