I ended up going to my bank and filed a complaint of dispute with them listening to what Go suggested. They agreed it is on HMV not fed ex - so they're going to chase HMV and get my money back now. I'm not dealing with HMV anymore, but I'm slowly pulling from the scene anyway, so it isn't a huge deal. Thanks rin.
