What law? The OP sounded like they were giving an opinion not some lengthy California law thing. I think there was foul play involved because I think they argued and he pushed her and she landed in the water. Not like those stupid scenarios that were on here and on that Simone blog about grabbing her kicking and screaming and holding her under the water. He was drunk and panicked and went back inside. This was when he started concocting a story. I don't think the guy said oh great! I'll take her on the boat this weekend and push her overboard.
