What's the evidence to arrest Anwar?

July 17 2008 at 12:02 AM

How can the police arrest Anwar Ibrahim at its whim and fancy?

This isn't even a routine "detained for questioning" thing. This was an outright arrest by court order.

Are they now compiling "evidence" that they don't have in the first place?

How come a man accused of sexual assault is arrested while the DPM Najib tun Razak and his wife who are accused of having knowledge of the Altantuya murder are not even detained for questioning?

How can we sit by and just watch this without doing anything?

Why the hell were the police wearing ski masks to arrest him?

July 17 2008, 1:13 PM

Parti Keadilan Rakyat vice-president Azmin Ali told reporters:

Azmin said the prime minister listened to some concerns raised by him with regard to Anwar's arrest and the way he was treated by the police.

"The PM listened to my views and guaranteed that the black eye incident would not be repeated."

Asked about the concerns he had raised, Azmin said it was about the high-handedness of the police in arresting Anwar.

"Why was he arrested before the 2pm deadline? There were commandos wearing masks. Of course, we are concerned after what happened to him in 1998."

Anwar in the dark over police report on sodomy

Anwar lashes out at cops (Update 4)
By SHAHANAAZ HABIB and AUDREY EDWARDS

KUALA LUMPUR: Datuk Seri Anwar Ibrahim lashed out at the police saying that to date they have not given him a copy of the police report of the sodomy allegation made by Mohd Saiful Bukhari Azlan.

He questioned why despite repeated requests the police report was being kept from him and his lawyers.

Datuk Seri Anwar Ibrahim arriving at his home in Bukit Segambut on Thursday morning after being released on police bail.

"Is it so that they can keep amending and amending and amending it to fit in with the statement that I have just given to the police. I gave my statement for five hours yesterday (Wednesday) and for another 30 minutes this morning.

"If they give the report to me now, how am I supposed to know that it is the original? Are they waiting to make up the 'perfect' police report (to fix me)," he said, adding that each time he asked the police for a copy of the report, he was told they had been instructed against giving him a copy.

"Who gave the instruction? The Deputy Prime Minister or his wife? The IGP or AG?" he asked.

He said there has never been a case where a suspect did not know exactly what he was being accused of or denied access to the police report made by the accuser.

Anwar who was released on police bail Thursday morning after being held overnight at the KL police headquarters lock-up, told a press conference, that as a whole the police treated him well and "did not touch him."

But he complained that he had been put in lock-up meant for hardcore criminals overnight and forced to sleep on a cold cement floor.

"It is known that I have a severe back problem and I had a major back surgery before. Lying on the cold cement floor has exacerbated the pain. It was only at 1am when Azizah (wife, Datuk Seri Wan Azizah Wan Ismail) brought me a towel that I could put the towel on the floor and lie on it," he said.

He said the pain in his back was so severe that Thursday morning when he was released, his family doctor had to inject him with a strong dosage of pain killer to ease the pain.

"I don't deserve this. No Malaysian deserves this. Why treat me like a major criminal and public enemy? Short of torture, what else do you call it, " he said.

Anwar also disclosed that during his medical examination that he was made to undergo at the KL Hospital, he was stripped naked, had his whole body was examined including his private parts measured.

"Of course I refused to be photographed because it would be on (video sharing portal) YouTube very soon! For a man of my age, it's not a compliment!" he quipped, to much laughter.

Anwar said he did not agree to having a blood sample taken because he did not trust the system and feared that the police would fabricate evidence against him using his DNA as he alleged they had done 10 years ago for a similar crime.

He said while he trusted the doctors and their professionalism, they could not guarantee the safety of the sample once it was handed over to the police.

He cited the 1998 sodomy case where the police found his samples on a mattress to implicate him and when the court found the evidence inadmissible, Justice S. Augustine Paul merely expunged that part, amended the charges and let the case proceed instead of throwing the case out.

He also pointed out that in the present case, Mohd Saiful was still under police protection "making any fabrication possible" if they obtained his DNA.

In any case, he said, the police already had his DNA sample of 10 years ago which they forcibly obtained from KLH.

On whether he would allow for an international forensic team to test the sample, Anwar said, the burden of proof was with the accuser.

Anwar said anybody could cast aspersions against others, and just because he (Anwar) happened to be on a different side of the government, this was used as a "national programme" against him with any compelling evidence.

"I am prepared to be investigated but not to be intimidated," he said, adding that if there was "compelling evidence one, two, three and four which needs an international expert," then he would be willing to submit.

Anwar said he was confident if the case was professionally handled and transparent, it would have been closed by now for lack of evidence.

Anwar also "advised" the Prime Minister to conduct the case professionally.

He said some of those involved like the AG Tan Sri Gani Patail and the IGP Tan Sri Musa Hassan had a personal vendetta against him as they were involved in the 1998 case against him.

"I went through hell in the 1998 case. They should not use this as a personal vendetta against me," he said, adding that both Musa and Gani should have nothing to do with the case.

He also took to task Federal CID director commissioner Datuk Mohd Bakri Zinin for telling Malaysians a "blatant lie" by saying that they had the reason to believe that Anwar was not going to show up at the police headquarters at 2pm on Wednesday as promised.

"I gave my commitment that I would come. My lawyer had just spoken to DSP Jude Pereira at 12.45pm and assured him that I would show up on time," he said, adding that he was ambushed 5 minutes after that call.

Anwar said he was going home for a quick lunch after which he planned to proceed to the police headquarters.

Speaking to reporters after the press conference, Anwar’s lawyer Sankara Nair said Anwar’s bail expires on Aug 18 when he will have to report to the police. He added that Anwar will only give a DNA sample if ordered by a court.

At another press conference, at Bukit Aman, the IGP said police are looking at the possibility of getting a court order to compel Anwar to give his DNA sample.

On Thursday morning, Anwar was released on police bail after having his statement recorded the night before, the Deputy IGP Tan Sri Ismail Omar said.

He was safely back at his home in Bukit Segambut in Kuala Lumpur by 10.05am.

Anwar's statement was taken down to facilitate police investigations into the report lodged on June 28 by his 23-year-old former aide Mohd Saiful Bukhari Azlan alleging he had been sodomised by the PKR de facto leader.

"He was arrested yesterday (Wednesday) as he was a suspect, and his arrest was made in accordance with the law," Ismail said.

"Police followed every procedure and had even informed him and his lawyers that the warrant for his arrest had been obtained.

"He was treated fairly and according to due process of the law, which included allowing his wife (Datuk Seri Dr Wan Azizah Wan Ismail) to visit him at about midnight," he added.

Ismail said police would continue with their investigations.

He also appealed to the public not to speculate and to allow the police to investigate this case as they would any other case.

At a press conference at about 10am, Anwar's lawyers R. Sivarasa and Sankara said that no charges had been levied on the former deputy prime minister at this time.

He will have to report to the Kuala Lumpur police headquarters on Aug 18 however.

They said that Anwar refused to give a DNA sample on Wednesday night because they feared there would be fabrication of evidence, which Anwar had alleged had taken place in the infamous "black eye" incident of nearly a decade ago.

At that time, Anwar was alleged to have committed sodomy too.

He lodged a police report against IGP Musa and A-G Gani, who were the investigating officer and chief prosecutor respectively in that case

Thankfully he hasn't. We still need him and the opposition for our parliament. From what we can surmise, UMNO just wants to prevent him from forming a new government (Having by elections and converting the MP's are ways he can do that).

Is Anwar guilty?

July 22 2008, 3:59 PM

Is Anwar guilty? My answer below.

Are you still unsure? Your heart will tell you.
And you got to decide. Can we remain neutral & be silent?

"If you are neutral in situations of injustice, you have chosen the side of the oppressor. If an elephant has its foot on the tail of a mouse and you say that you are neutral, the mouse will not appreciate your neutrality." (Desmond Tutu)

Why I believe Anwar is not guilty
K Bing | Jul 18, 08 6:00pm (extracted from Malaysiakini)
First of all, I must say that I do not possess any information which is not already public knowledge. However, I have been following news of the new sodomy allegation against Anwar closely and I'm analysing this from the perspective of 'reasonable behaviour' and 'balance of probability.' Here are the reasons why I think Anwar is not guilty.
MCPX
1. Is Anwar gay? A person who has fathered six children has established his sexual orientation firmly. Bisexuality is very rare and in any case he does not fit the mould. He has a loving family and his wife is standing steadfastly by him which says a lot.
2. The highly controversial sodomy conviction of 1998 failed to convince most people. A person in a position of power who allegedly cannot control himself to even keep away from his wife's driver, must have a string of partners. One must ask, why has nobody else come out of the woodwork? Why was it necessary to coerce false confessions from two of his associates?
3. A person on the cusp of attaining political power would not be so stupid as to risk everything. If indeed one assumes that he cannot control his urge, where are the others that he may have violated or other consensual partners? With multiple partners, it's a secret which is almost impossible to keep for a public figure.
4. Anwar's anger and outrage at the new allegation is exactly how a wronged person will react. His body language when he speaks of the issue is consistent with his words.
5. When news broke of the police report against him, Anwar took refuge at the Turkish embassy. I believe he did so as he feared immediate arrest and not so much a threat on his life. This shows that Anwar believes there is a conspiracy against him rather than a private complaint which would not warrant immediate arrest. A guilty person would immediately assume it's a private complaint.
6. Saiful's resignation e-mail to Anwar did not suggest he had been sodomised and traumatised by his boss. This e-mail has not been denied by him.
7. The notion that a 61-year-old man can force himself on a 23-year-old youth is unthinkable. If threats were used, what can Anwar possibly threaten him with as he is not in a position of power?
Is there a conspiracy against Anwar? I believe there is for the following reasons.
1. The accuser, Saiful was obviously closely connected with Umno and has been photographed with a few Umno leaders including an aide to the deputy prime minister.
2. Saiful is obviously pro-Umno as had been revealed by his online postings. Why then did he induct himself into PKR as a volunteer if not for some ulterior motive?
3. His visit to the DPM's office a few months before the incident was explained as him having gone there to apply for a scholarship. This is a very awkward explanation. As a college dropout, Saiful was not in the market for a scholarship and in any case, the DPM's office is the wrong department to go.
And why would a scholarship applicant have his photograph taken with a senior aide? One must ask, why is it necessary to obfuscate and conceal the real purpose of his visit?
4. Najib at first denied he had ever met Saiful and later admitted that he met Saiful at his residence when a traumatised and sodomised Saiful came to ask for his advice. Why did Najib first deny and then admit later when under pressure? Was he trying to conceal something?
5. Najib said he listened to Saiful's story and told him it's up to him whether he wants to lodge a police report or not. This is not credible. Wouldn't Najib have jumped at the opportunity to discredit his political nemesis and insist that Saiful make a police report?
It is wrong for anybody - much less a minister - who has been told a crime not to bring it to the attention of the law enforcement agencies. Why is Najib giving unbelievable explanations? Is he trying to divert all thoughts away from a conspiracy and overdoing it?
6. Najib said that Saiful visited him a few days before he made his police report. The report was made on Saturday and the sodomy was alleged to have occurred on Thursday. This means Saiful could only have visited Najib on Friday, one day before he made his report.
This is stretching the definition of 'a few days' to breaking point. Establishing when the meeting actually took place will shed light on the veracity of the allegation.
7. How easy is it for an ordinary person to drop in and see the DPM at his residence or office on such short notice? If he has been sexually violated, there is no need to hawk his allegation to politicians first before going to the police.
8. Saiful's smiling and confident demeanor when he emerged a few days after his police report certainly does not indicate a man who has been sodomised and traumatised.
9.. Saiful's public challenge to Anwar to swear his innocence on the Quran is unbecoming of a real victim who would be expected to feel depressed and keep a low profile rather than play politics.
To round it up, let me deal with some objections.
1. It is too outrageous to imagine that Umno would weave a sodomy conspiracy against Anwar again as nobody would believe it?
Do you think negative public opinion will stop them?
Umno controls the AG's chambers, the police, the judiciary all of which are sufficient to convict a man of trumped-up charges. For good measure, they also control the mainstream press.
2. The allegations will increase sympathy for Anwar so a conspiracy is unlikely.
On the contrary, it could well discredit Anwar. The tactic could backfire but it is not beyond politicians to miscalculate the effects of their action.
3. Anwar stands to gain the most from it so Anwar must have planned all this.
Isn't this even more outrageous than the above? No need to waste words on this.
4. Why sodomy again? Isn't the script 10 years old?
What else can they pin on Anwar? He is not outwardly corrupt. A legal conviction is the most efficient way to get Anwar out of the political scene for good. After serving the sentence, he will have to wait another five years before running for public office by which time he may be too old to have any political ambition.
5. It is too transparent as Saiful has been photographed with high-level Umno politicians.
The plot may have been hatched after all those photographs. We have to be realistic, there are not many candidates who would do this.
6. Why did PKR take in a person without background checks?
He volunteered at a time when PKR was desperately short of staff. Once in, a person is not easily dislodged even when his previous pro-Umno leaning is known. There's always the notion of fair play and judging a person by his work rather than his past.
In conclusion, when events really happen, details automatically fall into place. When there's nothing to hide, explanations do not create more questions. A person's demeanour and facial expression is a reflection of his inner thoughts.
All the bits and pieces collected together can create a complete picture.
The picture is not complete but it is complete enough for me to decide that on the balance of probabilities, the incident never happened and Anwar is again facing another political conspiracy.

Rehashed Plot!

July 22 2008, 6:09 PM

Is there such a thing as old DNA?

How stupid are the police? They can't even release the police report for fear of putting in the wrong details of the time of the alleged crime!

They made a fatal mistake this time around and unlike 10 years ago, we have the power of the internet at our disposal!

My friends were intrigued by Anwar's sodomy charges. Again.

July 23 2008, 11:34 AM

While they knew it was too obvious an entrapment case, it was enough to lure them to find out more about it in Malaysia Kini.

Err...something wrong with the site eh?
They can't log in lah.

Anyway, I've asked everyone what they think of the case
and they all laughed...so obvious right? Maybe the first time yes, because Anwar was at the height of his power
and was probably careless. Definitely not the second time.
No one is stupid enough to repeat the same mistake 'twice'
in his own backyard.

Kalau gatal pun, never heard of Thailand ah? Or Singapore? Ha ha ha...

The only thing that makes this whole incident not that hilarious is the fact that the government rehashed the script...twice.

Why?

We know there are gays and dykes in the cabinet, but they are all safe as long as they 'support' the 'right' people.

But not Anwar.

He crossed them already and they tried to use everything they know against him. I mean, all people in public office are being watched all the time, even when they don't know it. You wouldn't believe the number of dossiers in the secret vaults!

Secret information is power. And that heightens the probability that Anwar is bisexual.

I think (this is only my guess ah) the only reason Anwar isn't a victim of C4 by now is the fact that he possesses something of value that ahem...Badawi and Najib want.

And we know what they are.

And that he is backed by some powerful forces waiting for a reason to bulldoze their way here!

DNA tests can be faked - Anwar be careful

Faking DNA evidence: Case Study

Dr. John Schneeberger (born 1961) is a former Canadian physician, who drugged and raped one of his female patients and his stepdaughter. For years, he was able to evade arrest by planting a fake DNA sample inside his own body, thus successfully foiling DNA tests.

On the night of 31 October 1992, Schneeberger sedated his 23-year-old patient, Candice, and raped her. While Versed — the anesthetic he used — has strong amnesiac effect, Candice was still able to remember the rape. She reported the crime to the police.

Scheenburger's blood sample was, however, found not to match the samples of the alleged rapist's semen, thus clearing him of suspicion. In 1993, at the victim's request, the test was repeated, but the result was negative, as well. In 1994, the case was closed.

Candice, still convinced that her reminiscences were true, hired Larry O'Brien, a private detective, to investigate the case. He broke into Schneeberger's car and obtained another DNA sample, which, this time, matched the semen on victim's panties and pants. As a result, third official test was organized. The obtained blood sample was, however, found to be too small and of too poor quality to be useful for analysis.

In 1997, Lisa Schneeberger found out that her husband had repeatedly drugged and raped her 15-year-old daughter from her first marriage. She reported him to the police, which ordered fourth DNA test. This time, multiple samples were taken: blood, mouth swab, and hair follicle. All three matched the rapist's semen.

During his 1999 trial, Schneeberger revealed the method he used to foil the DNA tests. He implanted a 15 cm Penrose drain filled with another man's blood and anticoagulants in his arm. During tests, he tricked the laboratory technician to obtain blood sample from the place the tube was planted.

He was found guilty of sexual assault, of administering a noxious substance, and of obstruction of justice, and received a six-year prison sentence.

(Source: From Wikipedia)

The value of DNA evidence has to be seen in light of recent cases where criminals planted fake DNA samples at crime scenes. In the case above, Dr John Schneeberger planted fake DNA evidence in his own body: Dr. Schneeberger raped his sedated patients and left semen on her underwear. Police drew Schneeberger's blood and compared its DNA against the crime scene semen DNA on three occasions, never showing a match. It turned out that he had surgically inserted a Penrose drain into his arm and filled it with foreign blood and anticoagulants.

A Penrose drain is a surgical device placed in a wound to drain fluid. It consists of a soft rubber tube placed in a wound area to prevent the build up of fluid.

A Penrose drain removes fluid from a wound area. Frequently it is put in place by a surgeon after a procedure is complete to prevent the area from accumulating fluid, such as blood, which could serve as a medium for bacteria to grow in.

An anticoagulant is a substance that prevents coagulation; that is, it stops blood from clotting. A group of pharmaceuticals called anticoagulants can be used in vivo as a medication for thrombotic disorders.

Anticoagulants are given to people to stop thrombosis (blood clotting inappropriately in the blood vessels).

As long as the tests are conducted by people, there's always a margin for fraud.

Factors such as motives and stakes come into play.

Think of 'sisters' as the type of women who cannot tolerate women, so you can imagine why they won't get into bed together. Unless they're drunk. And drugged. And bound and gagged.

Saiful and the first 'victim' are more like sissy sisters.

Anwar is more than his sexuality. If you want to help fight injustice, help think of ways the Opposition can do to get out of their predicament. If you want to support Barisan, help think of ways they can rectify their mistakes and make Malaysia a better place. Okay? Thanks!

When you were in power, you didn't do away with all the ISA and oppressive policies, fight corruption and money politics. You were an education minister, a finance minister, a deputy minister, an acting prime minister.
You had a lot of power then. And what did you do?
Remember all your remarks? You think we don't know you also 'made' your money like the rest of them?

Yes, that's all in the past. We can forgive.
It's the future we're concerned about.
You can't screw it up. That'll be unforgivable.

Anwar was part of the system that created the problems we have today. It is God's will that he be punished like this.
There're lessons to be learnt. When he becomes our next PM, we will know how much he has learnt. Don't think God isn't watching Badawi and Najib. Better make amends before it's too late.

Drop The Case

Anwar: Drop the case (Update 3)

PETALING JAYA: PKR adviser Datuk Seri Anwar Ibrahim claimed that the medical report leaked on Monday confirmed that the sodomy allegations against him were baseless and were politically-motivated.

He urged the police to stop their investigation and to send the medical report to the Attorney-General’s Chambers and classify the case under “no further action.”

The medical report from Hospital Pusrawi, signed by Dr Mohamed Osman Abdul Hamid at 2.14pm on June 28, was leaked on the Internet on Monday.

The report said that there was no medical indication that Mohd Saiful Bukhari Azlan, Anwar’s 23-year-old former aide, had been sodomised.

In the report, Dr Mohamed Osman had also recommended that Mohd Saiful go to a government hospital for further check-up.

In KUALA LUMPUR, Home Minister Datuk Seri Syed Hamid Albar said that the case won't be dropped based just on the medical report.

"This is just one aspect of the investigation. The police are piecing together evidence, let them do their job and complete their investigation," he said.

"As it is, they haven't charged Anwar with anything yet," he noted.

Raja Petra Kamaruddin, editor of news portal Malaysia Today which first carried the medical report, also claimed that Dr Mohamed Osman had gone into hiding because the police wanted him to change his medical report to implicate Anwar.

The police have denied that allegation.

“We interviewed the doctor in the early stages of our investigations following the police report lodged by Mohd Saiful,” said Deputy Inspector-General of Police Tan Sri Ismail Omar.

“But we did not arrest the doctor or detain him for three days as alleged by the Malaysia Today report. We don’t have any plans to do so either,” he said.

In GOPENG, (PKR) vice-president Dr Lee Boon Chye went one step further and said the police should act against Mohd Saiful for lodging a false police report against Anwar.

Speaking at the opening of the Gopeng PKR service centre here on Tuesday morning, the Gopeng MP said Inspector-General of Police Tan Sri Musa Hassan should stop all investigations into the sodomy claim against the Opposition de facto leader.

Based on the medical report, "Saiful should be arrested for lodging a false report against Anwar and the IGP should also stop all investigations into the claim," Dr Lee added.

Govt won't ask police to drop probe, says Syed Hamid
By SHAHANAAZ HABIB

KUALA LUMPUR: The Government will not ask the police to drop its investigations into the Datuk Seri Anwar Ibrahim sodomy case just because a medical report said the complainant had not been sodomised, said Datuk Seri Syed Hamid Albar.

The Home Minister said the medical report from Hospital Pusrawi was “just one piece of evidence in a whole chain of evidences” at which the police were looking.

“There is not even a charge preferred on him (Anwar) yet, so what are we to drop? We have to let the police complete their investigations, submit their investigating papers to the prosecutor and let the prosecutor decide if there is a case,” he told reporters Tuesday.

He said he was not surprised that Anwar had “gone to town” with the report, declaring himself innocent, as he (Anwar) was adept at playing political games.

Denying the Government was framing Anwar on allegations of sodomy, Syed Hamid said:

”It would be very irrational for the Government to create a case of this nature, at this time, against such a person.”

He said the police were taking so long to complete investigations as they had to be “meticulous and look at every aspect”.

“You should not blame the police for being very cautious and careful because this involves such a famous personality, especially since he (Anwar) is treated differently from ordinary mortals,” he added.

Last month, one of Anwar’s political volunteers, Mohd Saiful Bukhari Azlan lodged a police report that Anwar had sodomised him.

However, a medical report from Hospital Pusrawi made just hours before the police report was made ruled out that Saiful had been sodomised as there was “zero tear and scar”, “zero active bleeding” and zero ulcer or pus in his anus.

The medical report was put on an online news portal, following which Anwar called a press conference Tuesday and asked the police to drop its investigations as this proved he was being framed.

Syed Hamid said it was unethical for the medical report to be leaked, as this constituted a breach of trust between the doctor and patient, and urged the medical fraternity to look into this.

He also denied the police was concealing this piece of evidence, adding that they were in no position to disclose the contents of any report. Syed Hamid said, for the Government, the earlier the investigation was completed and the earlier a decision was made one way or another, the better it would be

Why Anwar's Arrest Matters for Liberty and Justice

July 30 2008, 3:04 PM

Anwar Ibrahim's arrest, and the other events today related to it are a ridiculous mockery of our country's institutions and traditions. On Merdeka day, Tunku Abdul Rahman proclaimed us an independent nation "founded upon the principles of liberty and justice". Where is liberty? Where is justice?

I do not intend to deal with some of the crazy notions floating around about Anwar's guilt or innocence. Whether he is guilty or innocent is immaterial. Under our laws, under the laws of any civilised nation, under the principles all peoples and nations have agreed upon in the Universal Declaration of Human Rights, a man is innocent until proven guilty. Anwar has not been proven guilty; we can speculate about his potential guilt, but until this is actually proven he must be treated as an innocent man, one as free and righteous as you and me.

The simple fact is that Anwar has not been accorded the rights he deserves as a free citizen of Malaysia. We freely criticise the Americans for their inhumane treatment of prisoners in places like Guantanamo, but the way we handle our political prisoners is barely much better. The Americans will not furnish defendants with the facts of the charges against them; neither has the government here made the police report against him available to Anwar. How can a man defend himself when he does not what he is defending himself against?

Then there is the issue of intimidation. Anwar told the Police he would cooperate, even though there is no way he can prepare himself in advance for questioning when he does not even know the specifics of the allegations against him. In spite of this, officers showed up at his home and refused to leave, insisting on serving him with an order to appear before the Police and make his statement.

Anwar is of course not too happy; he refuses to show up at the appointed time, delaying his appointment to today. Call him an ass, a douchebag, a prick, whatever you like — he is a free man, and until you subpoena him or otherwise legally compel him to give his statement, you have no right to tell him what to do. Was it wise to do this? Probably not. But was it wise for the Police to intimidate a fellow willing to cooperate, in spite of their refusal to tell him what he is accused of?

The Police are of course not happy that Anwar has blown them off, and a judge grants them a warrant for Anwar's arrest if he does not show up at the police station by 2PM. So Anwar agrees to attend, of course. He heads off to an interview with the Anti-Corruption Agency, then goes home for a quick lunch at 1PM. Maybe he could have made it to the police station on time; former Anwar staff Nat Tan seems to think so. But maybe he couldn't. The only thing that matters is that Anwar shows up by 2PM.

Until the appointed hour is past, tough luck if the Police want to question him. They agreed to meet with Anwar at 2PM; the warrant was for if he did not show up at the appointed time to give his statement. There is no justification for arresting Anwar a full hour before he was due to give his statement; the Deputy Home Minister may say that such a small difference does not matter, but in that case, why couldn't the Police have waited an hour to arrest Anwar if he did not appear on time?

To Members of Parliament like Mukhriz Mahathir and Khairy Jamaluddin, this does not matter; Anwar is an ex-convict, and we can at best assume he falls somewhere in the grey area between innocent and guilty. Never mind if we violate the rights of a free Malaysian, it does not matter. Let the Police do what they want; that is justice taking its course.

What we are conveniently forgetting here is that Anwar is not guilty of sodomy; in the eyes of the law, he has never sodomised anyone before. When the courts overturned Anwar's conviction for sodomy, they erased it from his record. Yes, the judges said they personally believed Anwar was guilty. But more importantly, they stated that there is reasonable doubt; it is perfectly and equally reasonable to look at the evidence and conclude that Anwar never sodomised anyone.

Even more importantly, whether Anwar did sodomise anybody before does not matter. I might go to jail for robbing a bank; if someone else robs a bank and points the finger at me, you have no right to presume I am guilty. Anwar was not charged with buggering Saiful Bukhari Azlan; he was charged with and convicted of sodomising his driver and step-brother. He has never been convicted of sodomising Saiful, and as he has been cleared of sodomising anyone else, we have no right to assume he is at guilt now.

Maybe you don't like how the criminal justice system is supposed to work. Tough luck. A lot of us don't like how "justice" works in this country. With all the allegations flying around, how can you have confidence in our institutions?

I wish I could be as optimistic as various politicians from both sides of the partisan divide, and say we can leave it to the Police and the courts. But we can't, and we all know why. It is a known fact that the government has undue influence over the judiciary, and that the Police force is among the most corruption-ridden of our institutions.

After all, this is the same Police force with officers who will take RM2 bribes, in coins, from teenagers who commit traffic offenses. This is the same Police force which will not submit itself to the review of an independent commission on misconduct, because if the Police know someone is watching them for abuse of power, they will be demoralised and can't work effectively. What does this say about their morals, their work ethic, their professionalism?

The government may have promised to restore judicial independence, but until the actual amendments to the Constitution are passed by Parliament, this is just another empty promise. The past year has seen shocking revelations and allegations from politicians like Anwar, judges like Ian Chin — and lest we forget, it has also seen damning evidence in video form, evidence so strong that it prompted a Royal Commission to suggest a former Prime Minister and eminent judges be investigated and possibly even charged for the perversion of justice.

Let's not even talk about due process and equality before the law. How can we talk about this if our institutions blatantly disregard the notions of justice and the rule of law? How can we have regard for these principles if the Police cannot even wait an hour to bring Anwar in, if they cannot even give him the accusations against him? What due process or equality under the law can there be if the institutions we trust to protect these values have no regard for them?

So we have a rigged justice system — do we go out and riot? Vigilante justice is dangerous; it is the reason we have laws and a justice system in the first place. Revolutionary sentiment is all well and good, but it is far better if we give our country's traitors the fair trial they never gave the innocent men and women who suffered under them. The important thing at this point in time is to pressure our government and our justice system to do the right thing, to defend the principles our country was founded upon, and give every citizen, including Anwar Ibrahim, the rights and freedoms we are entitled to as citizens of Malaysia and as human beings.

Activism is not just about marching in the streets or arguing with authority figures, though these are important aspects of it. Activism is about spreading the spirit of citizenship and the spirit of liberty. Activism is telling your friends why what is going on is wrong. Activism is expressing support for citizens who are oppressed and see their basic freedoms denied, be they prominent people like Anwar Ibrahim and Raja Petra Kamarudin, or nobodies like ISA detainee Shahrial Sirin, who could not even hold his daughter one last time before her last breath because the government has detained him without even charging him for any crime for seven years. Activism is being a good citizen. Activism is patriotism.

We cannot sit by and tolerate injustice; that is the height of treason, betraying the very principles our country has committed itself to. We all have the right to liberty and justice; these are the principles our country was founded upon. When our institutions meant to protect liberty and justice fail, it is our patriotic duty to make it known that we cannot tolerate this, that we cannot sit idly as our country founders. The government must give Anwar a fair trial; it must give him the rights and freedoms he expects as a blemishless citizen of this country. If the government will not respect the liberty of a potential Prime Minister, whose rights will it protect? Yours? Mine? Liberty and justice are what our country supposedly stands for; are they too much to actually ask for?

If Anwar comes to power

August 3 2008, 8:21 PM

If Anwar comes to power...
T Rozario | Aug 1, 08 4:19pm
The police have come out with a statement that everyone in PKR is trying to confuse the issue of Anwar Ibrahim's alleged sodomy case.

But the public look at the police as the people who are trying to confuse them in this case. The police have not been consistent in the handling of many issues.

I, for one, feel that if you were to conduct an independent poll, you'll find that most Malaysians find that Anwar's case is related to the Altantuya case, to the possibility of him becoming prime minister in mid-September, and to the state of the current federal government.

This case against Anwar has become a brazen attempt by the government in cohorts with the police to fix up Anwar for fear that he will unseat them from their ivory towers and give all Malaysians a victory against tyranny, injustice and police brutality.

It is the fear of being called to account that has forced this government to attempt to lock Anwar up.

If he comes to power the corrupt judiciary will be called to account, if he come to power the corrupt police force will be called to account, if he comes to power the attorney-general and members of his chambers will be called to account.

Those in the attorney-general’s chambers and the police force have to understand that if they keep quiet and carry out illegal orders, they become accessories to the crime and are criminal in their actions.

Senior ministers past and present will also be called to account, including even the prime minister, his son-in law and the rest of the jing-bang.

One person who is extremely worried is Tun Dr Mahathir Mohammed, the former prime minister and the architect of this current state of affairs in the country. His son who is in parliament is saying all kinds of things to try and justify or cover up his father’s wrongdoings.

What is being sought now is the truth and any professional will know that in the quest for the truth, no stone must be left unturned lest innocent men be found guilty of crimes they have not committed.

PM, please answer my daughter's question

August 3 2008, 8:23 PM

Mr PM, please answer my daughter
True Malaysian | Aug 1, 08 4:05pm
Dear Mr Prime Minister, I keep writing letters to you but you never seem to respond to them. Please sir, you are where you are because the rakyat chose you to represent them, so please respond and clarify our doubts.

My daughter asked me a simple question yesterday that I couldn’t answer. She asked, ‘Why did the PM put Anwar in jail?’ Immediately, a whole bunch of responses came to my mind but as I was about to answer, I realised she asked me why the PM put Anwar in jail and not the police.
