Hi i have sold a item on ebay and it was a graded pack. The pack was a 1986 fleer basketball pack graded gai 9 from a full box . Here is the story the buyer bought the pack as a buy it now and i sent it to him right away. when he received the pack he said to me that the pack inside the gai holder is not legit ,resealed , and there are two small holes in the pack with gum powder in it . I responded by saying that this is a expert grading compony if you have a problem with the grade please talk to them there is nothing i can do , the tears in the pack were not there when the pack was sent the pack is in great shape with no tears ebay Item number: 250420124614 I also said if you would like to file a damage item to the post office i can help. I then got a email saying he filed a paypal clam on the pack and just want to know what to expect .Now my paypal account is on hold and i cant pay for items i won on ebay . Over 1000 transactions on ebay and first time i have had a problem selling.

Paypal only protects the buyer! It does not protect the honest seller with the dishonest buyer who is willing to tamper or exchange product. Sounds like buyer did a switch to me if you are 100% cetain yhese flaws were not there before? That is why it is good to take high resolution scans in your auctions and then you may be covered?

This has happened to me. Paypal won't let you use your account unless you provide cash in the amount of the transaction in dispute. That disputed $$ will be held by paypal until the claim is resolved. It will most likely be released to the buyer and you will be out a pack and the final transaction price and ebay fees and paypal fees. Not good.
I've also been in a situation as a buyer where the eBay seller closed shop and ran with my PSA 8 OPC Gretzky rc money. I only got $300 back because the seller did not have enough eBay feedback for the transaction to qualify as fully insured by paypal.
Lesson- paypal sucks. Buyers and sellers who abuse paypal are even worse.

this is a sad thing to hear how buyers have so much power with paypal that the bad buyers can take advantage of good sellers rather easily.
it is a lot of money to swallow in the amount lost but it also happened to me and it has also happened to other ebay sellers that i know real well on this forum.
no wonder ebay sellers are dropping like flies from ebay.
in my case a buyer bought an item from me on ebay and chose my regular surface shipping, paid with paypal, claimed he did not get it, got his money back, i lost the item and the money and to top it all off that buyer relisted the exact same lot i sold him on ebay rubbing it right in my face !!
imagine how F@@@ing angry i was. thankfully he got caught later on and got kicked off ebay.i still never did get my money back.
ebay's real name should be evilbay.

Can't you contact PayPal and request that the buyer return the pack to you. That seems only fair since she got a refund of her purchase price.
I don't understand how PayPal can give a buyer a refund without making sure that the seller gets the item back!
I have to agree with everyone else--PayPal only protects the buyer. I'm not sure why they don't do anything to make sure that the seller doesn't get ripped off, like in this case!
What does PayPal say about the return of the item?
What about the buyer? Is he willing to return the item?
I don't want to sound naive about this. Maybe his goal was to keep the get a refund and keep the pack, but if he honestly believed that the pack was tampered with, he should be willing to return it once he has gotten his refund.
Thank you guys for your support. I am so upset with this i have already talked to paypal a number of time today about this. I am a collector and only sold this pack because i needed the $ to pay a bill. I am done with ebay selling 100% now i will never sell anything again on ebay when i have no pertection. paypal told me that the pack will be returned to me and once they know i have received the pack thay are going to release the funds to him. I asked them what happens if i dont get the pack and he sends me a empty box or it has been removed from the gai case they said. not much we can do but you can try to appel the case, that did not sound good to me seeing now they always side with the buyer in every case.
paypal should look into doing something to help the honest seller because we are the ones paying all the fees!!

To put things in perspective, sellers aren't the only ones getting the wiener, although i realize it's slanted in the buyers favor.
A buyer buys a fairly expensive card ~ As per paypal rules and for Buyer/ Seller protection ~ purchases.. Delivery Confirmation so the item gets tracked to the doorstep of the recipient ~ and gets signed for upon it's arrival. Sounds bulletproof doesn't it. Item gets tracked to your doorstep and you sign for it when it arrives = PROOF OF DELIVERY!! So what can go wrong??
well .... that rare 1K King Clancy card you bought ~ turns into a one cent 1990 Pro Set Borje (King) Salming card. Paypal sides with the seller 100% of the time ~ because he can prove delivery!!! YOU LOSE the card and the money.
Hi I proved to paypal he received the pack but the buyer won because he said it was not as described so that did not work for me i sent it with full insurance express with tracking and signiture and still lost. So as long as a buyer says it is not as described thay win
I like that fact that PayPal allows you to file a claim for something that is "significantly not as described." That protects me as a buyer. But the seller should get this item back.
If the pack is returned, then I would say that the transaction was fair. It's no different than returning something to a store and getting a full refund. The store can restock the item or return it to the supplier for a refund.
I have heard stories like this for years, but in all my years on eBay, nothing like this ever happened to me. Long before PayPal I was ripped off a couple of times for small amounts. I have bought hundreds of items on eBay and I have sold hundreds of items on eBay and almost every transaction was great.
This buyer has good feedback, although it wasn't extremely high. His rating was a little over 100 with 100% positive. I didn't see that he had given any negative feedback either. He might still return the item intact. Keep us informed!
