HMV... screwed over!

I bought the new Kisaki Project CD as a pre-order back in March with HMV after inquiring if they carried it. They e-mailed me back that they did, and I paid, the total cost coming out to 42 dollars and some odd cents. April 28 was the release date, and HMV e-mailed me with my tracking, that I checked the 29- to see that Fed-EX had marked it as delivered. My mail is going to my friend's house currently, so I asked her if it had come - and she said no.

Fast forward to May 12, we still have NO package. Apparently, from what I can tell, HMV gave me overnight service and didn't make anyone sign for the package, just putting it somewhere for us to find it. I didn't even ask for overnight, if it is possible, so I e-mailed them again, and they informed me basically it is in Fed-Ex's hand right now, and it was apparently shipping. This bothers me right off the bat because CD Japan always makes me sign, and won't leave the package on my front doorstep. I understand if it was 2-4 weeks and they left it there, but this was apparently overnighted...

What should I do, from here? Obviously, they're going to lose a customer if they don't refund me or send another CD, (which I doubt they'll do either..) but has anyone else ever had this problem???
