Bob Spoos' research about the short distance between the Beiderbecke and Goddard houses and and the close associations between Bix and the two young men make it likely that they could reliably identify him, despite what Whitehorn has said.

The significant question before the grand jury had to be whether Sarah Ivens could definitely identify a man inside an unlighted garage on a cloudy, rainy day. Given her young age and poor eyesight, it seems unlikely that a positive identification could have been obtained from her had the case gone to trial, and as we know, it didn't.
