hollow river

Anyone ever gone down the hollow river from Robbins to crossover or wildcat lake? If so did you go there and back or head out the Haliburton Forest reserve? It seems pretty close to the border of the park and Im sure gets some pressure because of that but with my seasonal OCD kicking in I cant help but notice this little line on the map. Funny this was a proposed access point at one time and the ontario parks site references it for summer access to dividing lake.

Thanks in advance for any insight

Hope everyone got all the goodies they wanted for the holidays.

Happy New Year

Chris

call the boiler room at the forest h.q.
if i remember correctly there is private land that cuts into a section of the wildcat route. and access in that area has since been restricted by the land owner, not h.f. officals.
as far as the fishing. do your own due diligence, not on a public forum.

Thanks for the info. I dont think any landowner has a claim over water ways but definetly something to consider. As for due diligence, using the term liberally, I certainly will conduct my own investigations into the fishing, however, I just like the thought of going somewhere people do not frequent. Why not on a public forum? in this chat room we disscuss many fishing related ideas, places and pressures. The galipos lakes was another that received such pressure as stated in this forum. So while doing my homework, (due diligence)I thought this forum to be a great resource.

Did I miss something to change this? I know the park publishing the fish survey results was a source of contention?

Regards

Chris

Sorry if I came across wrong, just wondered if anyone had travelled here recently. I did not realize the problem that arose on the forum regarding fishing. Thank you for the info on the route.

Regards

Chris

I did travel the Hollow River from McGarvey Lake to Crosscorner Lake during early May of 2006 and only seen a few footsteps, probably the clearing crew as we had made reservations. We then made our way up to Dividing Lake. Lots of wildlife was spotted along the river and we did fish a bit with no success as the river is more marsh like.

It is a widely held false assumption that a waterway can be accessed publicly on private lands. There are many factors that determine right of access. Some include wheather the waterway is considered "navigable" - this is a complex definition that is determined by historic use of the waterway, assignment of "water rights" which gives ownership of the river bottom, and annual water levels throughout the year. Just because you can get a canoe down a creek does not make it "navigable" in the leagal sence.
Also, even on navigable waterways the moment you step out of your canoe onto private land to pull it over a beaver dam or other obstruction you are trespassing.
Your best bet is to find out and ask permission to be on pivate property. If the permission is refused - respect this and find another place to go.
Ontario is a big place with lots of nice public access areas to visit. If everybody stuck to the public areas, or bought their own nice private spot there would be a lot less conflict.

There are a lot of exceptions though... ie in many places there are still shoreline road allowances of 66ft, plus the public lands act has specific exemptions for portaging on previously established portages...

That being said, it's quite a complicated issue. If it's of interest one should take some time to do their own research.

private issue

January 6 2009, 7:17 PM

I live in SW ontario, theres been alot of issues about private land and waterways. Some that come to mind surround the nith and the credit rivers, but fisherman fishing salmon and trout in the seasonal runs have had issues on most rivers from the ausble right up to the pine. My understanding was that although most have rights to the land right to the banks, and even the bottom but the water flows through and isnt included. The other add on to the historical portages and route allowances was that historic dams could also be rebuilt by private landowners.
That said as mentioned previously as soon as you step out you are now in the wrong. Very complex issue indeed and local practice also plays a role. Best bet to just contact the parties involved of course, get any permissions and not worry about it.
Sounds like this route would be a spring only route due to water levels, and the private lands are mostly on the lakes in the system. Not the river which was what I originally was asking about.

Thanks for all the input, if I find out anything else in my reseaarch I will be sure to pass it on.
