The Virginia Tech shootings have brought out the extremists
in the debate over the right to keep and bear arms.

For example, while admitting that the Second Amendment
guarantees the right of an individual to own guns, a legal
affairs analyst recently recommended that because it
guarantees such a right it should be repealed.

“The Second Amendment is one of the clearest statements of
right in the Constitution,” said Benjamin Wittes, a guest
scholar at the center-left Brookings Institution, in a
discussion held on June 11. “We’ve had decades of sort of
intellectual gymnastics to try to make those words not mean
what they say.”

Wittes, who said he has “no particular enthusiasm for the
idea of a gun culture,” said that rather than try to limit
gun ownership through regulation that potentially violates
the Second Amendment, opponents of gun ownership should set
their sights on repealing the amendment altogether.

“Rather than debating the meaning of the Second Amendment, I
think the appropriate debate is whether we want a Second
Amendment,” Wittes said. He conceded, however, that the
political likelihood of getting the amendment repealed is
“pretty limited.”

According to CNSNews.com and other media outlets, Wittes
said the Second Amendment guarantee of the right to bear
arms meant more when it was crafted more than 200 years ago
than it does to day. Modern society is “much more
ambivalent than they (the Founders) were about whether gun
ownership really is fundamental to liberty,” he said.

But challenging the Second Amendment on the basis that
society’s circumstances have changed since the drafting
would similarly open up to question all other constitutional
rights, according to Georgetown University law professor
Randy Barnett, who also participated in the same policy
discussion.

“The techniques that are used to show that the Second
Amendment really doesn’t have any contemporary relevance are
absolutely available to anybody who wants to show that
aspects of the First Amendment and the Fourth Amendment and
the Fifth Amendment have no contemporary relevance,” he
said.

Barnett said that advocates of warrantless searches could
make an “appeal to changing circumstances,” on the basis
that the Fourth Amendment is “archaic (and) we don’t need it
anymore,” he added.

But the Second Amendment isn’t the only part of the Bill of
Rights that contemporary commentators would trash. Given
the chances, they would gut the whole Bill of Rights to get
rid of the guns.

An example of this thinking comes in a late April column by
Dan Simpson of The Pittsburgh Post-Gazette.

Simpson’s approach to getting rid of the hundreds of
millions of guns in US hands is sort of a fascist’s dream
linked to the Nike slogan: ‘Just do it.”

“When people talk about doing some thing about guns in
America, one of the points that comes to the fore is, ‘How
could America disarm even if it wanted to? There are so
many guns out there,’” Simpson wrote. Then he focused on
“how” to get the job done. But before proceeding, he
offered his own gun credentials, as a youth and in his
military service days.

Then Simpson lays out his plan.

“First of all, federal or state laws would need to make it a
crime punishable by a $1,000 fine and one year in prison per
weapon to possess a firearm. The population would then be
given three months to turn in their guns, without penalty.

“Hunters would be able to deposit their hunting weapons in a
centrally located arsenal, heavily guarded, from which they
would be able to withdraw them each hunting season upon
presentation of a valid hunting license. The weapons would
be required to be redeposited at the end of the season on
pain of arrest. When hunters submitted their request for
their weapons, federal, state and local checks would be made
to establish that they had not been convicted of a violent
crime since the last time they withdrew their weapons. In
the process, arsenal staff would take at least a quick look
at each hunter to try to affirm that he was not obviously
unhinged,” Simpson continued, apparently oblivious to the
fact that anti-gun politicians such as then New York Gov.
Nelson Rockefeller had proposed a similar “arsenal” plan
back in the 1960s.

Simpson continued:

“All antique or interesting non-hunting weapons would be
required to be delivered to a local or regional museum, also
to be under strict 24-hour-a-day guard. There they would be
on display, if the owner desired, as part of an interesting
exhibit of antique American weapons, as family heirlooms
from proud wars past or as part of collections.

“Gun dealers could continue their work, selling hunting and
antique firearms. Dealers would be required to maintain
very tight inventories. Any gun sold would be delivered
immediately by the dealer to the nearest arsenal or the
museum, not to the buyer.

“The disarmament process would begin after the initial
three-month amnesty. Special squads of police would be
formed and trained to carry out the work. Then, on a random
basis to permit no advance warning, city blocks and
stretches of suburban and rural areas would be cordoned off
and searches carried out in every business, dwelling and
empty building. Thoroughness would be at the level of the
sort of search that is carried out in Crime Scene
Investigations. All firearms would be seized. The owners
of weapons found in the searches would be prosecuted:
$1,000 and one year in prison for each firearm.

“Clearly, since such sweeps could not take place all across
a city, county, state or the country at the same time, guns
would move. But fairly quickly there would begin to be
gun-swept, gun-free areas where there should be no firearms.
If there were, those carrying them would be subject to quick
confiscation and prosecution. On the streets it would be a
question of stopping and searching anyone, even Grandma
with her walker, with the same penalties for ‘carrying.’”

Let’s see: That’s Second, Third, Fourth, Fifth and Sixth
Amendments trampled in one jackbooted scheme.

When Jeanne Capozzi saw two "disreputable characters" coming
toward her on Broughton Street, she didn't hesitate to put
her hand on the .38 caliber revolver in her purse.

"The one man was watching me, and they backed off and walked
away. Maybe it was all innocent, but I felt very
uncomfortable," she said.

Whether Capozzi's fear was unfounded or she knew something
bad might have happened, she said she was more confident
with a gun in her purse.

Bob Oberst, owner of Palmetto State Shooting Center said
women are more aware of the need for personal security now
than ever. He has taught a shooting course for more than 10
years, and the number of women taking the course has
steadily increased.

"When we first started teaching the course, there were maybe
one or two women each year," Oberst said. "Now we teach the
course every month, and there are four to six women every
class, every month."

According to the National Shooting Sports Foundation, a
not-for-profit trade association for the shooting, hunting
and firearms industry formed in 1961, 23 percent, or
approximately 5 million, of all the target shooters in 2005
were women.

Oberst said he has seen more women ages 21 and older wanting
to learn how to shoot - and buy - a gun for self defense.

Capozzi, 64, of Savannah, began shooting about 10 years ago.
She met her best friend Mary Giachhini, 73 and also of
Savannah, about four years later through their husbands'
membership in the Forest City Gun Club.

Although both say they were hesitant when they first started
shooting, they have come to enjoy it.

They even call themselves the Pistol Packin' Mamas.

Capozzi began shooting because her husband wanted to spend
more time together as they were getting ready to retire and
wanted his wife to be able to defend herself.

"The police do a wonderful job, but they are not with us on
a 24-hour basis," she said.

When she began shooting, Capozzi took the Chatham County
Civilian Firearms Familiarization and Safety Course offered
by the Sheriff's Department to learn how to handle a gun
safely.

Giacchini also began shooting because her husband wanted to
spend more time with her. Plus, he thought the activity
would be good for her safety and to learn something new.

"Women shouldn't be intimidated," Giacchini said. "They
shouldn't be afraid. They can be just as good if not better
than men."

"I don't know if I would be comfortable to use it for self
defense," Giachinni said. "I would be afraid (the criminal)
would snatch it and use it on me."

Just for fun

Sarah Clemens, 43, of Okatie, S.C., shoots on a regular
basis simply because she enjoys it.

About a year ago, she began shooting with her husband to see
whether she would enjoy it or be good at it.

Clemens said her husband supported her because it was a
common interest and a way they could spend time together.

"It's very relaxing, and it helps with hand-eye
coordination," Clemens said. "Women should have that
choice. They can do anything men can do."

In March, Clemens and her husband took the eight-hour course
required to apply for a concealed carry weapons license in
South Carolina. They expect to have those permits by fall.

She agrees self defense is a good reason to learn to shoot,
but said it never crossed her mind.

"I think you should always be prepared, but I would be
devastated if I was in the position to have to shoot
someone."

A new respect

All three wives said their husbands have found a new level
of respect for them.

Shooting has become an activity they can enjoy together.
And the husbands are more confident their wives can defend
themselves, the women said.

"Practice makes perfect, and it makes me more comfortable to
know that (my wife) can shoot," Jack Capozzi said.

It opens a new avenue of gift giving, too.

"We've been married more than 40 years, and I have many
beautiful pieces of jewelry," Jeanne Capozzi said. "But
once we started shooting together, he began giving me
firearms instead. I have three guns.

"I think we need to go back to the jewelry."

To obtain a Concealed Carry Weapons, or CCW, permit

South Carolina

Palmetto State Shooting Center provides the CCW application,
an 8- to 10-hour training course and the written and
shooting tests necessary to obtain the permit. The
completed application is mailed by the applicant to the
State Law Enforcement Division. The SLED will then do a
background check on the applicant and mail the permit once
it is approved. In order to complete the application, the
applicant must provide a valid driver's license, proof of
residency in South Carolina, proof of fingerprints and a $50
fee.

Georgia

Georgia requires a completed CCW application, proof of
residency, a $24 money order and $25 cash or check.
Applicants can go to a county probate court to apply for a
CCW permit. After the items are submitted, the applicant
will complete a background check and fingerprints through
the Sheriff's department. In Chatham County, the probate
court is open 8 a.m.-3 p.m. Monday-Friday.

JUDGE MITCHELL SCHICK VIOLATES GUN LAWS

Republican Judge Mitchell K. Schick of the Coles county court house in Charleston Illinois, has illegally violated general assembly law 14.5 (a) concerning firearms; he has violated Illinois, and federal constitutional laws and his oath to protect the constitution, which is an act of treason. I have notified the FBI of this matter. Judge Shick is trying to cover this matter up, hoping it will go away. I have solid evidence (documentation) from the Coles County Court house that proves that he illegally seized my two guns without having any reason to do this illegal act. I had no criminal recorded anywhere recorded, and he gave me no trial to defend my self in court by law, he took them before I even had the chance to show up for my court date to defend myself, which is a violation of 14.5 (a) Illinois law. He ordered this action to seize my guns violating every law written to protect the common citizen. Judge Shick is working above the law, and must be accountable for his actions. I have also notified Senator Dale Righter from Illinois of this matter. I am waiting to see if he will obey the law and take proper action.

Another Judge Mitchell K Schick victim read this one: According to an order issued April 20, 2005, by the Illinois Supreme Court, Charleston, Illinois (Coles County) Fifth Circuit Judge Mitchell K. Shick, a Republican, was assigned to replace Webber in the case. “It’s like something you see on TV; Judge Webber operates outside the law, specifically §755 ILCS 5/11-5(b),” says Schneider, “and after Webber is removed his Republican colleagues make sure I am deprived of any access to the court and remain unlawfully stripped of my constitutionally protected rights to a parent child relationship

Deprivation of Rights Under Color of Law
This statute makes it a crime for any person acting under color of law, statute, ordinance, regulation, or custom to willfully deprive or cause to be deprived from any person those rights, privileges, or immunities secured or protected by the Constitution and laws of the U.S.

This law further prohibits a person acting under color of law, statute, ordinance, regulation or custom to willfully subject or cause to be subjected any person to different punishments, pains, or penalties, than those prescribed for punishment of citizens on account of such person being an alien or by reason of his/her color or race.

Acts under "color of any law" include acts not only done by federal, state, or local officials within the bounds or limits of their lawful authority, but also acts done without and beyond the bounds of their lawful authority; provided that, in order for unlawful acts of any official to be done under "color of any law," the unlawful acts must be done while such official is purporting or pretending to act in the performance of his/her official duties. This definition includes, in addition to law enforcement officials, individuals such as Mayors, Council persons, Judges, Nursing Home Proprietors, Security Guards, etc., persons who are bound by laws, statutes ordinances, or customs.

Punishment varies from a fine or imprisonment of up to one year, or both, and if bodily injury results or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire shall be fined or imprisoned up to ten years or both, and if death results, or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death.

Please if anyone else has been criminally violated by Judge Mitchell K Schick. Notified the FBI and the Illinois Judicial Inquiry Board, to file a complaint.

HB1106 - 11 - LRB095 09700 RLC 29902 b ILLINOIS GENERAL ASSEMBLY LAW 14.5(a)

1 to use firearms illegally against the petitioner, and the
2 respondent is present in court, or has failed to appear

15 The firearm or firearms shall be returned to the respondent
16 at the end of the stated period or at expiration of the
17 order of protection, whichever is sooner.

I NEVER GOT A TRIAL TO DEFEND MYSELF IN COURT, AND JUDGE MITCHELL K SCHICK ORDERED MY TWO GUNS THAT HAD NEVER BEEN FIRED TO BE SEIZED. THIS IS A CRIMINAL ACT AGAINST EVERY LAW IN THE COUNTRY. I HAD NO POLICE RECORD noted anywere. I SERVED HONROBALLY IN THE ARMY, AIRFORCE; AND FOUGHT IN THE GULF WAR TO PROTECT OUR RIGHTS AND FREEDOMS. THIS JUDGE IS OUT OF CONTROL AND MUST BE ACCOUTABLE FOR HIS ACTION. ONE OTHER THING, SENATOR OBAMA OF ILLINOIS, IS SUPPOSE TO BE LOOKING INTO THIS CRIMINAL ACT AGAINST ME, SO THERE IS SOME HOPE TO PROTECT OUR RIGHTS AND CONSTITUTION.

PROTECT OUR RIGHTS

I know who this judge is, and I have heard he has no common sense and is a very arrogant man. Any idiot that knows anything about law, knows that you have to give a person a fair trial before you take a persons guns away from them. I would contact the NRA, if I were you; it sounds like to me that this judge Shick should review the laws of Illinois before he gets himself into more trouble.

MITCH SCHICK LOST MY VOTE

I am sick of these types of guys with power taking away our rights. I am a NRA member and a registered voter. I look at this as another example of Big Government pushing around the voting citizen. I want to know why this judge is still on the bench? It sound like to me someone isn’t doing his or her job, or he would be in some trouble for breaking the law.

How can he get away with this?

I can’t believe this kind of crime still goes on in America. Is there no one in the government that supports the Constitution anymore? Why would this happen in America, and most of all, how can this judge not get in some kind of trouble for this? This shows that our justice system is falling apart at the core and it needs to be overhauled. This is not right to let Mr. Schick keep practicing law until this has been investigated and a solution has been determined. Judges are not above the laws of the land, and anyone who has the power to do something about this and doesn’t is as guilty as the person who committed the crime.

Heres your answer About Senator Dale Righter

NO, he has done nothing to date. I have been to his office twice in the last month, and spoke to him both times in person; he says he will look into it, and let me know what he finds out. Here’s what’s up with that story. Senator Dale righters wife is a judge at the Coles County Court House In Charleston, Illinois and she is a friend with Mitchell K Schick. I also know from the Internet that Dale and his wife or x-wife have gone to dinner together, so he also knows him. I don’t think he will go after his friend, but you never know; Dale might be scared that backing Schick on this is a bad political move. I just don’t know what Dale Righter will do. I can only hope he will do the right thing and up hold the law and the constitution. I talked to the FBI on the phone yesterday and they can’t tell me much about it yet. I also joined the NRA, and sent them a letter about this crime against me by Schick, as well another letter to Senators Obamas office

Customer Kills 1, Wounds Another, Police Say

PLANTATION, Fla. -- A retired United States Marine
disrupted a robbery in progress when he shot two men who
attempted to rob a Subway sandwich shop, fatally wounding
one of them, police said.

According to Plantation police, two armed men barged into
the Subway at 1949 Pine Island Road shortly after 11 p.m.
Wednesday, demanding money from the employee behind the
counter. When they tried to force John Lovell into the
bathroom, he pulled out a gun and shot both men, police
said.

Donicio Arrindell, 22, was shot in the head and later died
at the hospital. Fredrick Gadson, 21, was shot in the chest
and ran from the Subway, but police found him in hiding in
some bushes on the property of a nearby BankAtlantic.

Lovell, 71, was the lone customer at the time. Police said
he had a concealed weapons permit.

A witness who was about to enter the Subway at the time said
he thought the shootings were justified.

"I think justice, you know, was served and a civilian was a
hero for today," Sebastian Shakespeare said.

Police said Lovell, a retired Marine, wouldn't be charged.

ANTI-GUN MAYORS’ HYPOCRISY BLASTED BY SECOND AMENDMENT FOUNDATION
BELLEVUE, WA – Several members of New York Mayor Michael Bloomberg’s anti-gun Mayors Against Illegal Guns coalition are annoyed by freedom of information requests about their activities from a California law firm, yet these same mayors have no problem demanding complete access to sensitive gun trace data.

The Second Amendment Foundation today said the mayors are practicing a double standard and are guilty of “world class hypocrisy.” SAF founder Alan Gottlieb pointed to a remark from Joseph Arellano in San Francisco Mayor Gavin Newsom’s office, who contended that the information being sought by the law firm of Trutanich Michel “is privileged.”

“That information couldn’t be anywhere near as privileged as the gun trace data kept by the Bureau of Alcohol, Tobacco, Firearms and Explosives that these anti-gun mayors want to get their hands on,” Gottlieb stated. “Mayors Against Illegal Guns has been pushing for repeal of the Tiahrt Amendment this week just so they can access that data and use it to further their anti-gun lawsuit agenda.

“This has nothing to do with crime prevention, and they know it,” he continued. “They’ve been saying the trace data is not available to law enforcement, and that’s a lie. Gun trace data is available for legitimate on-going criminal investigations. It’s just not available for politically-motivated legal fishing expeditions.”

Gottlieb said Trutanich Michel has every right to the information it is seeking, because no criminal investigations would be jeopardized if they get it. That is not the case with the mayors wanting access to gun trace data, where criminal investigations could easily be compromised.

“It is arrogant beyond words for these mayors to demand access to gun trace data, and then turn around and declare that information about their coalition’s activities is privileged,” he remarked. “The mayors claim they are working in the public interest. We think the public interest would be better served by learning about the activities of this mayors’ group – how it is financed, and whether it has misused public resources, for example.

“Bloomberg and his cronies already have a credibility problem,” Gottlieb concluded. “They shouldn’t compound things by trying to conceal their activities from public scrutiny.”

FYI, the following email was sent to Garry Breitkreuz, M.P. from an RCMP officer. He says the gun registry is more if a hindrance than help to police officers in the field:

Dear Mr. Breitkreuz:

First off, I thank you for your tireless work fighting the useless gun registry. I have the right to call it useless as I am a member of the Royal Canadian Mounted Police and have been for quite a number of years. I have seen firsthand the inaccuracies of the information in the registry while conducting numerous investigations. I also train new recruits that have graduated from Depot Division and consistently try to de-program them from making queries using CFRO checks as it gives them a false sense of security and I believe actually endangers their lives. Please continue to work to abolish the registry, and campaign to provide the police forces of this country some real tools, like a justice system that keeps violent criminals behind bars.

I ask you to please not use my name in any way when relaying this information on as I fear repercussion as the RCMP is a very political organization. With that said though, please share the body of this note with any and all that you feel need to hear.

I can speak for the majority of police officers that I have worked with over the years in saying that we do not support the registry. We support common sense, and the registry simply isn't common sense.

CCRKBA BLASTS JACKSON FOR GUN SHOP DEMAGOGUERY
BELLEVUE, WA – Rev. Jesse Jackson’s headline-grabbing protest at a suburban Chicago-area gun shop over the weekend produced further proof that Jackson and anti-gunners like him do not understand that even gun owners and retailers have civil rights, the Citizens Committee for the Right to Keep and Bear Arms said today.

Jackson and Rev. Michael Pfleger were arrested outside of Chuck’s Gun Shop in Riverdale after blocking the door so that customers of the shop could not enter. Jackson has vowed to be back this Friday for another protest. Jackson was quoted by the Chicago Tribune asserting, “I think people have the right to bear arms at a hunting reserve.”

“For a guy who built his reputation as a so-called defender of civil rights,” observed CCRKBA Chairman Alan Gottlieb, “Jackson demonstrated a remarkable ignorance on the subject. A civil right is not subject to fences, or specific activities. The right to keep and bear arms is supposed to apply everywhere, just like the voting rights for which Jackson and others fought hard to defend a generation ago.

“If Rev. Jackson truly believed in civil rights,” he said, “instead of getting himself arrested in front of Chuck’s Gun Shop, he’d be getting himself arrested on the steps of Chicago’s city hall, demanding that Mayor Richard Daley and his cronies abolish that city’s handgun ban. That ban has left good citizens at the mercy of criminals for more than 30 years, and everyone, including Jackson, knows it.

“But Jackson,” Gottlieb continued, “like every other far left political demagogue, believes that some rights, particularly the right to bear arms, are subject to politically correct whim. He would relegate a cherished civil right to the level of a privilege, proving that he doesn’t have a clue about what it is he has supposedly been fighting for over the past 40 years.

“It is not okay for Jackson to interfere with a legally-operated private business,” he concluded. “It is no more acceptable for Jackson to block the doorway of a gun shop than it is for a southern governor to block the door of a high school. Jackson has promised to return to Chuck’s Gun Shop this Friday for a prayer vigil. He ought to say a prayer for himself, and offer some repentance for the monumental hypocrisy in which he is engaged.”

Washington, June 19: Actor John Travolta has blamed psychotropic drugs
for the Virginia Tech and Columbine school shootings.





The actor insisted that if one carefully looks at the whole story, it
has not so much to do with 'gun control' but 'drugs'

"I still think that if you analyze most of the school shootings, it is not gun control. It is [psychotropic] drugs at the bottom of it," New
York Post quoted Travolta, as saying.

The 'Hairspray' actor agrees with fellow Scientologist Tom Cruise who is one of the most outspoken members of the Church of Scientology.

"I don't disagree with anything Tom says," he said.
According to Scientology there is no such thing as a chemical imbalance, and psychiatry is a form of pseudoscience.

As for what is his stand on the 'Mission Impossible' actor's clash
with co-host of NBC's 'The Today Show' Matt Lauer, Travolta insisted
that had he would have not put his point of view so aggressively.
"How would I have presented it? Maybe differently than how he did, but
it doesn't matter," he said.

In a June 2005 interview, Cruise started an argument with Lauer about psychiatry and postpartum depression and called him 'glib'.

Guns, Tears, Tragedy and Change

The Rock was patrolling the well-to-do neighborhood, which
bordered a high crime area in the major midwestern city.
The veteran policeman felt relaxed as he drove through the
beautiful tree lined streets that were home to some of the
grandest houses in the country. His relaxation ended
quickly when Dispatch cracked out a call of a possible home
invasion right around the corner. Patrolman Thomas Rakoczy
was only seconds away. He was known as the Rock because he
was as hard, strong and tough as one. He was the kind of
cop you wanted at your home if you needed serious help.

The Rock arrived at the home and began to evaluate the scene
as he walked toward the door. He entered the house and soon
found two adults and two teenage girls tied up. Other
officers also arrived and no one else was found in the
house. Rakoczy began untying the family, starting with the
man first. As he was untying him the disheveled middle-aged
man hurriedly spouted out what had happened. Four men had
broken down the front door (in broad daylight) and started
up the long staircase leading to him and his family.

He said he saw the men coming up the stairs with guns in
hand but he couldn’t do anything to stop them. So he
quickly gathered his family and locked them in the master
bedroom. He said they found them hiding there in less than
a minute.

As he continued, he started to cry and told how they all
were immediately tied up. Then they started leisurely
burglarizing the home, seemingly in no hurry whatsoever.
After they bagged-up everything they deemed worthwhile,
things really got bad.

They took turns raping both daughters in front of him and
his wife. The man was beside himself as he told what had
happened. The Rock told me the mother was so bad off she
was almost totally incoherent. She hadn’t been physically
touched, but she witnessed what happened to her daughters.

The father kept repeating that he just couldn’t do anything
to help them. Nervously he asked, “Officer, please tell me,
if I would have had a gun do you think I could have helped
my family”? Rakoczy didn’t want to render his opinion at
such an emotional time, but the man pushed him. “I want the
truth, could I have helped”? After more and more prodding,
the Rock finally told him that if he would have had a gun he
might have at least been able to scare them away by firing a
shot at them. “They may have turned or ran away instead of
trying to fight—gun-to gun” the Rock said. He also told him
that with a gun he could have made a powerful stand in the
bedroom as they were breaking down the door.

Thankfully, the four criminals were caught a few weeks later
and sentenced to around 15 years in prison. Later, the
father told Rakoczy that all through his life he was against
guns and thought they were a terrible problem in our
society. However, after what he and his family went through
and after a lot of soul searching and thought, he had
changed his mind. He said he now understood the need and
availability for the best protection available for people,
which are firearms. He eventually bought a gun, received
training and said he was ready to protect himself and others
if need be, for the rest of his life.

There are of course horror stories on the other side of the
gun controversy. Ones such as children gaining access to
unsecured firearms and accidentally injuring or killing
others or themselves. And of course there are the stories
of troubled individuals using firearms to cause mass
casualties and deaths in public places. However, there are
the very real stories of people protecting themselves with
firearms against burglars, rapists and other predators.
There’s no doubt firearms are the best self-defense tool
available for the private citizen. However, and this is a
big however, firearms come with many different levels of
serious responsibility.

The father who changed his views on firearms shows us there
is more than one side to an issue, which may change as time,
circumstances, knowledge and experiences evolve. This story
can help us understand, that all of us, no matter what are
feelings are on this controversial subject, should step back
and listen to those with differing views with dignity and
respect. All differing people have viable thoughts and
ideas and should be reasonably listened to. Whether it’s
the hugely important issue of how mentally unstable
individuals can be weeded out from owning firearms to the
many other issues people differ on. Respect and true
empathy for others views are the cornerstones to building
workable solutions for all.

Even at 69 years old, Russ Geis has enough vitality to bike
through Stark County's remote nature trails.

He said the .380-caliber handgun on his handlebars will
ensure he's doing it at 70.

Geis is among a growing number of seniors licensed to carry
a concealed firearm. Because of the way the state collects
such information, it's hard to determine exactly what
portion of concealed-carry permit holders are 60 or older.
However, some local permit data and anecdotal information
indicate they have steadily packed heat since the state's
concealed-carry law passed in 2004.

"You are out in a park, riding a bicycle trail and all of a
sudden you're confronted by a drug addict who would kill you
for $5," Geis said. "Are you going to sit there and say,
'Boy, I hope the police show up?'

"Having a concealed weapon today is more to my advantage
than it perhaps would've been when I was 30 years old."

About 12 percent of all concealed-carry licenses issued
since 2005 by the Cuyahoga County Sheriff's Office have been
to people 60 and older.

In April, 18 out of 127 concealed-carry permits -- 14
percent -- issued by the Cuyahoga Sheriff's Office were to
the elderly. It was the highest monthly total of permits
given to that age group since August 2004, when the law was
four months old.

Seniors make up 40 percent to 50 percent of students at
concealed-carry license certification classes at the Phoenix
Center in Painesville, said Mike McKenney, who runs the
12-hour courses. Some are recent victims of violent crime,
he said.

"An 87-year-old woman with a gun is equal to anybody,"
McKenney said.

A 64-year-old Lodi man preparing to teach a training class
at Stonewall Gun Shop & Firearms Range in Broadview Heights
agreed. "I've had two heart surgeries. I literally can't
run, can't fight," he said.

The man said he carries the gun whenever possible for
protection.

"I feel naked without it," he said. He lifted up his gray
polo shirt, revealing a silver revolver inside a belt
holster. He liked the gun's rounded handle because it
doesn't show through his clothes -- an appearance known as
"printing."

He didn't want his name printed because he said vandals
flattened his tires the last time his opinions on gun rights
were published.

Jeff Garvas, president of Ohioans for Concealed Carry, said
seniors should consider carrying a gun because criminals can
interpret their physical weakness as an opportunity. John
R. Lott, author of the book "More Guns, Less Crime:
Understanding Crime and Gun-Control Laws," said guns are a
safer method of self-defense for seniors because they may
run slower or have less strength.

But gun-control advocates say society is safer with fewer
armed citizens, not more. Senior citizens are no more at
risk of being attacked than any other demographic group,
said Toby Hoover, executive director of the Ohio Coalition
Against Gun Violence.

Also, despite the vulnerability older people might feel,
there is a "code" among criminals against attacking women,
children and the elderly, said Lt. Reginald Eakins, who's
in charge of the division of the Cuyahoga County Sheriff's
Office that issues concealed-carry licenses.

"I personally don't think that criminals target senior
citizens, but I do think senior citizens are better targets
-- for obvious reasons," Eakins said. "Even criminals tend
to frown on other criminals targeting the elderly."

The Cleveland area has had a spate of high-profile attacks
on seniors. Two seniors were killed in the city's Slavic
Village neighborhood in recent months, including the March
beating death of 78-year-old Joseph Krasucki.

Geis, of Stark County, isn't taking any chances. He refuses
to rely on the habits of criminals and even law enforcement
for his personal protection. He would rather count on his
gun.

"That's the last thing a criminal wants to see," he said.

Marc Thom drew his 9 mm pistol on two shotgun-wielding men who confronted him and a woman outside his MetroWest apartment early Sunday.

One of the robbers ducked when Thom pointed his weapon, which allowed him and his friend to run to a business and call police.

Thom, who has a concealed-weapons permit, is among a growing number of people in the Orlando area who are confronting rising violent crime by carrying guns.

Nearly 20,000 people in Orange County are legally carrying concealed guns, records show. The number of licenses for concealed weapons in the county has jumped 20 percent in the past year and has risen 57 percent in the past five years.

And more are on the way. The state Division of Licensing has sent out nearly a quarter-million applications for permits statewide this year, a 33 percent increase from five years ago.

"Having a concealed-weapon permit for most people is peace of mind," said Larry Anderson, who manages the Shoot Straight gun shop and firing range in Apopka. "If someone is prepared for the worst-case scenario, they're better off.

"We all have insurance for our cars for that same reason," he added.

No permit is required to carry a weapon openly in the Sunshine State, though to carry a gun on your person requires a concealed-weapon license.

As violent crime spiked across the nation, Florida in 1987 joined 34 other states in allowing residents who take a safety class and pass a background check to carry a hidden gun.

'Wicked conundrum'

Research shows that some form of resistance, including use of a weapon, does help thwart criminal attacks, said Lonn Lanza-Kaduce, who heads the criminology department at the University of Florida.

But it also increases the risk of injury or death to the victim.

"That's the wicked conundrum," Lanza-Kaduce said. "You can't have too many of these incidents before someone gets hurt."

Cops agree. When victims resist, that's often when something happens, Orlando police Sgt. Barbara Jones said.

At the same time, though, police understand that people want to defend themselves, Jones said.

"Obviously, the public is concerned about crime and they have to do what they need to," Jones said. "It's just a reaction when this happens."

Two days after Thom chased away the two armed men at MetroWest, Eaion Connor fought back another way.

Connor didn't have a weapon when a gunman tried to carjack him as he left a 7-Eleven early Tuesday on the city's south side.

So he reached for his assailant's .40-caliber handgun, which went off as he wrested it away. No one was hit, but the shot startled the gunman so much that he lost his slippers and hat as he ran off.

"That's good news," said John Harvey, owner of the Oak Ridge Gun Range in Orlando. "If you're attacked and you don't fight back, you're going to be attacked more."

Harvey said he sees 20 people in every permit class his range offers, double from a year ago.

Anderson, manager of Shoot Straight, said his two weekly classes also have about 20 people in them, a definite and steady increase since the 2001 terrorist attacks.

He was more guarded in lauding the men who fought back but also said he couldn't second-guess them.

"I don't recommend just anybody doing that, but until you're in that situation, you never know what you'll do," Anderson said.

Every attack is different.

Dick Giles, taking target practice with his grandson Wednesday morning at the Shoot Straight range, can't afford the $118 for the concealed-weapon license he wants.

A lifelong shooter, the Pine Hills man said he wants it to fight back if attacked when he is alone. He would give in only if his wife or 7-year-old grandson, Max Ortiz, were with him.

"Most of the stuff going on out there are young kids who don't want to work for a buck," Giles said. "When someone actually fights back, they run off."

Len Morris, shooting two lanes away in the range, took the opposite tack. He would defend his family but, alone, would give in.

'Last resort'

"Just because you have a weapon doesn't mean you're guaranteed of the outcome," the Orlando man said. "It's a last resort."

Before firing into a tight black bull's-eye on his target 15 yards out, Morris explained his logic.

"You have to avoid the confrontation, if possible," he said. "But with what appears to be an increase of crime in this area, it just seems prudent to be able to defend yourself."

Human beings only have two ways to deal with one
another: reason and force. If you want me to do
something for you, you have a choice of either
convincing me via argument, or force me to do
your bidding under threat of force. Every human
interaction falls into one of those two
categories, without exception. Reason or force, that's it.

In a truly moral and civilized society, people
exclusively interact through persuasion. Force
has no place as a valid method of social
interaction, and the only thing that removes
force from the menu is the personal firearm, as
paradoxical as it may sound to some.

When I carry a gun, you cannot deal with me by
force. You have to use reason and try to persuade
me, because I have a way to negate your threat or
employment of force. The gun is the only personal
weapon that puts a 100-pound woman on equal
footing with a 220-pound mugger, a 75-year old
retiree on equal footing with a 19-year old gang banger,
and a single gay guy on equal footing with a
carload of drunk guys with baseball bats. The gun
removes the disparity in physical strength, size,
or numbers between a potential attacker and a defender.

There are plenty of people who consider the gun
as the source of bad force equations. These are
the people who think that we'd be more civilized
if all guns were removed from society, because a
firearm makes it easier for a [armed] mugger to
do his job. That, of course, is only true if the
mugger's potential victims are mostly disarmed
either by choice or by legislative fiat--it has
no validity when most of a mugger's potential
marks are armed. People who argue for the banning
of arms ask for automatic rule by the young, the
strong, and the many, and that's the exact
opposite of a civilized society. A mugger, even
an armed one, can only make a successful living
in a society where the state has granted him a force monopoly.

Then there's the argument that the gun makes
confrontations lethal that otherwise would only
result in injury. This argument is fallacious in
several ways. Without guns involved,
confrontations are won by the physically superior
party inflicting overwhelming injury on the
loser. People who think that fists, bats, sticks,
or stones don't constitute lethal force watch too
much TV, where people take beatings and come out
of it with a bloody lip at worst. The fact that
the gun makes lethal force easier works solely in favor of the weaker
defender, not the stronger attacker. If both are
armed, the field is level. The gun is the only
weapon that's as lethal in the hands of an
octogenarian as it is in the hands of a weight
lifter. It simply wouldn't work as well as a
force equalizer if it wasn't both lethal and easily employable.

When I carry a gun, I don't do so because I am
looking for a fight, but because I'm looking to
be left alone. The gun at my side means that I
cannot be forced, only persuaded. I don't carry
it because I'm afraid, but because it enables me
to be unafraid. It doesn't limit the actions of
those who would interact with me through reason,
only the actions of those who would do so by
force. It removes force from the equation...and

NICS UPDATE PROPOSAL SHOULD OFFER MORE FOR GUN OWNERS, SAYS CCRKBA
BELLEVUE, WA – A proposal that would reportedly update and strengthen the National Instant Check System (NICS) may not go far enough to protect the rights of American gun owners while apparently making it easier to prevent mentally ill persons from legally buying guns at retail outlets, the Citizens Committee for the Right to Keep and Bear Arms (CCRKBA) said today.

One tenet of the contemplated “compromise” legislation, noted CCRKBA Chairman Alan Gottlieb, would reportedly allow persons whose names are in the NICS database for minor infractions that should not be disqualifiers to petition the states to have those entries removed.

“It should be up to the government to remove those persons from the NICS database automatically, at no cost to the the affected person,” Gottlieb stated. “Likewise, the Department of Veterans Affairs should be required to removed the names of some 83,000 veterans that it entered into the system seven years ago, for what the media have identified as ‘alleged mental health reasons.’ Soldiers should not have to petition or pay for that.

“More importantly,” Gottlieb added, “this proposal should fully restore the process through which citizens can get relief from disabilities (RFD) that prevent them from owning and buying firearms. Though the process remains on the books, there has been no implementing funding since 1991. People who have a mistake in their past, but have since been good citizens cannot get their rights restored. There should be a mechanism in place to allow funding of RFD investigations, even if the petitioner pays the costs himself.”

CCRKBA Public Affairs Director John Snyder also suggested that while the reported proposal offers funding to states to update their NICS data, and withholds funding from states that do not, there should be additional pressure on colleges and universities that refuse to allow legally-licensed students and instructors from carrying handguns for self-defense on campus to prevent further tragedies like the one at Virginia Tech.

“This proposal is in response to Virginia Tech,” Snyder noted, “and such tragedies might be stopped by legally armed students or professors. Schools that prohibit those citizens from defending themselves should have their federal funding withheld.”

CCRKBA will work with its contacts on Capitol Hill and in the firearms community to address these issues, Gottlieb noted.

Mike Duffy: Finally, a story in today's Toronto Star relating to the gun
registry. What's going on there?


Minister Day: I know, you know, especially Mike in light of these
tragedies that have happened, this is heartbreaking stuff for the
families. The fact is in Toronto, the City of Toronto, over the last
year, their police force have undertaken the type of measures that we
have said all along would result in reduced crime with firearms. They
have been more aggressive in terms of officers on the street, we're
assisting on the resource side in terms of going after smuggling with
guns, and getting more aggressive on the criminals. By the City of
Toronto police taking those measures, gun crime has gone down
significantly in the last year in Toronto, notwithstanding these two
recent tragic events.

We don't need police officers running around trying to ban firearms that
are owned by collectors and sport shooters. We've got to take our
precious resources and go after the criminals.

Mike Duffy: Well, Premier McGuinty says they should ban all handguns.
We've had handgun registries since the '30's and I think the Mayor of
Toronto said the same thing. The answer to their problem is ban all
handguns. What would that do?


Minister Day: It would create a diversion for police officers. They
would have to go after the thousands of innocent people who collect
firearms, who can only use handguns when they're going to a shooting
range and they have to have a permit for that. You don't take officers
who want to be going after the criminals and focus them on innocent
people. Mike, if we thought it would work we'd look at it. But in the
UK, in Ireland, in Jamaica, in other jurisdictions where they've tried
this so-called handgun ban we've seen stats go up, not down. We want to
do things that work. The City of Toronto police have done a great job
reducing gun crime by going after the criminals. That's what we want to
help them on.

Studies Say Death Penalty Deters Crime

Anti-death penalty forces have gained momentum in the past few years, with a moratorium in Illinois, court disputes over lethal injection in more than a half-dozen states and progress toward outright abolishment in New Jersey.

The steady drumbeat of DNA exonerations - pointing out flaws in the justice system - has weighed against capital punishment. The moral opposition is loud, too, echoed in Europe and the rest of the industrialized world, where all but a few countries banned executions years ago.

What gets little notice, however, is a series of academic studies over the last half-dozen years that claim to settle a once hotly debated argument - whether the death penalty acts as a deterrent to murder. The analyses say yes. They count between three and 18 lives that would be saved by the execution of each convicted killer.

The reports have horrified death penalty opponents and several scientists, who vigorously question the data and its implications.

So far, the studies have had little impact on public policy. New Jersey's commission on the death penalty this year dismissed the body of knowledge on deterrence as "inconclusive."

But the ferocious argument in academic circles could eventually spread to a wider audience, as it has in the past.

"Science does really draw a conclusion. It did. There is no question about it," said Naci Mocan, an economics professor at the University of Colorado at Denver. "The conclusion is there is a deterrent effect."

A 2003 study he co-authored, and a 2006 study that re-examined the data, found that each execution results in five fewer homicides, and commuting a death sentence means five more homicides. "The results are robust, they don't really go away," he said. "I oppose the death penalty. But my results show that the death penalty (deters) - what am I going to do, hide them?"

Statistical studies like his are among a dozen papers since 2001 that capital punishment has deterrent effects. They all explore the same basic theory - if the cost of something (be it the purchase of an apple or the act of killing someone) becomes too high, people will change their behavior (forego apples or shy from murder).

To explore the question, they look at executions and homicides, by year and by state or county, trying to tease out the impact of the death penalty on homicides by accounting for other factors, such as unemployment data and per capita income, the probabilities of arrest and conviction, and more.

Among the conclusions:

- Each execution deters an average of 18 murders, according to a 2003 nationwide study by professors at Emory University. (Other studies have estimated the deterred murders per execution at three, five and 14).

- The Illinois moratorium on executions in 2000 led to 150 additional homicides over four years following, according to a 2006 study by professors at the University of Houston.

- Speeding up executions would strengthen the deterrent effect. For every 2.75 years cut from time spent on death row, one murder would be prevented, according to a 2004 study by an Emory University professor.

In 2005, there were 16,692 cases of murder and nonnegligent manslaughter nationally. There were 60 executions.

The studies' conclusions drew a philosophical response from a well-known liberal law professor, University of Chicago's Cass Sunstein. A critic of the death penalty, in 2005 he co-authored a paper titled "Is capital punishment morally required?"

"If it's the case that executing murderers prevents the execution of innocents by murderers, then the moral evaluation is not simple," he told The Associated Press. "Abolitionists or others, like me, who are skeptical about the death penalty haven't given adequate consideration to the possibility that innocent life is saved by the death penalty."

Sunstein said that moral questions aside, the data needs more study.

Critics of the findings have been vociferous.

Some claim that the pro-deterrent studies made profound mistakes in their methodology, so their results are untrustworthy. Another critic argues that the studies wrongly count all homicides, rather than just those homicides where a conviction could bring the death penalty. And several argue that there are simply too few executions each year in the United States to make a judgment.

"We just don't have enough data to say anything," said Justin Wolfers, an economist at the Wharton School of Business who last year co-authored a sweeping critique of several studies, and said they were "flimsy" and appeared in "second-tier journals."

"This isn't left vs. right. This is a nerdy statistician saying it's too hard to tell," Wolfers said. "Within the advocacy community and legal scholars who are not as statistically adept, they will tell you it's still an open question. Among the small number of economists at leading universities whose bread and butter is statistical analysis, the argument is finished."

Several authors of the pro-deterrent reports said they welcome criticism in the interests of science, but said their work is being attacked by opponents of capital punishment for their findings, not their flaws.

"Instead of people sitting down and saying 'let's see what the data shows,' it's people sitting down and saying 'let's show this is wrong,'" said Paul Rubin, an economist and co-author of an Emory University study. "Some scientists are out seeking the truth, and some of them have a position they would like to defend."

The latest arguments replay a 1970s debate that had an impact far beyond academic circles.

Then, economist Isaac Ehrlich had also concluded that executions deterred future crimes. His 1975 report was the subject of mainstream news articles and public debate, and was cited in papers before the U.S. Supreme Court arguing for a reversal of the court's 1972 suspension of executions. (The court, in 1976, reinstated the death penalty.)

Ultimately, a panel was set up by the National Academy of Sciences which decided that Ehrlich's conclusions were flawed. But the new pro-deterrent studies haven't gotten that kind of scrutiny.

At least not yet. The academic debate, and the larger national argument about the death penalty itself - with questions about racial and economic disparities in its implementation - shows no signs of fading away.

Steven Shavell, a professor of law and economics at Harvard Law School and co-editor-in-chief of the American Law and Economics Review, said in an e-mail exchange that his journal intends to publish several articles on the statistical studies on deterrence in an upcoming issue.

Philosopher George Santayana said that those who cannot
remember the past are condemned to repeat it. It's true.
One of the reasons to study history is to avoid repeating
past mistakes. When it comes to freedom, we cannot afford
to forget the lessons of the past. So you and I need to
know the history of gun control, because history teaches us
there is a terrible price to pay when we lose our right to
keep and bear arms.

Over 200 years ago, when the Founding Fathers drafted the
Second Amendment, no one questioned the need for private gun
ownership. The Framers considered private firearms to be
essential to protecting personal liberty, both as a means of
opposing foreign threats and also as a check against
excessive government power. The Framers were passionately
devoted to the idea that a self-sufficient armed citizenry
is the best means of preserving liberty.

But many on the left do not want you to know this. They
keep the truth from being taught in public schools, and they
even write books laden with falsehoods in a dishonest
attempt to rewrite history.

Seven years ago, Emory University historian Michael
Bellesiles published a book purportedly proving there were
few guns and gun owners in early America. The book garnered
Columbia University's coveted Bancroft Prize. Two years
later, primarily due to the efforts of a brilliant young
research historian, Clayton Cramer, who had studied that
period in history extensively, the book was revealed to be a
total fraud, full of lies and fabrications. Bellesiles was
forced to resign from Emory University and, for the first
time in history, Columbia University rescinded the Bancroft
Prize.

Every American who values his or her constitutional rights
should know something about these frauds that gun control
advocates perpetrate so we can be watchful and teach the
truth to our young ones.

Early Americans were gun owners. Private firearm ownership
was widespread from the coasts to the frontier, in both the
North and the South.

Our ancestors not only knew the value of gun rights, they
actually practiced those rights. Many early Americans
provided for their family through their skill with a
firearm, and many more Americans had a gun hanging over the
hearth or in the bedroom to protect the house and the
children against wild animals or criminals. These firearms
were also seen as an insurance policy against American
Indians, the British or French, and even against our own
central government.

This honored tradition went completely unchallenged until
the 1900s. Then New York passed the Sullivan Act in 1911,
one of the first gun control laws. This law required that
firearms small enough to be concealed on a person be
registered. This state law became a test measure for future
gun control laws.

Opponents of the Second Amendment started to mobilize at the
federal level in the 1930s. It came during the New Deal,
when the federal government was growing rapidly. Two laws
enacted during this period, the National Firearms Act of
1934 and the Federal Firearms Act of 1938, established the
first federal gun controls. While most of these regulations
were uncontroversial by current standards (such as licensing
gun dealers and regulating possession of machine guns), they
introduced the concept of national regulation of firearms.

It was also during this time President Franklin Roosevelt
appointed a number of liberals to the United States Supreme
Court. Starting in 1937, the high court began moving in a
liberal direction, and by the 1960s had become a court
favoring full judicial activism, a judicial philosophy that
has threatened our Second Amendment rights ever since.

During this period, anti-Second Amendment politicians began
testing the waters on gun control. The highest-ranking
official to do this was FDR's anti-gun attorney general,
Homer Cummings. Attorney General Cummings started planning
for federal gun control measures such as a national registry
in the hands of the central government for guns and gun
owners.

But then World War II broke out, and Germany and Japan
invaded their neighbors. The American people were reminded
how important it is to have a firearm handy when you need
one. Cummings' early attempts to regulate guns and gun
owners suddenly became unpopular. Gun control advocates
lowered their voices until a more opportune time.

Most American leaders in both political parties were
pro-gun. In fact, Democratic presidents Harry Truman and
John F. Kennedy were NRA members. Gun control advocates
were always present in policy debates, but did not have much
political clout.

In the 1960s, gun control came back with a vengeance.
Modern liberalism became the dominant political philosophy
in this country. And after the deaths of JFK, Robert
Kennedy and Martin Luther King Jr., an all-out national push
for gun control was launched.

This period in the late 1960s was the beginning of
significant gun control in America. Liberal activist
judges, led by the Warren Court, enacted a widespread
liberal agenda. American society was being secularized.
President Johnson was forcing a hard-left agenda through the
Great Society. And the Vietnam War was becoming
increasingly unpopular. It was against that backdrop the
left finally launched an open, concerted effort to implement
national gun control.

And that's what we'll talk about next week, remembering that
if we ignore the lessons that history offers us, our
children will pay the price with their freedom.

a Catholic priest who during a weekend anti-gun rally threatened to "snuff
out" a Chicago gun store owner.
As Cybercast News Service reported earlier, Rev. Michael Pfleger said Saturday in
comments aimed at Chuck's Gun Shop owner John Riggio, "we're going
to find out and snuff you out."
Pfleger, pastor of St. Sabina's Church in Chicago, told the crowd "we're
going to snuff out John Riggio, we're going to snuff out legislators that are
voting ... against our gun laws and we're coming for you because we are not
going to sit idly."

FEDERAL ALCOHOL, TOBACCO AND FIREARMS AGENTS knocked first, then entered
the Downey home of purported anti-gang activist Hector Marroquin on
Wednesday, arresting him for selling silencers and weapons - including
three assault rifles and a machine gun - to an undercover ATF agent.

The gun sales, some of which Marroquin, the founder of the
gang-intervention group No Guns, transacted at his bar in the city of
Cudahy, were captured on videotape and audiotape, said police officers
present at his arrest.

Inside the house, the 51-year-old veteran of the 18th Street Gang
surrendered as his daughter's boyfriend, David Jimenez, a parolee at
large, jumped out a window, tossed a gun into the backyard pool and
climbed on the roof, authorities said. Officials said ATF agents then
confronted him, he climbed back inside and was arrested and charged as a
felon in possession of a gun.

Marroquin, an alleged associate of the prison-based Mexican Mafia, has
grown accustomed to such intrusions, having been arrested many times
over the years while at the same time being the founder and CEO of No
Guns, which has received $1.5 million from Los Angeles City Hall via the
much-criticized L.A. Bridges program designed by the Los Angeles City
Council to keep youth out of gangs.

Last December, the L.A. Weekly exposed Marroquin's allegedly persistent
gang ties and suspected mafia association, in its "Broken Bridges"
article, based on federal Drug Enforcement Agency memos, classified L.A.
County Sheriff's Department documents, wiretap transcripts and
interviews with current and former law enforcers.

Since then, John Chavez, the head of L.A. Bridges, which funded No Guns
through the Community Development Department, has lost his job.

On Wednesday, the L.A. District Attorney's Office filed five charges
related to Marroquin's sale of automatic weapons and silencers to the
undercover ATF agent, according to a criminal complaint filed in L.A.
Superior Court. Also charged was Marroquin's girlfriend, Sylvia
Arellano, who police arrested the same day in Cudahy. Police searched
Marroquin's bar on Atlantic Avenue in Cudahy, as well as an auto yard in
South Gate, where they recovered gang photos and journals.

The criminal charges against Marroquin are elevated by his gang
membership, according to the complaint. If convicted on all counts, he
and Arellano face up to 50 years in prison.

At the time of his arrest Marroquin faced a separate gun possession
charge, also reported in December by the Weekly. That trial has been
delayed. Meanwhile, his son, Hector Marroquin Jr., a former No Guns
officer who police say is an admitted 18th Street Gang member, has been
indicted on charges of home invasion robbery and faces up to 40 years in
prison.

No Guns finally lost its funding last year, after city officials found
the organization had engaged in nepotism and misappropriation of public
funds. Along with his wife, son and daughter, who police say is a member
of the Hawthorne L'il Watts Gang, the Marroquins made more than $200,000
a year in salaries - public funds paid by L.A. taxpayers - to steer
children away from gangs and help active gangsters escape the life.

However, a report by civil rights lawyer Connie Rice and independent
audits have stated that L.A. Bridges, which has funneled more than $100
million to programs like No Guns, cannot show that it has reduced gang
activity, and the city council lacks any meaningful measures for
determining success. Just last week, another purported
gang-member-turned-good, 30-year-old Mario Corona, with a group called
Communities in Schools, also a recipient of L.A. Bridges money, was
sentenced to 32 months in prison for transporting a large amount of
methamphetamine and being a felon with a gun.

Marroquin grew up on the rough streets of Cudahy, a crime-riddled L.A.
suburb largely inhabited by poor Latino immigrants. Ever since founding
No Guns in 1996, when he was shot while protecting his son from unknown
attackers, Marroquin has been a target of police suspicion. Earlier that
year he was convicted of gun charges, and has violated terms of his
probation two times. In 1998, he was acquitted of weapons charges. That
same year he intervened to resolve gang strife in Santa Monica.

In 2005, he told the Los Angeles Times he was a changed man - intent on
fighting gangs and violence - but he was arrested last year at his home
in Downey when police, while looking to arrest his son, found an
unloaded gun on the top of an armoire in his bedroom. His daughter,
Charleeda Marroquin, claimed it was hers.

Then, in November of last year, Marroquin was shot twice and
hospitalized after a confrontation with a group of young men in the
alley outside his South Gate auto yard. The shooting remains unsolved.

The undercover sting that culminated Wednesday came as the result of a
nine-month investigation, federal ATF officials said. The complaint
alleges Marroquin and his girlfriend sold guns to an ATF agent in
September, October and November of last year. According to the District
Attorney's Office, Marroquin posted $260,000 bail and is expected in
court on June 21.

Police say ATF agents caught Marroquin on videotape selling at least one
of the guns out of the parking lot of Marrokings Seafood and Bar � a
property on Atlantic Avenue he and his wife purchased for $645,000.
Police say that in the past, they have arrested gang members there for
gun possession. In 2005, a Cudahy man alleged that Marroquin assaulted
and threatened him there, after a dispute over the sale of tires.
�You�re messing with the Mexican Mafia. I run all of
Cudahy,� Marroquin
said at the time, according to an arrest report. According to a real
estate database, Marrokings has been put up for sale.

In a second expose, published in February, the Weekly found that
Marroquin was operating the bar without a valid business license. Cudahy
City Manager George Perez told the Weekly he did not know how that
occurred, and confirmed that he called then-Maywood Chief of Police
Bruce Leflar on Marroquin�s behalf after police raided the property
last
year looking for weapons.

Documents obtained by the Weekly also show that the city of Cudahy
passed a moratorium on issuing Conditional Use Permits for alcohol
sales, but that the moratorium was lifted at the time Marroquin applied
for - and was granted - his permit.

Tears after student gets 1-year sentence for airgun assault

A TERRIFIED teenager who shot a burglar who tried to break into his home was yesterday jailed for a year.

A court heard that 18-year-old Casimir Ali reacted after he heard David Goldie attempting to force his way into his flat last June.

The computing student had grabbed the airgun and a small fishing knife after Goldie - who was high on drugs - threw a bottle at his stepdad.

First offender Ali had admitted assaulting Goldie while under provocation.

But at Glasgow Sheriff Court yesterday, sheriff John Baird told him his act ions would have been considered in a different light had Goldie been inside his flat.

The sheriff added: "If that had been the situation and you behaved in this way, then it could have been a case which could have been disposed of in another way.




"You chose to arm yourself with a rifle and a knife and, along with others, confronted the person yourself.




"As he attempted to move away, you shot him twice.




"Your conduct is completely unacceptable. This was taking the law into your own hands. The only appropriate disposal is a custodial sentence."




Ali looked shocked as he was taken away. A woman, thought to be his girlfriend, left the court crying hysterically.




Ali had noticed Goldie and a youth outside his door in Glagow's Maryhill on June 10 last year.




Patrick Hughes, prosecuting, said Ali believed they were going to break in.




He called police and told his stepdad, who confronted Goldie and a struggle ensued. Goldie then threw a bottle at the man.




Seeing Goldie turn violent, Ali came out of the flat armed with the knife and rifle.




Mr Hughes told the court: "He fired a pellet at Goldie. Goldie then returned to the accused and his stepdad and punched the man.




"During this, Goldie dropped a metal cosh. At this, the accused fired a second pellet, hitting him on the chest."




Police arrived and found Ali, now of Glencairn Drive, Coatbridge, with the knife and discovered the air rifle.




The court was told that Goldie, a serial housebreaker, had a long history of violence and dishonesty.




Jason Beltrami, defending, said Ali had owned the rifle since he was 11 and had been given the knife by his dad as a gift.




He added: "Mr Ali did not know this man and became fearful. There had been previous incidents of youths outside his door.




"A bottle had been thrown at his stepdad and Mr Ali took the wrong decision and fired the gun."




It is thought the sentence will be appealed.

] Local Pharmacist foils robbery attempt


As I'm sure all here know, we've had a fairly regular string of
pharmacy robberies over the last couple of years. Usually the crooks
are demanding Oxycotin or some other drug with high street value.
We've had a large number of cases where the same individual was
responsible for a string of robberies, almost certainly supplying
others, rather than just his own habit.

Sadly, in almost all cases the pharmacists complies and the thief gets
away. In some cases--usually the repeat offenders--the bad guy will
eventually get caught, but not in the act.

This story is much different. The pharmacist runs a small, family
owned business and makes clear in the article he wants others to know
he will continue to defend himself and his business with his gun. He
does not intend to be an easy target.

Not only this guy NOT become a victim, he helped prevent more drugs
from ending up on the street feeding and creating more habits and
problems there.

Sadly, the judicial system engaged in its usual catch and release for
the perp.

pharmacy, but the pharmacist had a surprise under the counter.

"I just pulled a gun on him and said 'get out of here," Rod Dunn tells
KSL. Pharmacist Rod Dunn is tired of getting robbed for pills and he's
not going to take it anymore, so he used a gun to protect his pharmacy
and employees.

It happened at Millcreek Pharmacy, a family-owned and run business.
The man who tried to rob them quickly learned not to mess with this
pharmacy.

Rod Dunn has been robbed before, he says about 20 times. It's why he
made the counters tall and deep and the enclosures high. "So we can
just step this way and we'll be out of their sight," he said.

It's also why he has a gun. Just over a week ago, he pulled it out on
Joseph Chiazzese, who had come into the pharmacy, left, then came back.

The Dunn's will do this again because they don't want to get robbed
again. They hope word gets out to leave their pharmacy alone.

A welcome article in "Editor & Publisher," the trade publication for the newspaper industry, acknowledged that because a wave of articles on guns would likely follow the Virginia Tech shootings, "it would be a good idea for the press to at least get its technical terminology right in covering the developments." The article's author, Chuck Klein, then pointed out egregious errors that had already appeared and provided his fellow journalists with a handy glossary and other helpful information. NSSF formerly ran a series of ads in "Editor & Publisher," stressing the importance of accurate reporting on firearms-related issues and positioning itself as an authoritative and available resource to journalists.

In the wake of the Virginia Tech massacre, a new wave of gun control debate and legal measures will remain in the news for months. But sloppiness is a warm gun: It would be nice if the press at least got its technical terminology right in covering the developments.

(May 13, 2007) -- In the wake of the Virginia Tech massacre, a new wave of gun control debate and legal measures will remain in the news for months. It would be a good idea for the press to at least get its technical terminology right in covering the developments.

My field of expertise is firearms and I am constantly amazed at the lack of knowledge and/or research (laziness?) that some writers exhibit when writing about guns or the use thereof.

For example, one noted author penned, “&helliphe grabbed the 30.06 rifle&hellip.” The thirty-ought-six is probably the most well know cartridge in the world. However, it is displayed as .30-06. The “.30” is the caliber or bore diameter of the barrel. The “06” refers to the year (1906) when the cartridge was accepted by and for the U.S. Military. This same author, when describing a group men in the early 1970s had one of them shooting a Glock pistol. Glock didn’t make handguns until the 1980s.

Some other the most egregious errors found in news media stories, articles and books include:

“The gun used was a Colt automatic.” (Did the writer mean machinegun or the more common SEMI-automatic pistol? Colt has made both).

“He took out his pistol, opened the cylinder&hellip.” (Pistols don’t have cylinders – only revolvers do.)

“The killer placed a fresh bullet into his gun.” (I think he means, cartridge.)

Below are some Firearm Related Terms that might help when editing a piece that includes reference to firearms:

ACTION: Moveable mechanical parts of a firearm.

BALLISTICS: Science of the characteristics of projectiles in motion.

BARREL: Part of the firearm through which the discharged bullet passes moving from breach to muzzle.

BORE: The inside of the barrel through which the discharged bullet passes. Size is determined by measuring the distance between the lands of a rifled barrel or maximum inside diameter of a smoothbore (shotgun) barrel .

BREECH: Rear portion of the barrel which includes the chamber.

BULLET: (aka PROJECTILE) The missile only. The part of the cartridge that separates, exits from the muzzle and impacts on the target.

CARTRIDGE: A complete unit of ammunition which is comprised of the cartridge case, primer, propellant, and bullet - a loaded round of ammunition.

CALIBER: Refers to a weapon's (land or grove) or bullet's diametrical size - usually expressed in thousands of an inch or metric equivalent. Sometimes includes other information to indicated powder charge (e.g., .38-40) or year of adoption (e.g., .30-06) or special designation (e.g., .38 Special).

CENTERFIRE: Cartridge case which contains its primer in the rear center portion. Usually reloadable. A firearm designed to fire centerfire ammunition.

CHAMBER: Inside portion of the breech formed to accommodate the cartridge.

CLIP: Device to hold cartridges for insertion into a magazine. See "MAGAZINE"

CYLINDER: Revolving mechanical part of a revolver which houses multiple chambers.

DEADLY FORCE: See "LETHAL FORCE"

DOUBLE ACTION: (DA) Function of trigger pull that requires two actions to discharge a weapon. The first action is the compressing of the hammer/firing pin (main) spring by physically moving the trigger rearward. The second action is the continued rearward movement of the trigger to the point of causing the release of the hammer/firing pin.

FIREARM: Any weapon from which a projectile(s) is discharged by means of a rapidly burning or exploding propellant.

FRAME: The non-moveable mechanical portion of a weapon into or upon which all other parts are attached.

GRIP: See "STOCK"

HAMMER: Moveable mechanical part of the action which, when released, drives the firing pin into the primer.

HANDGUN: A firearm (revolver or pistol) designed to be operated with one hand and without the aid of extraneous support.

INSTINCT COMBAT SHOOTING: The act of operating a HANDGUN by focusing on the target and instinctively coordinating the hand and mind to cause the HANDGUN to discharge at a time and point that ensures interception of the target with the projectile. Method developed by and term coined by Police Firearms Instructor CHUCK KLEIN.

INSTINCT SHOOTING: (a.k.a. point shooting) Focusing on the target and instinctively shooting any long gun without the aid or use of mechanical sights.

MAGAZINE: Removable part of a pistol which holds cartridges in such a way as to facilitate the chambering of these cartridges during operational functioning.

MUZZLE: The end of the barrel from which the discharged projectile exits.

PISTOL: aka: Autoloader, auto pistol, semi-auto. Any self-loading handgun that is not a revolver. Usually incorporates the chamber as part of the barrel. Requires the manually pulling and releasing of the trigger for each shot. After each shot the recoil "automatically" pushes the slide rearward, ejecting the spent cartridge, cocking the hammer/firing pin and, on the return forward movement, striping a fresh cartridge from the magazine for insertion into the chamber. This action/reaction does not disengage the sear, which can only be done by releasing the trigger.

Fully automatic weapons such as machine guns or submachine guns will continue to fire until either the trigger is released or the magazine is emptied.

POINT BLANK RANGE: Distance so close that appreciable projectile deviation of line of flight is negligible.

POINT SHOOTING: See "INSTINCT SHOOTING".

PRIMER: Detonating mixture structured to ignite propellant when struck a sharp blow as from a firing pin.

RECOIL: The kinetic energy reaction of the expanding burning propellant as it pushes the projectile through the bore. This is also evidenced by the rearward thrust of the weapon against the shooters hand/body.

REVOLVER: A multi-shot handgun, utilizing a revolving cylinder as a cartridge receptacle.

RIFLING: Parallel spiral groves cut into the bore to impart spin on the projectile. This spin aids in stabilizing the bullet in flight which greatly improves accuracy. This rifling so marks the bullet as it passes through the bore. These engravings (fingerprints) are unique to that particular bore and bullet.

RIMFIRE: Cartridge case which contains its primer in the rear rim portion. A firearm designed to fire rimfire ammunition. Not reloadable. .22 LR (Long Rifle); .22 Short; and .22 Long are all rimfire cartridges and are of the most common and oldest cartridges in current use. Rifles, pistols and revolvers have all been chambered for this round of ammunition.

SAFETY: Any device or mechanism which locks or blocks the trigger, hammer and/or sear to prevent unintentional discharge.

SEAR: Mechanical part of the action of a firearm which functions between the trigger and the hammer; acts as a release when the trigger is fully depressed.

SEMI-AUTOMATIC: See "PISTOL"

SHOTGUN: A shoulder fired long-gun with a smooth (not rifled) barrel. Shotgun size and power are designated by Gauge – not by caliber (see Sidebar). Some shotgun types are: SxS (Side by side – a double barrel shotgun with the barrels arranged side by side); O/U (Over/Under – a double barrel shotgun with the barrels arranged one on top of the other); Pump action (One must operate the pump to expel fired shells, load a fresh shell from the magazine and cock the hammer/firing pin); Auto-loading (The force of firing a shell ejects the spent shell and “automatically” recharges the chamber with a fresh shell from the magazine while cocking the hammer/firing pin) Bolt action (a bolt is used to extract, charge the chamber and cock the hammer/firing pin).

SINGLE ACTION: Only one action is required to fire the weapon such as moving the trigger rearward to release the hammer/firing pin.

SLIDE: On semi-automatic or automatic weapons, the movable mechanical device which functions to extract spent cases and insert loaded cartridges.

SNUB-NOSE: Slang term usually meaning any short barreled revolver.

STOCK: Portion of the weapon which is held in the hand.

TACHYINTERVAL: Time-deception phenomena. A condition that occurs when, under extreme stress, events appear to happen in slow motion. Events, of course, do not slow down but, the mind seems to speed up due to the brains ability to digest information much faster than the body can act/react. Many people who have been in serious auto accidents or gun fights have experienced this condition.

TRAJECTORY: The parabolical path of a projectile in flight from muzzle to impact.

TRIGGER: Moveable mechanical device designed to be operated by the index finger for double action or single action mode depending on type of firearm.

TUNNEL-VISION: Peripheral-optic distortion/dysfunction phenomena. A condition that can occur during high concentration where one see (is aware of) only the center of his/hers attention. This temporary occurrence renders the victim oblivious to surrounding events.

SOME COMMON HANDGUN CALIBERS:

.22 Long Rifle (.22LR) This is a rimfire cartridge and has been very popular for over 100 years.
.25 ACP (ACP means, Automatic Colt Pistol)
.380 Automatic (Popular self-defense pistol round)
9mm (Once popular police cartridge, especially in Europe)
.38 Special (Early police revolver cartridge – still popular in snub-nose revolvers)
.357 Magnum (Popular revolver cartridge for police and self-protection)
.40 Caliber (Popular modern police pistol cartridge)
.44 Magnum (Powerful hunting and self-defense round)
.45 ACP Old (1911) and still popular police and self-defense pistol round)

SOME COMMON RIFLE CALIBERS:

.223 (aka 5.56mm. Cartridge designed for the M-16 – and other – military semi-auto and full-auto rifles)
.270 Winchester (Popular hunting cartridge)
.30-06 (Originally a military cartridge – now a very popular hunting round)
.308 Winchester (aka 7.62 NATO. A military round and one of the most accurate high power hunting and target rounds)
.30-30 (Most popular deer hunting cartridge)
.470 Nitro Express (early “elephant” cartridge usually found in SxS double barreled rifles)
.458 Winchester Magnum. (Very powerful hunting cartridge – used for big game)

COMMON SHOT GUN GAUGES:

12 Gauge (.729 bore diameter)
16 Ga. (.662)
20 Ga (.615)
28 Ga (.550)
.410 (.410) Called the Four-Ten, it is actually about a 67 Gauge, but has always been referred to as the four-ten.

. . . Sports giant Nike is known worldwide for its roster of sponsored pro athletes like Michael Jordon and Tiger Woods. But no shooter has ever broken the Nike barrier -- until now. Nike is expected to soon announce that Kim Rhode will become the first shooter to join the sports world's elite beneath the Nike banner. Said Rhode, "Nike didn't know a lot about shooting, but discovered that it's a real sport worthy of projecting in a positive light, right alongside golf and tennis and basketball. For shooting to have a mogul like Nike behind it, backing it, showcasing it, and highlighting what shooters can achieve, is extremely outside the box. And it's a very big deal for our sports." Rhode has medaled in the last three Olympics, claiming two golds and a bronze in women's double trap. No word yet on whether Nike will introduce a line of shooting apparel or footwear.

WASHINGTON — Rep. Todd Tiahrt is Mayor Bloomberg's bogeyman, the congressional embodiment of what the mayor says is a powerful lobby allowing illegal guns to flow onto the city's streets.

As part of his national campaign against illegal guns, Mr. Bloomberg has targeted Mr. Tiahrt aggressively, even running television ads in his Kansas district that tell voters that a law their congressman sponsored is helping criminals, not the police.

The veteran Republican lawmaker has stayed mostly quiet in the face of the onslaught, but now he is fighting back. In a 30-minute interview in his office last week, Mr. Tiahrt accused Mr. Bloomberg and his aides of negotiating in bad faith, and he says the famously nonpartisan mayor is putting politics over police safety.

"I think it's a self-serving effort to put a political agenda above the safety of our law enforcement officers," Mr. Tiahrt said.

The measure he has sponsored, known as the Tiahrt amendment, puts limits on the use of gun tracing data by law enforcement agencies and in civil litigation. City officials argue that it ties their hands in aggressively prosecuting gun crimes and getting illegal guns off the streets.

Mr. Tiahrt says the opposite is true.

Repealing the amendment, which has passed Congress each year since 2003, could endanger undercover police officers by making aspects of their investigations available to the public, he said.

"They could be, by looking at the trace data, ferreted out, or discerned, and that would place them in jeopardy as well," he said.

To city officials, Mr. Tiahrt's claims are beside the point. In the eyes of City Hall, the congressman is a foot soldier for the National Rifle Association and a spokesman for the gun industry. And to Mr. Tiahrt, Mr. Bloomberg is using a "passion for gun control" as a plank in a national, if not presidential, campaign.

Mr. Tiahrt, 55, is a former Boeing executive first elected to Congress in 1994. A lifetime member of the NRA, he is a staunch advocate of the Second Amendment, saying guns in the hands of private citizens act as a deterrent to criminals. He owns about a dozen guns himself, some for collecting and others for hunting. "I have more guns than I need and not as many as I want," he said with a laugh.

In the interview, he also offered a glimpse of Mr. Bloomberg's personal style, as the mayor first tried to persuade Mr. Tiahrt to agree to changes in the legislation before taking a more hard-charging approach. The courtship began with charm — the mayor sent the congressman a copy of his book with a personal inscription — but soured before long.

Mr. Tiahrt met with Mr. Bloomberg and his aides in the congressman's Capitol Hill office on January 23, while the mayor was in town for a summit on illegal guns. He described the meeting as cordial, saying he presented himself as open to negotiating on some areas of the legislation — allowing the sharing of aggregate trace data — while not budging on others, such as the use of the data in civil litigation.

He characterized City Hall officials as less open to compromise. "It became very clear to me that they didn't want to come to some sort of agreed settlement on something that would be good for police officers and effective for catching criminals," Mr. Tiahrt said. "They wanted to go to where the mayor wanted to go, and they wanted to do it at the peril of undercover police officers."

Within three months of that initial meeting, Mr. Bloomberg, through his coalition against illegal guns, had unleashed television ads in Mr. Tiahrt's district, along with the districts of other key members of the House Appropriations Committee. In the ad that ran in Wichita, Kan., a narrator urges constituents: "Ask Representative Tiahrt why he voted to protect criminals, instead of cops."

How many people actually saw the ad targeting Mr. Tiahrt is another question. Two stations in Wichita refused to run it, questioning its accuracy and calling it misleading.

Mr. Tiahrt said he called the mayor when he heard about the ad last month. Mr. Bloomberg told him things weren't moving fast enough and that the advertising might speed up the process, the congressman said. Mr. Tiahrt wasn't buying it. "For him to use these ads to try to make something happen doesn't make any sense," he said of the mayor. "It's just that he's trying to push this political agenda."

City Hall tells a vastly different version of events and blames Mr. Tiahrt for causing the impasse. The city's criminal justice coordinator, John Feinblatt, said Mr. Tiahrt never followed up on the January meeting and infuriated city officials by secretly offering a proposal for a revised bill that would have stiffened the Tiahrt amendment by tightening restrictions on the use of trace data in civil suits.

The changes, Mr. Feinblatt said, could cripple the city's efforts to sue gun dealers across the country for engaging in illegal "straw purchases."

"If Todd Tiahrt is worried about protecting gun dealers who are violating the law, then we have to part ways," Mr. Feinblatt said, defending the mayor's decision to target the congressman in ads.

The city has settled with 12 of the dealers it has sued; they have agreed to broad oversight of their practices. New York officials gleaned much of the evidence for the lawsuits by sending private investigators into the gun shops to perform sting operations. Gun rights advocates have railed against the mayor's tactics, and the state of Virginia in March outlawed the use of private investigators without supervision by the federal Bureau of Alcohol, Tobacco, Firearms, and Explosives.

Mr. Tiahrt also had choice words for the strategy, calling it a "vigilante-style effort."

The firestorm over his amendment, meanwhile, shows no sign of abating. Mr. Tiahrt says he intends to try to renew it in the coming months, and he touts the support of the Bush administration along with the Fraternal Order of Police, the nation's largest association of law enforcement officers, with more than 300,000 members.

For the city's part, Mr. Feinblatt cited the backing of more than 160 mayors and 20 national or state law enforcement organizations. He also responded to Mr. Tiahrt's chief reason for supporting the legislation — that its repeal could jeopardize the safety of undercover officers. Mr. Feinblatt said there is little evidence to suggest that is true. Beyond that, he said, the city has consistently expressed willingness to restrict access to trace data to the general public.

He portrayed Mr. Tiahrt's argument as a recent creation, pointing to statements the congressman made when he first introduced the measure in 2003. At that time, he bragged that the NRA had reviewed and approved the language in the bill, and he told the Washington Post: "I wanted to make sure I was fulfilling the needs of my friends who are firearms dealers."

To Mr. Tiahrt, the city's protestations may not matter now. "This isn't a struggle that I went out looking for," he said. But neither is it one he seems eager to give up.

This is the way society is SUPPOSED TO WORK!!!! I suspect it will srart
working this way more and more, the more people who arm themselves and train
properly so they know the law of self defense before attempting to use a gun
to defend themselves and others. This guy was clearly justified even though
the robber wasn't showing a weapon because he was committing a forcible
felony. Pancho V.

Armed pharmacist stops robbery in progress
Police say a 35-year-old Salt Lake man didn't really have a gun when
he walked into a pharmacy and handed an employee a note demanding
painkillers. But a pharmacy co-worker did.
According to charges filed against the man Friday in 3rd District
Court, surveillance video at the Millcreek Pharmacy, 1260 E. Vine St.,
showed the man pulling his hoodie over his head and putting on a pair of
cotton gloves before entering the pharmacy last Monday.
A pharmacy worker told police the man handed her a note stating "This
is a robbery. Give me 2 bottles of Oxycontin ... Do NOT make a scene and no
one will get hurt. I have a gun."
When another pharmacy co-worker showed his gun, and the suspect
attempted to flee. The suspect, however, "deferred to suggestions" made
by a
passer-by armed with a golf club to wait for police, according to the
charging documents.
A search by police revealed the suspect was armed with a hunting
knife. He has been charged with first-degree aggravated robbery and a
misdemeanor count of carrying a concealed weapon.
As of Friday, he remained in the Salt Lake County Jail on $50,000
bail.

APOPKA, Fla. - Monday is Ladies Night, and Lorrie McNally is a regular here. So is her 62-year-old mom.


The air is thick and smoky, and the place is packed. People are forced to shout over the boom, boom, boom.


But these women aren't clutching cocktails - they're gripping guns. Ladies Night at the Shoot Straight gun range means women don't pay.


McNally trains her eyes on a neon-orange target nearly 20 feet away. She pulls the trigger 17 times, pausing only momentarily between each shot, eyeing the spot where the slug punctures the target.


"I wouldn't want her shooting at me," her boyfriend remarked about her accuracy.


That's the fear McNally hopes to instill. Ten years ago, McNally found herself on the other end of a gun, when she was nearly abducted in broad daylight from a mall parking lot. Her screams saved her then, but she vowed that next time - should there be one - she would not rely on her lungs to save her. Next time, her attackers would be looking down the barrel of her gun.


McNally, 39, represents a growing number of women who have armed themselves for personal safety.


Shooting ranges are reporting a marked increase in the number of women taking aim, signing up for concealed-weapons courses and making purchases. On a recent Saturday, more than 200 women attended a six-hour introductory firearms workshop, an event that keeps growing each year.


Nationwide, the National Rifle Association's "Women on Target" program has grown from 500 participants in 2000 to 6,000 this year.


"Women are the largest-growing demographic in the gun industry," NRA spokeswoman Ashley Varner said.


McNally practices shooting each week. The 5-foot-6-inch, 129-pound mortgage broker slams a magazine into her 9 mm semiautomatic and pulls the slide back, creating a ch-ch sound. She takes aim at the target and fires away, her bracelets jingling at each pull of the trigger.


"I keep it on me wherever I go," she said when finished.


The mother of an 18-year-old son, she keeps a Springfield Armory semiautomatic in her purse and a Beretta pistol at home or in her glove box.


"I think it's more important for women with small children to own a gun because you can't run when you have children," she said.


Two years ago, one in 10 of Shoot Straight's students was a woman. Now, women make up about 40 percent of its gun classes, said Larry Anderson, manager of the Shoot Straight in Apopka.


At East Orange Shooting Sports in Winter Park, Fla., the number of female customers is up almost 25 percent over last year, manager John Ritz said.


"The ladies seemed more keyed into personal safety," Ritz said of his clients.


But, he stressed, "Having a gun on the nightstand doesn't make you any safer just by its presence. The customer has to be educated, has to be informed."


Anderson's and Ritz's jobs put them face to face with crime victims, the people who have been robbed, beaten and raped.


They've also met their share of so-called soccer moms who no longer are packing only lunches; now they want to pack heat.


Known as security moms, these women, the NRA says, are arming themselves with weapons in the belief that they are the first line of defense against crime, especially since the Sept. 11 attacks sent a wave of fear into American communities.


Gun-shop owners say they see an increase in sales after events such as hurricanes, a series of unsolved rapes or an overall spike in crime.


"More people out there aren't feeling safe," Anderson said. "(Crime) has gotten out of hand; it's gotten to the point where you can't escape it."


McNally's mother, Carol, started shooting last year, mostly at the urging of her daughter, who is quick to preach about personal safety.


"The bad guys are out there. They do a carjacking today, and they're out on the streets tomorrow," Carol McNally said. "I doubt that I'd ever have to use the gun, but if anyone threatened me, my family, my kids, my grandson, I wouldn't hesitate. I have the confidence to carry it without feeling intimidated by it."


The gun industry is doing its part to make ownership less threatening by creating models better fitting for women - smaller and more contoured to their hands. And in doing so, gun manufacturers have clued into something else - that there's a market for stylish and more feminine accessories and products.


Gun manufacturer Taurus, for instance, unveiled a pink-pearl handgun, as well as a smaller-barreled gun, which can fit more easily in purses. There's even a range of chic holster purses that are just as fashionable as high-end handbags. What better way to appeal to women?


The attraction, however, remains firepower.


When someone broke into Sarah Price's home last month and stole the .357 Magnum from her bedroom, she temporarily replaced it with a "big stick." But it was hardly the protection and peace of mind the single 42-year-old was looking for. Her father promptly replaced it with a 9mm Kurz handgun.


"Men can overpower us," Price said. "You have to have something that's bigger and badder than they are."

It is a rare person who does not attach some sort of value or emotion to some physical object or to an event. A home becomes more than a building. A statue of the Virgin Mary, a crucifix, a flag or a song, or even a photograph can stir emotions greater than the value of the material item.

I have a piece of paper showing I served in the military until I was discharged honorably. But, oh, the memories that piece of paper conjures up. The friends, the fun times. The bad times. The times when we were bound closer to strangers than to our own families and, in frightening chaos, our lives hung by a thread.

Many of our friends died far from home. Ask us about the feeling of "American soil" upon returning to the land we loved. Ask those returning soldiers about America.

Remember the old, faintly humorous band of American Legionnaires, wearing out-dated military uniforms straining at the buttons. But, God how proudly they marched. Grinning, waving to friends and families, and always, always "The Flag!" Ask them if the flag is mere cloth, I dare you.

See the elderly lady sitting in a lawn chair watching the fourth of July parade. Three flags carefully folded some forty years ago into triangles now rest in her lap - one for each lost son. Ask her if those flags are mere cloth, I dare you.

Look at the old man quietly crying, leaning against the Iwo Jiima Memorial at Arlington Cemetery. As he turns to you, smiles with some embarrassment, and says in a choked whisper, "I was there." Ask him, "Is it just metal and clay?" Ask him. I dare you.

The Wall. My God, the Wall. See the young man lightly tracing the name of his father there inscribed. Ask him if its just rock. Ask him. I dare you.

My guns? They’re of little real value compared to my family and my home. They are toys, or tools, or both. But what those guns represent to me is greater than all of us, greater than myself, my family, indeed greater than our entire generation. What could be of such value?

The freedom of man to live within civil, self-imposed limitations rather than under restrictions placed upon him by a ruler or a ruling class.

Imagine the daring, the bravery of a few men to declare they intended to create a new country, independent of the burden of their established Rulers!

Those men we call our forefathers were brilliant men. They could have maneuvered themselves into positions of influence within the structure of the times, but they did not. They struggled to free themselves from tyranny. They wrote the Declaration of Independence. And they backed up their words and ideals with metal and wood.

They knew the dangers of such dreams and actions. They knew it was a frightening and dangerous venture into the unknown when they dared reach beyond their grasp for a vision - for an ideal. But they dared to dedicate themselves to achieve Liberty and Freedom for their children, and their children’s children, through the generations.

Imagine the dreams and yearnings of centuries finally being reduced to the written word. The Rights of "We the People!" instead of the "Powers of the Monarchy."

Our forefathers dared to create a new government - a new form of government. And they knew that any organization has, as its first and foremost goal, its continued existence. Second only to that it strives to increase its power. It plots, it devises, it maneuvers to achieve control over its environment - over its subjects.

Our Forefathers decided to make America different from any country, anywhere, at any time in the entire history of the entire world.This country, this new nation of immigrants,would be based upon the concept that people could rule themselves better than any single person or small group of persons could rule them.

Other countries have had outstanding documents with guarantees for its citizens - but the citizens have become enslaved. How, these great men pondered, can we ensure this new government will remain subject to the will of the People?

They wanted limits upon this new government. Therefore, our forefathers wrote limitations into the Constitution and the Bill of Rights. And one of those Rights was that metal and wood, as the final power of the people, would secure this country for the future generations.

Metal and wood were the means by which we won our freedom.

Metal and wood were the means by which we kept our freedom.

Metal and wood may be the means by which we regain our freedom.

Metal and wood are the final power of the people. Take away the metal and wood and the people become powerless - they can only beg, they supplicate for favors.

We are unique in our ability to rule ourselves but we are letting it slip away. Today we compromise. We try to appease man’s insatiable appetite for power by throwing him bits of our freedoms. But the insatiable appetite for power can not be appeased. The freedoms we feed him only make us weaker and him stronger. We must conquer him and again ensure the "Blessings of Liberty" won for us by our forefathers.

We must be ready to use metal and wood again, for if we are ready, truly ready, we may be able to conquer the monster with words - for in its heart it is a coward. But if we continue to feed the monster our freedoms, we will become too weak to win, to weak even to fight, and we will become a conquered people. We will have sold ourselves and our future generations into servitude.

If words fail us, we will use metal and wood, we will regain what we have lost, we will achieve what we seek, we will guarantee the America of our forefathers for the future generations.

So you see, our guns are more than metal and wood. They are our heritage of freedom. They are the universally understood symbol that the government, no matter how big and strong it may be, answers to us! They are the tools we will use to prevent tyranny in the land of our forefathers and our children. So, ask me what my guns mean to me. Ask my children what our guns mean to them. Ask us. I dare you.

Law officers have praised a bank customer who pulled his gun
and helped deputies capture a gunman who opened fire during
a robbery of a Wachovia branch, killing two tellers and
wounding two.

Chris Chappell, who was in the bank Monday morning getting
$40 in change on the way to his job in Adger, fled the bank
when gunshots rang out, drew a gun for which he has a
concealed weapon permit, took cover by his sport utility
vehicle and alerted deputies who came up.

The gunman, cornered by Chappell and the deputies when he
tried to flee the bank with a hostage, stumbled and was shot
by Deputy Alan Rhea.

"It's certainly commendable," Jefferson County Sheriff's
Sgt. Randy Christian said. "It's obvious he played a key
role in keeping the guy there until we could get there.
It's a great testament of someone willing to take action."

"He kept him from escaping, and he gave deputies time to get
to the scene," Bill Veitch, chief assistant district
attorney, told The Birmingham News in its moment-by-moment
account of the robbery and arrest.

Bessemer Mayor Ed May, while calling Chappell a "good
Samaritan and a brave individual," added that "I would not
encourage anyone to do that."

Chappell, however, said he just went by his instincts.

"I know what's right and what's wrong. There wasn't nothing
I could do differently. I'm always going to do what I think
is right," Chappell said.

William Merriweather Jr., 30, a 1994 Jackson-Olin High
School graduate who also attended Alabama State University
and Lawson State Community College, was taken into custody
after being shot outside the bank. He was charged with
capital murder in the deaths of the two tellers.

According to witnesses and police investigators, the gunman
fatally shot Eva Lovelady Hudson, then continued firing down
the line of tellers, killing Sheila Prevo. He shot two
other tellers, who survived, while demanding money, and
forced bank manager Myron Gooding to open the vault.

Grabbing a bag of money, he left the bank, only to find
Chappell waiting.

"I was prepared to shoot," Chappell said.

According to the News account, the gunman threw his hands up
and went back inside when he saw Chappell. He eventually
came out holding Gooding as a hostage. By then, deputies
had arrived and Merriweather was shot and captured.

"I don't think you had time to be scared," said Chappell.

The clock inside Chris Chappell's SUV read 9:03 as he pulled into the Wachovia
bank branch Monday morning on Bessemer's Ninth Avenue.
He had visited his mother at Medical West hospital, dropped in at Wal-Mart and then
made a quick stop at the bank to get $40 in change to take to work in Adger in west
Jefferson County.
Just after Chappell entered the bank, another man walked in.
He was wearing a sky blue shirt, striped tie, khaki pants, baseball cap, sneakers
and sunglasses, police and witnesses say.
William Merriweather Jr. also was carrying a 9 mm Glock semi-automatic pistol. He
took money. He took lives. But he didn't get away.
Here's what witnesses and police investigators say happened during a terrifying
six minutes.
As the bank opened its doors about 9 a.m., eight employees were inside, just beginning
a new work week. One of the teller windows was empty because one person was on vacation.
About a dozen customers were there first thing, ready to do their banking business
- Chappell among them.
Merriweather, a 1994 Jackson-Olin High School graduate who also attended Alabama
State University, came in with a mobile phone pressed to his ear. Police think he
walked to the bank, using an access road from the Lawson State Community College
campus, where he had once taken classes.
Chappell handed a teller a few bills, and the teller collected the coins for him.
Shots rang out. Chappell glanced up and saw that the teller at the next window,
Eva Lovelady Hudson, had been fatally shot.
Merriweather continued firing down the line of tellers, Chappell said, killing Sheila
Prevo. Customers and employees ran for cover.
At the counter, Merriweather demanded money and keys. No one is sure whether that
demand came before or after he fired his gun, or if it was during the barrage.
Merriweather then dashed behind the counter and grabbed teller LaToya Freeman by
the hair and ordered her to open the vault. Another teller, Anita Gordon, tried
to protect her co-worker, but Merriweather turned and shot Gordon in the face and
neck. Freeman fell to the floor, leaving some of her hair in Merriweather's
grip. Merriweather fired shots at Freeman, blowing off the tip of her right index
finger.
Amid the rampage, Chappell and at least one other customer fled the bank.
Chappell was carrying his own gun, for which he has a concealed weapon permit. He
took cover by his sport utility vehicle just outside the front doors, drew his weapon
and waited.
Inside the bank, with Freeman wounded and no longer able to comply with his demands,
Merriweather grabbed bank manager Myron Gooding and forced him to open the vault.
Merriweather then grabbed a bag of money and exited the bank.
He found Chappell waiting.
"I was prepared to shoot him," Chappell said.
Returned with hostage:
Merriweather threw his hands up and turned to go inside after seeing Chappell. He
returned to the doors a second time only to go back inside the bank. But when he
returned a third time, he had taken Gooding hostage.
At the same time, sheriff's deputies Ray Sorenson and Randy Davis were passing
by the bank when they spotted a woman falling. She fell, rolled, got back up and
kept running.
The deputies, who serve outstanding warrants, quickly turned around to investigate.
That's when they spotted Chappell standing outside, his gun drawn. Chappell
screamed that an armed man inside had shot "two or three people."
"I'm very surprised that the guy he held hostage didn't get his head
blowed off," Chappell said.
The deputies called for backup.
At 9:06 a.m. Bessemer police were notified that there was a disturbance at the bank.
Meanwhile, Chappell and the deputies cornered Merriweather, who faced them with
a gun pressed to Gooding's head. Merriweather and Gooding stumbled.
"He knows he's fixin' to get shot," Chappell said of Merriweather.
"And he's not crazy. A crazy man don't have sense enough to be scared.
And he was scared."
As Merriweather stood up, he reached for his gun and was shot by Deputy Alan Rhea.
Merriweather hardly acknowledged being shot, Chappell said, only letting out a grunt
when he was wounded in the groin.
Bessemer police arrived at 9:09 a.m.
"I don't think you had time to be scared," said Chappell, who had
never used his gun to subdue anyone. "I prayed to God that I wouldn't have
to use it.
Still holding bag:
Deputies and police moved in to arrest the wounded Merriweather, who was still clutching
the money bag and trying to get away. He didn't let go until he was handcuffed.
Authorities praised Chappell
"It's certainly commendable," Sheriff's Sgt. Randy Christian said.
"It's obvious he played a key role in keeping the guy there until we could

but added: "I would not encourage anyone to do that."
Chappell said he was only doing the right thing. "I know what's right and
what's wrong. There wasn't nothing I could do differently. I'm always

S.C. House panel approves concealed weapons on campuses

COLUMBIA, S.C. --To prevent school shootings, South Carolina legislators want more guns on campuses.


Staff and older students would be allowed to carry concealed weapons to school under a proposal approved Wednesday by a House subcommittee. Legislators said they believe having trained, armed gun owners in schools could prevent massacres like the shootings at Virginia Tech.

If signed in to law, South Carolina would join Utah as the only states that have laws allowing people to carry concealed weapons on campuses. Current law bans weapons on campuses in South Carolina.

Supporters say people who carry concealed weapons could stop shootings in part because they have to undergo training, criminal and mental background checks, and must be at least 21.

"We're not talking about kids. We're talking about responsible adults," said Republican Rep. Jeff Duncan, the bill's chief sponsor. The measure doesn't specify who would be allowed to carry concealed weapons, but Duncan said he's willing to limit permit holders on campuses to school staff.

Opponents said they fear accidental killings and pleaded against the measure, which passed by a 2-1 vote. The bill now heads to the House Judiciary Committee.

"You can't call a bullet back," said Democratic Rep. Seth Whipper. "It's a bad idea."

College police chiefs across South Carolina said that if the law were passed, it would be difficult for officers to pick out a criminal. "Today, if we respond, we know the person with the weapon is the bad guy," said Ernest Ellis, the law enforcement director at the University of South Carolina.

Nationwide, 37 states - including Virginia - ban weapons at schools. Of those, 16 explicitly prohibit weapons on college campuses, according to the National Conference of State Legislatures.

To obtain a concealed weapon permit in South Carolina, a resident must be at least 21, undergo at least eight hours of handgun training, and pass criminal and mental background checks. By law, the permit holder must keep the gun on their body or within arm's reach.

APOPKA -- Monday is Ladies Night, and Lorrie McNally is a
regular here. So is her 62-year-old mom.

The air is thick and smoky, and the place is packed. People
are forced to shout over the boom, boom, boom.

But these women aren't clutching cocktails -- they're
gripping guns. Ladies Night at the Shoot Straight gun range
means women don't pay.

McNally trains her eyes on a neon-orange target nearly 20
feet away. She pulls the trigger 17 times, pausing only
momentarily between each shot, eyeing the spot where the
slug punctures the target.

"I wouldn't want her shooting at me," her boyfriend remarked
about her accuracy.

That's the fear McNally hopes to instill. Ten years ago,
the Eustis woman found herself on the other end of a gun,
when she was nearly abducted in broad daylight from a mall
parking lot. Her screams saved her then, but she vowed that
next time -- should there be one -- she would not rely on
her lungs to save her. Next time, her attackers would be
looking down the barrel of her gun.

McNally, 39, represents a growing number of women who have
armed themselves for personal safety.

Here in Central Florida, shooting ranges are reporting a
marked increase in the number of women taking aim, signing
up for concealed-weapons courses and making purchases. On a
recent Saturday, more than 200 women attended a six-hour
introductory firearms workshop -- an event that keeps
growing each year.

Nationwide, the National Rifle Association's "Women on
Target" program has grown from 500 participants in 2000 to
6,000 this year.

"Women are the largest-growing demographic in the gun
industry," NRA spokeswoman Ashley Varner said.

Crime 'has gotten out of hand'

McNally practices shooting each week. The 5-foot-6-inch,
129-pound mortgage broker slams a magazine into her 9 mm
semiautomatic and pulls the slide back, creating a ch-ch
sound. She takes aim at the target and fires away, her
bracelets jingling at each pull of the trigger.

"I keep it on me wherever I go," she said when finished.

The mother of an 18-year-old son, she keeps a Springfield
semiautomatic in her purse and a Beretta pistol at home or
in her glove box.

"I think it's more important for women with small children
to own a gun because you can't run when you have children,"
she said.

Two years ago, one in 10 of Shoot Straight's students was a
woman. Now, ladies make up about 40 percent of its gun
classes, said Larry Anderson, manager of the Shoot Straight
in Apopka.

At East Orange Shooting Sports in Winter Park, the number of
female customers is up almost 25 percent over last year,
manager John Ritz said.

"The ladies seemed more keyed into personal safety," Ritz
said of his clients.

But, he stressed, "Having a gun on the nightstand doesn't
make you any safer just by its presence. The customer has
to be educated, has to be informed."

Anderson's and Ritz's jobs put them face to face with crime
victims, the people who have been robbed, beaten and raped.

They've also met their share of so-called soccer moms who no
longer are packing only lunches -- now they want to pack
heat.

Known as security moms, these women, the NRA says, are
arming themselves with weapons in the belief that they are
the first line of defense against crime, especially since
the Sept. 11 attacks sent a wave of fear into American
communities.

Gunshop owners say they see an increase in sales after
events such as hurricanes, a series of unsolved rapes or an
overall spike in crime, as Orlando experienced with a
record-breaking number of slayings last year.

"More people out there aren't feeling safe," Anderson said.
"[Crime] has gotten out of hand; it's gotten to the point
where you can't escape it."

Industry catering to women

McNally's mother, Carol, started shooting last year, mostly
at the urging of her daughter, who is quick to preach about
personal safety.

"The bad guys are out there. They do a carjacking today,
and they're out on the streets tomorrow," Carol McNally
said. "I doubt that I'd ever have to use the gun, but if
anyone threatened me, my family, my kids, my grandson, I
wouldn't hesitate. I have the confidence to carry it
without feeling intimidated by it."

The gun industry is doing its part to make ownership less
threatening by creating models better fitting for women --
smaller and more contoured to their hands. And in doing so,
gun manufacturers have clued into something else -- that
there's a market for stylish and more feminine accessories
and products.

Gun manufacturer Taurus, for instance, unveiled a pink-pearl
handgun, as well as a smaller-barreled gun, which can fit
more easily in purses. There's even a range of chic holster
purses that are just as fashionable as high-end handbags.
What better way to appeal to women?

The attraction, however, remains firepower.

When someone broke into Sarah Price's Pine Hills home last
month and stole the .357 Magnum from her bedroom, she
temporarily replaced it with a "big stick." But it was
hardly the protection and peace of mind the single
42-year-old was looking for. Her father promptly replaced
it with a 9 mm Kurz handgun.

"Men can overpower us," Price said. "You have to have
something that's bigger and badder than they are."

FRANCONIA, N.H. -A police officer was fatally shot and run over by a man
who had assaulted him four years earlier, authorities said Saturday. The
shooter, a cousin of ski champion Bode Miller, was then killed by a
passer-by who grabbed the officer's gun.
Attorney General Kelly Ayotte said Liko Kenney, 24, shot Cpl. Bruce McKay
four times, then ran over him with his car after a traffic stop Friday
evening.
Gregory Floyd, who was driving by with his son, grabbed McKay's gun, then
shot Kenney when he refused to put his gun down, Ayotte said.
"This once again reminds of us of the difficult and dangerous work that
is done everyday by the law enforcement of this state to protect each of
us," Ayotte said at a news conference in Concord. "The police officers
of
this state, including Cpl. McKay, are nothing short of heroes."
Authorities said McKay pulled Kenney over for speeding on Route 116.
Kenney then took off, and McKay pursued him for about a mile and half
before pulling his cruiser in front of Kenney's car and pushing it off
the road.
The officer used pepper-spray on Kenney and his passenger then turned
around, Ayotte said. That's when he was shot.
"Cpl. McKay's cruiser video confirmed for police investigating this case
that in fact Mr. Kenney had discharged several shots at Cpl. McKay before
running him over," Ayotte said.
Soon after, Floyd arrived and confronted Kenney while his son, also named
Gregory Floyd, called for help using the officer's radio. Authorities
have determined that his actions in shooting Kenney were justified.
An autopsy showed McKay died of four gunshot wounds. Autopsy results on
Kenney were incomplete Saturday.
McKay, 48, was a 12-year veteran of the Franconia Police Department and
previously had worked in Haverhill. Survivors include a daughter, Ayotte
said.
"It really tears at the fabric of the community and the fabric of the
state," said Gov. John Lynch, who visited the town of about 900 residents
Saturday. People paid their respects at the local police station,
bringing flowers.
Ayotte said McKay had "prior dealings" with Kenney, who was convicted
of
assaulting the officer and resisting arrest in 2003. Kenney's uncle said
the animosity between them was so great that if Kenney got pulled over by
McKay, "he had the right to request a different officer."
"That's what I heard, that Liko requested a backup officer and that was
when he was pepper-sprayed," said Bode Miller's father, Woody Miller.
Ayotte had no other details of the assault incident and brushed off
suggestions that McKay should have let someone else handle the traffic
stop given his history with the driver.
"This is a situation where this corporal is doing his job in Franconia .
he's not going to look the other way when he see someone violating the
law," she said. "The history is that Mr. Kenney was convicted of these
offenses. If the standard was that police officers were going to remove a
police officer from interacting with anyone who has a criminal history
that they had some involvement in, that frankly, would not make a lot of
sense."
The passenger in Kenney's car told police Kenney said something like "Get
another officer" just before speeding off after the initial stop, Ayotte
said.
"But he refused to produce a license and registration to Cpl. McKay,
which is standard operating procedure, and then just took off. So this is
a situation where he obviously disobeyed a police officer," she said.
Woody Miller said his nephew claimed the officer had once beaten him
during an arrest.
"They had a long relationship," said Miller, who operates an
international tennis camp in nearby Easton. "There's been physical
altercations between them before in the course of being arrested."
Bill Kenney, another uncle, agreed. "They had it in for each other."
Woody Miller said he last saw his nephew Friday morning, when Liko Kenney
was on his way to work. He was running late, but he was in good spirits.
Miller said Kenney, who lived next door to him, didn't have a steady job,
but often took work cutting firewood and picking fiddlehead ferns, a wild
green that grows in the region and is considered a delicacy.
Bode Miller, who had bailed his cousin out of jail once, was on his way
home to Franconia, his father said. In 2005, Bode Miller was fined $250
for going 83 mph in a 40 mph zone in his hometown of Franconia. According
to an article published on Sports Illustrated's Web site, SI.com, Miller
said he chose to contest the ticket "to try to get my fine reduced and to
antagonize McKay."
Lynch ordered all state flags be flown at half-staff in memory of the
officer. Franconia's Board of Selectmen released a statement saying that
the town "mourns the tragedy that befell our community on the evening of
May 11. ... We ask that you all embrace in your thoughts and feelings the
families affected by this tragic incident."
The shooting happened near this town in the White Mountain National
Forest, popular with skiers and tourists who visited the Old Man of the
Mountain, a rock formation and the state's symbol that crumbled into
pieces four years ago.
It's the second time in less than a year that a New Hampshire police
officer has been killed on the job. In October, when Manchester Officer
Michael Briggs was shot in the head while investigating reports of
gunshots in an alley. Michael Addison is charged with capital murder in
the shooting.

GMU Students for Concealed Carry formed at Virginia's George Mason University

George Mason University Students for Concealed Carry (GMU-SCC) is a
student group that has come together in the wake of the recent
Virginia Tech tragedy. The purpose of GMU-SCC is to advocate for
repeal of the administrative gun carry ban at George Mason University
(GMU) for concealed handgun permit holders.

Recent tragedies, such as the events at Virginia Tech and California
State University, have proved one thing: college campuses are not as
safe as students and parents were led to believe. Every citizen has
the right to protect him or her self, and GMU Students for Concealed
Carry demands that George Mason University recognize this right of
their law-abiding students.

George Mason University, located in Fairfax, Virginia, is the largest
school in Virginia with close to 30,000 students. Current policy at
GMU prevents students that hold concealed handgun permits from
bringing a handgun onto campus. These students are at least 21 years
of age, and many are military or law enforcement veterans.
Individuals who are not affiliated with the university, according to
state law, are not prohibited from carrying firearms for their
protection.

Andrew Dysart, the current president of GMU-SCC, recently founded the
organization. Dysart said "The irony of this situation is that
students attending the university can do nothing to protect
themselves from criminals, but non-students have this right. This
policy does not take into account that the vast majority of Concealed
Handgun Permit Holders are law abiding citizens; all have been
scrutinized by extensive background checks and taken courses in
handgun safety."

The current policy (George Mason University Administrative Policy NO.
56: Policy Preventing Weapons) is under review. It has been removed
from the University website, but a recent Freedom of Information Act
request revealed that it was enacted in 1995. Dysart said, "This
policy is outdated. It is not illegal for the general public to
carry a concealed handgun on a public university campus, so why deny
the campus community this same right? The fact is that any adult
student may be expelled from GMU for lawful gun carry, and the moment
they are expelled the same person can carry a handgun on a GMU campus
without recourse."

George Mason University Students for Concealed Carry is calling upon
the University to immediately change this outdated and unjust policy.

"First, we briefly recount the tragedy that led to this
lawsuit. Jennifer Braddock was issued three protective orders against James Hudson, the father of
her son, because Hudson repeatedly abused Braddock. In August 2001, while the third protective
order was in effect, Hudson broke into Braddock’s home and threatened her. She called the
Memphis Police Department, but it made no attempt to find him. Hudson eventually was convicted
of aggravated criminal trespass, vandalism, and violating the protective order, and sentenced to one
week in jail. Over the next two years, Braddock called the police several times to complain about
various violations of the protective order, including acts of physical violence, but the Memphis
Police took no action. Braddock’s struggle against Hudson’s violence ended when Hudson broke
into her home, killed her and two of her friends, then turned the gun on himself and committed
suicide."

"As a general principle, state actors cannot be held liable for private acts of violence under
a substantive due process theory. DeShaney v. Winnebago County Dep’t of Soc. Servs., 489 U.S.
189, 196 (1989); see also Castle Rock, 545 U.S. at ___, 125 S. Ct. at 2810. We recognize two
exceptions to this rule: (1) when the state has a special relationship to the victim, and (2) when the
state creates the danger that led to the victim’s harm. Jones v. Union County, 296 F.3d 417, 428 (6th Cir. 2002). In Jones, the plaintiff claimed that Union County, Tennessee, violated her substantive
due process rights when it failed to serve a protective order on her ex-husband, who later attacked
her. We held that “the Tennessee Legislature’s imposition of affirmative duties upon state officials
to serve ex parte orders of protection timely does not give rise to a due process claim cognizable
under § 1983 based upon a special relationship between Union County and Plaintiff.” Id. Similarly,
we hold that a protection order does not create a special relationship between police officers and the
individual who petitioned for that order.

Nor may the plaintiffs establish their claims under the state-created-danger theory. Under
this theory, a plaintiff must show “an affirmative act that creates or increases the risk, a special
danger to the victim as distinguished from the public at large, and the requisite degree of state
culpability.” McQueen v. Beecher Cmty. Schs., 433 F.3d 460, 464 (6th Cir. 2006) (citing Kallstrom
v. City of Columbus, 136 F.3d 1055, 1066-67 (6th Cir. 1998)). These officers’ alleged inaction fails
to satisfy the “affirmative act” requirement."

[Update in light of comments: the Court's treatment of due process falls into two categories. "Procedural" due process is what you'd normally think of as due process. A person got what process was due, a fair trial or procedure. "Substantive" due process is a strange bird, largely created to make the 14th amendment apply the Bill of Rights to the states. For example, if a state outlaws freedom of speech, it deprives a person of liberty without "due process" no matter how much process they give that person.]

No duty to protect. And yet, the anti-gunners in this country and the U.N. taking advantage of the Virginia Tech Massacre claiming the individual has not right of self-defense as they now call for a global gun control treaty! That is due cause for despare being forced legally to be a "sitting duck" for the oncoming genocide. Forget about going to a therapist to sort this out because there is not a movement to strip people with emotional problems of their Second Amendment rights. That's the old "Give the Government an inch worth of your rights and they will take a mile. Can you say, "slave?"

The following Washington Post article says that Fairfax County
officials are furious at VCDL over the Bloomberg Gun GiveAway being
held in a County building.

Our intention wasn't to upset them. We just wanted to help two
businesses defend themselves from NYC Vigilante Bloomberg's actions.
However, if they're upset, that's too bad. Rights (at least in
Virginia) are for everyone, not just the few elites (as in NYC).

You are NOT going to believe some of the statements in this article.
I did not have the time to work this item into the Update coming out
very shortly, but it is better as a stand alone alert item anyway.

Advocates to Give Away Guns to Protest Bloomberg's Lawsuits

RICHMOND -- A gun-rights organization is planning to hold a "gun
giveaway" next week inside a Fairfax County government building to
protest New York Mayor Michael R. Bloomberg's efforts to crack down on
illegal gun sales in Virginia.

On Thursday at the Mason District Government Center in Annandale, the
Virginia Citizens Defense League will hold a drawing for a
semiautomatic pistol, a hunting rifle and ammunition to raise money
for two gun shops that Bloomberg has filed suit against.

And because it's Virginia, many people at the "Bloomberg Gun Giveaway"
will probably be armed. League members routinely lobby the Virginia
General Assembly with guns on their hips.

Fairfax County officials are furious about a gun event staged in a
government building but say they can't do much to stop it because the
General Assembly won't allow local governments to ban the possession
of guns in public buildings.

"These people have concealed-weapons permits, and we know they are
packing, but they are legal," said Fairfax Supervisor Penelope A.
Gross (D-Mason). "I swore to uphold the law, whether I like it or
don't, and I don't."

Under Virginia law, a person 21 or older can obtain a permit for
carrying a concealed handgun. No permit is needed if someone 18 or
older wants to carry a gun in plain sight. The league, which says it
has 3,300 members, sent out an e-mail this week reminding members that
"lawful gun carry is optional at the Bloomberg Gun Giveaway."

The Citizens Defense League is trying to raise money for Bob Moates
Sport Shop in Richmond and Old Dominion Gun and Tackle in Danville,
two of the six Virginia dealers New York has sued. The legal
challenges stem from Bloomberg's effort to prove that Virginia is a
major contributor to violent crime in New York.

[And Bloomberg has failed miserably at this. Not one single targeted
gun store has been prosecuted for any such charge - PVC]

Convinced that Virginia gun dealers are selling weapons illegally,
Bloomberg sent undercover agents to the stores to conduct "straw
purchases," in which one person fills out a form and buys a gun for
someone else. According to a lawsuit filed a year ago in federal court
in Brooklyn, the city alleges that Bob Moates and Old Dominion Gun
illegally sold guns to Bloomberg's agents.

Philip Van Cleave, president of the Virginia Citizens Defense League,
said, "We are trying to protect the gun stores that Bloomberg
attacked." He called the Republican mayor "a vigilante. He has come
into Virginia and taken the law into his own hands."

Bloomberg spokesman Jason Post responded: "We will not for one second
back away from our tough law enforcement efforts against illegal guns,
which have made New York the safest big city in the country. We caught
gun dealers on videotape flagrantly violating the law."

To help pay the gun dealers' legal fees, the defense league has
encouraged people to buy weapons from the Moates and Old Dominion
stores. Those who spend more than $100 will have their names entered
into Thursday's drawing. Winners will be able to view the guns at the
meeting but will take possession of their weapon at a gun shop after
filling out the paperwork, Van Cleave said.

When she learned of the event last week, Gross intervened to see
whether the drawing was legal. Gross concluded that the county cannot
prohibit a group from using community meeting rooms because of its
political views. And because the organizers won't be selling tickets
at the meeting, Gross said it appears that the group is not violating
state or local laws regulating raffles.

Even so, Del. Adam P. Ebbin, a Democrat who represents parts of
Alexandria and Fairfax County, called the event "embarrassing."

The gun giveaway is turning off some sportsmen groups. "It really
gives legitimate gun owners and shooters a bad name when you see
something like this," said Fairfax resident Bob Ricker, executive
director of the American Hunters and Shooters Association.

Association," with prominent anti-gunner Robert Ricker in tow, is a
"sportsman's group?" Oh, please. That shell organization is

Fairfax has been pushing for state legislation that would allow local
governments to ban the possession of firearms in county buildings,
police stations and public libraries. The Republican-controlled
General Assembly has killed the bills, demonstrating the disconnect
between Northern Virginia and the rest of the state on gun-control
issues.

[This attempted gun ban dies every year because the General Assembly
knows it serves no purpose other than to stick gun owners in the eye.
It was Fairfax County years ago that admitted in front of a
subcommittee that their proposed gun ban would not be enforced
against "that kind of person," referring to a question about an armed
repairman who might drop in to fix something. The Delegates' jaws
dropped open with everyone wondering what kind of person it WOULD be
applied to. Oooops, Fairfax County, your agenda is showing! - PVC]

Del. C.L. "Clay" Athey Jr. (R-Warren) said law-abiding citizens who
carry guns shouldn't have restrictions placed on where they can go.

"The reality is, it may be helpful for someone who is qualified to
carry a concealed weapon to be there in a public building in case some
[shooting] occurs," said Athey, noting that many retired police
officers have concealed-weapons permits.

The Virginia Citizens Defense League was formed in 1994 to fight for
the rights of people who want to carry concealed weapons. The group
often spars with the Fairfax-based National Rifle Association, which
it accuses of being too willing to compromise on gun control.

compromise on gun control. Certainly not always. - PVC]

In Richmond, the league holds considerable influence among lawmakers
who represent rural areas. But the group is known for its aggressive
lobbying tactics in support of its agenda, including a bill that would
allow students to carry guns on college campuses.

State Sen. Jeannemarie Devolites Davis (R-Fairfax) said some league
members have threatened her in the past over her support for tougher
gun laws.

"They are mean-spirited, and they won't listen or reason," Devolites
Davis said.

about her. I think it is fair to say that if SHE would present us
with something REASONED we would be glad to listen! She's too busy
trying to be another Carolyn McCarthy, a ferociously anti-gun
Congresswoman from New York - PVC]

Bloomberg has said the group is made up of "sick people."

Mike Stollenwork, a defense league member from the Alexandria section
of Fairfax County, responded: "We are tenacious but polite. . . . We
defend civil liberties."

Senator Devolites-Davis's accusations that VCDL members have
'threatened' her and are "are mean-spirited, and they won't listen
or
reason" are most probably based on sour grapes.

Just this year, Senator Davis, who is running on a anti-gun platform
this fall, put in a bill that would hurt gun shows. VCDL fought that
bill vigorously and your efforts caused her bill to be repeatedly
passed by, as Davis could not get the votes to get it out of the
Senate Courts of Justice Committee.

She held a press conference that was supposed to be about her
'victory' in getting her gun show bill out of committee. Of course
that didn't happen, so it became a much different press conference
about her fight to get it out of committee.

There were more VCDL members sitting in on her press conference than
supporters! That was something that the Senator did NOT miss.

As soon as she ended the press conference the press rushed over to
interview VCDL members, ignoring Davis and her allies. That was
something that the Senator did NOT miss, either.

In the end, the only 'threats' that she has gotten from VCDL is to
her political aspirations. Those aspirations, hopefully, will go the
way of her gun show bill.

While VCDL strongly disagrees with you on firearm laws, VCDL
certainly does not condone threats of violence from our members to
anyone.

Nor do we take accusations against VCDL lightly.

I therefore ask that you provide me any and all information
concerning the threats that you told the Washington Post that you
have received from VCDL members. Please include associated police
reports, including arrest reports or judicial verdicts. We will then
investigate and remove any such offenders from our membership.

Do understand that someone who has said they will NOT vote for you or
who will actively support an opponent is NOT a threat of the nature
implied in the Washington Post.

I also ask that if you have no information on VCDL or its members
making threats to your physical (as opposed to political) safety,
that you issue a public apology forthwith.

Re: "Lock up your guns," by Ben Johnson, Letters, May 9.

Johnson suggests gun owners be forced to take IQ tests. Perhaps it is
people like Johnson who should be required to take an IQ test.

He obviously has a hard time distinguishing between things such as age
limits, background checks, professional training, licensing and being a
generally smart, responsible individual with good intentions.

All of which I might add this 12-year-old Ardrossan boy did not qualify
for when he decided to take a gun to school.

Johnson should give his head a shake. No one ever said children should
pack a gun at school. Only trained, checked and licenced adults should
have access to them.

Perhaps he should look at other culprits such as parenting,
glorification of illegal drugs and firearms in the media and nanny-state
brainwashing in schools.

Johnson would have us believe that millions of responsible gun owners
promoting a safer society for everyone, excluding criminals, is somehow
to blame. It doesn't make sense and we're not buying it.

Abstract: This article examines a broad range of international data that bear on two distinct but interrelated questions: first, whether widespread firearm access is an important contributing factor in murder and/or suicide, and second, whether the introduction of laws that restrict general access to firearms has been successful in reducing violent crime, homicide or suicide. Our conclusion from the available data is that suicide, murder and violent crime rates are determined by basic social, economic and/or cultural factors with the availability of any particular one of the worldÂ’s myriad deadly instrument being irrelevant.
