The quest must be active (unsolved) by the person landing the killing blow. AND it has to be active in that game (meaning, game creator hasn't completed it yet).
This can be sometimes very annoying if you lose your "uberdrop" because someone else lands the final blow in the game. But this simply can't be helped at times. Only way to ensure that drop is to play the act bosses solo.
Of course with this system it's basically possible for you to kill diablo without even getting the quest done if the person who made the game has already completed the quest. Why would anyone specifically want to though, that I don't know heh.
